90This cause came on to be heard pursuant to Sections 766.304
101and 766.305(6), Florida Statutes, 1 upon the stipulation and joint
111petition of the parties, filed July 2, 2004, for the entry of an
124order approving the resolution o f a formal claim for
134compensation benefits heretofore filed in this cause in
142accordance with the provisions of Chapter 766, Florida Statutes,
151and a resolution of the exclusive remedy otherwise available as
161outlined in Chapter 766, Florida Statutes.
167By the terms of their stipulation, the parties have agreed,
177inter alia , that Petitioners (Claimants), John Romine and
185Rebecca Romine, as the parents of Loren Romine, a minor, receive
196from Respondent a lump sum payment of One hundred thousand
206dollars ($100,000.00) , as authorized by Section 766.31(1)(b)1,
214Florida Statutes; that Claimants receive from Respondent a lump
223sum payment of Four hundred fifteen thousand four hundred
232ninety - five dollars and ninety - one cents ($415,495.91), for
244medical expenses (custodial care , nursing expenses, medical
251equipment and supplies, prescriptions, specialty foods, therapy
258expenses, and travel and vehicle expenses) incurred from
266January 26, 1998, through December 31, 2003, as authorized by
276Section 766.31(1)(a), Florida Statutes; and t hat Respondent pay
285McMillen, Reinhart & Voght, P.A., attorneys for Claimants, an
294agreed - upon attorneys' fee of Thirty - five thousand six hundred
306eighty dollars ($35,680.00), and costs of Seven thousand fifty -
317two dollars and thirty - four cents ($7,052.34), as reasonable
328expenses incurred in connection with the filing of the claim,
338including all appellate fees and costs, as authorized by Section
348766.31(1)(c), Florida Statutes.
351After due consideration of the interests of all parties,
360and being otherwise fully ad vised in the premises, it is
371ORDERED that:
3731. The stipulation of the parties, filed July 2, 2004, is
384hereby approved, and the parties are directed to comply with the
395terms thereof.
3972. Petitioners, John Romine and Rebecca Romine, as the
406parents of Loren Romine, a minor, are awarded One hundred
416thousand dollars ($100,000.00), pursuant to Sections
423766.31(1)(b)1, Florida Statutes, to be paid in lump sum.
4323. Petitioners, John Romine and Rebecca Romine, as the
441parents of Loren Romine, a minor, are awarded Fou r hundred
452fifteen thousand four hundred ninety - five dollars and ninety - one
464cents ($415,495.91), pursuant to Sections 766.31(1)(a), Florida
472Statutes, for expenses incurred through December 31, 2003, to be
482paid in lump sum.
4864. Respondent shall pay McMillen, Reinhart & Voght, P.A.,
495attorneys for Claimants, an attorneys' fee of Thirty - five
505thousand six hundred eighty dollars ($35,680.00) and costs of
515Seven thousand fifty - two dollars and thirty - four cents
526($7,052.34), as reasonable expenses incurred in connecti on with
536the filing of the claim, including all appellate fees and costs,
547pursuant to Section 766.31(1)(c), Florida Statutes.
5535. Upon payment of the award of One hundred thousand
563dollars ($100,000.00) to the Petitioners; payment of the award
573of Four hundre d fifteen thousand four hundred ninety - five
584dollars and ninety - one cents ($415,495.91), to the Petitioners
595for expenses incurred through December 31, 2003; and payment of
605the award of Forty - two thousand seven hundred thirty - two dollars
618and thirty - four cent s ($42,732.34) for attorneys' fees and costs
631incurred in connection with the filing of the claim, including
641all appellate fees and costs, the claims of Petitioners shall be
652deemed fully satisfied and extinguished, except for Respondent's
660continuing obligat ion under the provisions of Section 766.31,
669Florida Statutes, to pay future expenses (those incurred after
678December 31, 2003), as incurred.
6836. The Division of Administrative Hearings retains
690jurisdiction over this matter to resolve any dispute as to the
701i nterpretation of any provision of the parties' stipulation and
711to resolve any disputes, should they arise, regarding the
720parties' compliance with the terms of such stipulation.
