106STATEMENT OF THE ISSUE

110Whether the Respondent failed to provide proof of

118workers' compensation coverage or exemption, and proof of

126having completed 14 hours of approved continuing education in

135response to an audit conducted by the Electrical Contractors

144Licensing Board for the biennium commencing September 1, 1996,

153and terminating on August 31, 1998, in violation of Subsection

163489.533(1)(o), Florida Statutes, by violating Subsections

169489.515(3) and 489.517(3), Florida Statutes, and Rule 61G6-

1779.011, Florida Administrative Code, as alleged in the Amended

186Administrative Complaint.

188PRELIMINARY STATEMENT

190This cause was heard pursuant to a request for hearing

200involving material disputed facts filed by the Respondent.

208The Petitioner was permitted to file an Amended Administrative

217Complaint, upon motion, to include both electrical contractor

225license numbers that have been held by the Respondent. The

235Amended Administrative Complaint alleged two counts. Count I

243alleges the failure to document adequate insurance during the

252board audit, specifically the workers' compensation coverage

259or exemption. Count II alleges the failure to document the

269required amount of board approved continuing education.

276Prior to commencement of the proceedings herein, the

284Administrative Law Judge informed the parties that prior to

2931975, he had been counsel for the Electrical Contractors

302Licensing Board (the ECLB) while employed as an assistant

311attorney general. The parties waived any potential objection

319to this fact and agreed to proceed with the hearing.

329At the hearing the Petitioner presented the testimony of

338George Ayrish, Program Administrator for the ECLB. The

346Petitioner submitted exhibits numbered 1 through 11 which were

355admitted into evidence.

358The Respondent, David Karably, appeared and represented

365himself at the hearing. The Respondent presented exhibit

373number 1 which was admitted into evidence. The Respondent was

383permitted to testify in narrative fashion.

389Both parties filed post-hearing briefs which were read

397and considered in the preparation of this Recommended Order.

406FINDINGS OF FACT

4091. The Petitioner is the State of Florida, Department of

419Business and Professional Regulation (DBPR), the state agency

427charged with regulating the practice of electrical contracting

435in Florida and those licensed under Chapter 489, Florida

444Statutes, pursuant to Section 20.165, and Chapter 455, Florida

453Statutes.

4542. The Respondent is, and has been at all times material

465to the allegations in the Amended Administrative Complaint, an

474electrical contractor licensed by the Electrical Contractors

481Licensing Board. From 1987 until 2000, the Respondent was a

491registered electrical contractor, holding license number

497ER 0010816. Since August of 2000 the Respondent has been a

508certified electrical contractor holding license number EC

5150002356. The Respondent's practice pursuant to his registered

523license was a prerequisite to issuance of his certified

532license.

5333. All insurance and continuing education requirements

540for renewal of a license issued by the ECLB are set forth in

553Sections 489.515 and 489.517, Florida Statutes, as well as

562Rule 61G6-9.004, Florida Administrative Code, and are

569identical for certified and registered electrical contractors.

5764. In March of 1999 the ECLB conducted a random audit of

588the insurance and continuing education requirements

594established in Rule 61G6-9.004, Florida Administrative Code,

601for the biennium commencing September 1, 1996, and terminating

610August 31, 1998. The Respondent was one of the licensees

620randomly chosen for this audit.

6255. In response to the initial audit letter sent to the

636Respondent on March 17, 1999, the Respondent submitted

644insurance and continuing education documentation. This

650documentation reflects : no evidence of workers' compensation

658coverage or exemption for the audit period; no evidence of

668approved continuing education for the audit period; and no

677evidence of required liability insurance for the audit period.

686The continuing education documentation submitted by the

693Respondent was for the prior biennium, in February 1996.

7026. On July 19, 1999, the ECLB forwarded the Respondent a

713follow-up letter, indicating that he was still lacking the

722documents enumerated in Finding of Fact Number 5. In response

732to this letter, the Respondent submitted documentation of the

741required liability insurance and of workers' compensation for

749May 1, 1997 through June 22, 1999.

7567. At hearing, the Respondent produced a document

764similar to those previously provided to the DBPR documenting

773his workmen's compensation insurance from March 1, 1995 to

782May 1, 1997. The date of this document was the same as the

795date on the materials previously furnished to DBPR.

8038. The Respondent testified that his insurance agent had

812faxed the requested documents to DBPR and sent copies to him.

823He received all of the documents substantiating his insurance

832from May 1, 1997 until June 22, 1999. His agent presumably

843forwarded or faxed the same documents to DBPR. DBPR produced

853all the documents except the one for the period of March 1,

8651995 until May 1, 1997.

8709. The Respondent provided enough information to raise a

879genuine question whether this document was lost by DBPR. It

889is concluded that it is as likely DBPR lost the record as it

902is the record was not sent.

