152The issue is whether, as provided by the relevant statutes,
162Respondents owe Petitioner money for the sale of agricultural

172PRELIMINARY STATEMENT
174By Amended Complaint served June 14, 2001, Petitioner
182alleged that Respondents owed it $1190 for the sale of avocados
193on November 25, 2001. This complaint commenced DOAH Case
202No. 01 - 3320.
206By Amended Complaint served June 14, 2001, Petitioner
214alleged that Respondents owed it $54,519.25 for the sale of
225avocados, limes, and papayas from November 28, 2000, through
234February 5, 2001. This complaint commenced DOAH Case No.
24301 - 3321.
246By responsive pleadings served July 18, 2001, Respondent
254Small Indian Corporation requested a formal hearing.
261During the prehearing conference conducted by telephone on
269October 11, 2001, the parties agreed to present the case by
280stipulation. Accordingly, on October 12, 2001, the parties
288filed a Stipulation, which is the source of all of the factual
300findings conta ined in this Recommended Order.
307FINDINGS OF FACT
3101. At all material times, Petitioner, which is located in
320Homestead, Florida, has been a producer of agricultural
328products. At all material times, Respondent Small Indian
336Corporation (Respondent) has been a dealer in agricultural
344products.
3452. Respondent Cumberland Casualty and Surety Company, as
353surety (Surety), issued a bond to Respondent, as principal, in
363the amount of $27,600 for the period, November 26, 1999, through
375November 25, 2000. Surety also issue d a bond to Respondent in
387the same amount for the following bond year.
3953. During the periods covered by this case, Petitioner
404sold to Respondent numerous avocados, limes, and papayas. The
413shipments were timely and conformed in quality and quantity to
423the o rders. Petitioner timely issued invoices to Respondent for
433the sales of these agricultural products, but Respondent never
442paid any portion of these invoices.
4484. On May 25, 2001, Petitioner filed a complaint with the
459Department of Agriculture and Consumer S ervices (Department) for
468the period from November 22, 2000, through February 5, 2001.
4785. The Department required Petitioner to file separate
486complaints by bond year. Thus, Petitioner filed an amended
495complaint for $1190 for the bond year ending November 25, 2000,
506and an amended complaint for $54,591.25 for the bond year ending
518November 25, 2001. The date of the lone invoice within the bond
530year ending November 25, 2000, was November 22, 2000. The
540amended complaint concerning the bond year ending Novemb er 25,
5502000, commenced DOAH Case No. 01 - 3320, and the amended complaint
562concerning the bond year ending November 25, 2001, commenced
571DOAH Case No. 01 - 3321. The allegations as to dates and amounts
584of invoices are all correct.
589CONCLUSIONS OF LAW
5926. The Divis ion of Administrative Hearings has
600jurisdiction over the subject matter. Sections 120.57(1) and
608604.21(6), Florida Statutes.
6117. Section 604.21(1), Florida Statutes requires that all
619complaints against agricultural dealers, such as Respondent, and
627their sur eties, such as Surety, must be filed within six months
639from the date of the sale.
6458. The complaint filed on May 25, 2001, was timely as to
657all invoices except the sole invoice that is the subject of DOAH
669Case No. 01 - 3320 and totals $1190. The six - month fili ng
683deadline for this invoice expired on May 22, 2001. Thus,
693Petitioner has proved its entitlement only to the $54,591.25
703that is the total of the invoices that are the subject of DOAH
716Case No. 01 - 3321.

724RECOMMENDED that the Departme nt of Agriculture and Consumer
733Services enter a final order dismissing the amended complaint in
743DOAH Case No. 01 - 3320 and finding Respondent liable to
754Petitioner in DOAH Case No. 01 - 3321 for the sum of $54,591.25.
