101STATEMENT OF THE ISSUE

105The issue is whether Respondent is guilty of discriminating

114again st Petitioner in employment based on his age, in violation

125of Section 760.10(1)(a), Florida Statutes.

130PRELIMINARY STATEMENT

132By Petitioners' Request for Administrative Hearing filed

139August 24, 2001, Petitioner alleged that Respondent terminated

147Petitione r due to age discrimination.

153At the hearing, Petitioner called three witnesses and

161offered into evidence four exhibits: Petitioner Exhibits 1 - 3

171and 5. Respondent called four witnesses and offered into

180evidence 21 exhibits: Respondent Exhibits 1 - 21. All exhibits

190were admitted.

192The parties did not order a transcript.

199FINDINGS OF FACT

2021. Petitioner was born on September 13, 1955. He was

212initially employed by Respondent in 1996. He remained employed

221with Respondent until he was terminated in late Novem ber 2000.

2322. At the time of his termination, Petitioner served as

242the Assistant Director of Parks. His immediate supervisor was

251Julio Martinez, who was the Director of Parks.

2593. On July 18, 2000, Yioset de la Cruz was elected Mayor

271of Respondent. Mayor d e la Cruz had been employed by Respondent

283during the administrations of Mayors Oliveros, Fatima, and

291Morejon. However, Mayor Morejon terminated the employment of

299Mr. de la Cruz, as well as several other employees who had

311served under Mayor Fatima.

3154. Run ning on the promise to clean up the city, Mr. de la

329Cruz won 57 percent of the vote and defeated then - Mayor Morejon.

342When he assumed office, Mayor de la Cruz had to address several

354pressing financial issues, including a projected deficit of

362$540,000 for t he fiscal year and the cancellation of

373Respondent's insurance by The Florida League of Cities.

3815. At the same time, the people of Hialeah Gardens had

392become dissatisfied with the maintenance and operation of their

401city parks, which are the most visible refl ection of the quality

413of their city government. Appointing Arturo Ruiz to oversee the

423parks and their maintenance and operation, Mayor de la Cruz

433nonetheless remained directly involved in parks administration

440by imposing new discipline upon parks workers to ensure public

450satisfaction with the maintenance and operation of city parks.

4596. Shortly after disciplining Petitioner for improper use

467of his city telephone, Mayor de la Cruz visited Respondent's

477office, which was located in one of the major city parks, to

489assure that city park employees had completed their preparations

498for the long holiday weekend of Thanksgiving 2000. Unable to

508find Petitioner at his office, Mayor de la Cruz asked to see

520Petitioner's time card and found that he had not punched out for

532the day. After driving through nearby parks in search of

542Petitioner, Mayor de la Cruz returned to the office, where the

553secretary belatedly informed him that Petitioner had called in

562to say that he had fallen ill and asked that another employee

574punch him out for the day.

5807. After Mayor de la Cruz and the secretary finished

590speaking, Mayor de la Cruz spoke with Petitioner by telephone.

600When Mayor de la Cruz attempted to discuss the matter with

611Petitioner, Petitioner became disrespectful and insubordinate.

617Petitioner began screaming and swearing at the Mayor, who

626responded by promptly firing Petitioner.

6318. The evidence in this case is clear that Mayor de la

643Cruz fired Petitioner due to his insubordination, not due to his

654age.

655CONCLUSIONS OF LAW

6589. The Di vision of Administrative Hearings has

666jurisdiction over the subject matter. Section 120.57(1),

673Florida Statutes.

67510. Section 760.10(1)(a), Florida Statute, prohibits

681employment discrimination based on age.

68611. Petitioner has failed to prove that he lost his job

697due to discrimination based on Petitioner's age. Mayor de la

707Cruz was trying to regain the confidence of the public in the

719administration of the city's parks, and he reasonably required

728the cooperation of the city parks employees in this effort.

738Petitioner's ill - tempered display reasonably demonstrated to the

747Mayor that he could not rely on Petitioner's cooperation in this

758effort. Without delay, the Mayor fired Petitioner for

766insubordination and did so with ample cause.

77312. Respondent's request for attorneys' fees and costs is

782denied.

783RECOMMENDATION

784It is

786RECOMMENDED that the Florida Commission on Human Relations

794enter a final order dismissing Petitioner's Request for

802Administrative Hearing.