90810. There was no additional documentation of the

916required continuing education submitted at hearing.

92211. Subsequent to the completion of the audit, the ECLB

932initiated a complaint with the Bureau of Consumer Services at

942DBPR. This complaint alleges that the Respondent failed to

951document required workers' compensation coverage or exemption

958for the entire audit period and failed to document required

968continuing education within the audit period.

97412. The Respondent was initially issued citations for

982resolution of the alleged violations herein. Each of these

991citations provided for a $500 administrative fine. The

999continuing education violation was documented as DBPR case

1007number 2000-08338 and the workers' compensation violation was

1015documented as 2000-05654. The Respondent chose to dispute

1023these citations, and as a result, this matter was handled

1033pursuant to the provisions of Section 455.225, Florida

1041Statutes.

104213. The Respondent has failed to document completion of

105114 hours of board approved continuing education between

1059September 1, 1996 and August 31, 1998.

106614. The Respondent failed to obtain any board approved

1075continuing education between September 1, 1996 and August 31,

10841998.

108515. In DBPR case number 2000-08338, the Petitioner

1093incurred non-legal costs in the amount of $31.70.

110116. In DBPR case number 2000-05654, the Petitioner

1109incurred non-legal costs in the amount of $42.47. However,

1118this cost may not be recovered.

1124CONCLUSIONS OF LAW

112717. The Division of Administrative Hearings has

1134jurisdiction over the parties and subject matter in this case,

1144pursuant to Section 120.569, Florida Statutes.

115018. The Department of Business and Professional

1157Regulation, Electrical Contractors Licensing Board has

1163jurisdiction to enter the final order in this case pursuant to

1174Chapters 455 and 489, Florida Statutes.

118019. Pursuant to Subsection 489.515(3), Florida Statutes,

1187licensees of the ECLB must have obtained liability insurance

1196and workers compensation insurance or exemption prior to

1204renewal of their certificate or registration.

121020. Pursuant to Sections 489.510 and 489.515(3), Florida

1218Statutes, the ECLB is authorized to require documentation of

1227workers' compensation or exemption by random audit.

123421. Pursuant to Section 489.517(3)(a), Florida Statutes,

1241and Rule 61G6-9.004, Florida Administrative Code, licensees of

1249the ECLB must provide proof of at least 14 classroom hours of

1261continuing education during each biennium, as a condition of

1270each renewal.

127222. Pursuant to Section 489.515, Florida Statutes, and

1280Rule 61G6-9.011, Florida Administrative Code, the ECLB is

1288authorized to require documentation of continuing education by

1296random audit.

129823. The evidence presented raises legitimate questions

1305whether the documentation for the period March 1, 1995 to May

13161, 1997, was misplaced by DBPR. The Petitioner failed to meet

1327its burden of proof by clear and convincing evidence that the

1338Respondent failed to document workers' compensation coverage

1345or exemption in response to the ECLB audit, thereby violating

1355Sections 489.510 and 489.515(3), Florida Statutes, which

1362constitutes a violation of Subsection 489.533(1)(o), Florida

1369Statutes, as alleged in Count I of the Amended Administrative

1379Complaint.

138024. The Petitioner has met its burden of proof by clear

1391and convincing evidence that the Respondent failed to document

1400completion of 14 hours of board approved continuing education

1409for the September 1, 1996 through August 31, 1998, biennium in

1420response to the ECLB audit, thereby violating Section

1428489.517(3)(a), Florida Statutes, which constitutes a violation

1435of Section 489.533(1)(o), Florida Statutes, as alleged in

1443Count II of the Amended Administrative Complaint.

145025. The disciplinary guidelines applicable to violations

1457of Chapter 489 Part II are found in Rule 61G6-10.002, Florida

1468Administrative Code. Subsection (15)(d) of this rule provides

1476the following penalty for a violation as alleged in Count II

1487of the Amended Administrative Complaint, for failure to

1495provide required proof of public liability insurance, required

1503proof of workers' compensation insurance or exemption, or

1511required proof of continuing education in response to an audit

1521required by the board (Rules 61G6-5.008 and 61G6-9.011,

1529Florida Administrative Code). First violation: $500 fine for

1537each requirement to probation and fine, or suspension.

1545RECOMMENDATION

1546Based upon the foregoing Findings of Fact and Conclusions

1555of Law set forth herein, it is

1562RECOMMENDED:

1563That a final order be entered imposing an administrative

1572fine of $500 against the Respondent for Count II of the

1583Amended Administrative Complaint. It is further recommended

1590that the Respondent be required to pay the non-legal costs

1600incurred by the Petitioner in both agency cases totaling

1609$31.70.
