101STATEMENT OF THE ISSUE

105The issue is whether Respondent is guilty of discriminating

114ag ainst Petitioner in employment based on his age, in violation

125of Section 760.10(1)(a), Florida Statutes.

130PRELIMINARY STATEMENT

132By Petitioners' Request for Administrative Hearing filed

139August 24, 2001, Petitioner alleged that Respondent terminated

147Petiti oner due to age discrimination.

153At the hearing, the parties agreed to incorporate the

162evidentiary record of the hearing conducted the previous day in

172Rolanda Boada v. City of Hialeah Gardens , DOAH Case No. 01 - 3463.

185The evidentiary record in that case con sists of the testimony of

197three witnesses called by Petitioner, four witnesses called by

206Respondent, Petitioner Exhibits 1 - 3 and 5, and Respondent

216Exhibits 1 - 21. In addition, Petitioner offered eight additional

226exhibits: Petitioner Exhibits 6 - 13; Respond ent offered twelve

236additional exhibits: Respondent Exhibits 22 - 33; Petitioner

244called seven witnesses; and Respondent called four witnesses.

252All of the exhibits were admitted.

258The parties did not order a transcript.

265FINDINGS OF FACT

2681. Petitioner was born on June 26, 1943. He has served as

280a city council member and mayor of Hialeah, which, during his

291three - year term as mayor, had 230,000 residents and nearly 1,200

305city employees. Petitioner has served on the Dade League of

315Cities for seven or eight years , as well as the United States

327League of Cities and a committee of the United States Department

338of Housing and Urban Development. From October 1998 through

347November 27, 2000, Petitioner served as Park Director of

356Respondent, which is considerably less pop ulated than Hialeah.

3652. On July 18, 2000, Yioset de la Cruz was elected Mayor

377of Respondent. Mayor de la Cruz had been employed by Respondent

388during the administration of Mayors Oliveros, Fatima, and

396Morejon. However, Mayor Morejon terminated the employme nt of

405Mr. de la Cruz, as well as several other employees who had

417served under Mayor Fatima.

4213. Running on the promise to clean up the city, Mr. de la

434Cruz won 57 percent of the vote and defeated then - Mayor Morejon.

447When he assumed office, Mayor de la Cruz had to address several

459pressing financial issues, including a projected deficit of

467$540,000 for the fiscal year and the cancellation of

477Respondent's insurance by the Florida League of Cities.

4854. At the same time, the people of Hialeah Gardens had

496become dis satisfied with the maintenance and operation of their

506city parks, which are the most visible reflection of the quality

517of their city government. Appointing Arturo Ruiz to oversee the

527parks and their maintenance and operation, Mayor de la Cruz

537nonetheless remained directly involved in parks administration

544by imposing new discipline upon parks workers to ensure public

554satisfaction with the maintenance and operation of city parks.

5635. Relations between Petitioner and Mr. Ruiz, who was the

573Director of Administra tion for Respondent, were often strained.

582Mr. Ruiz felt that Petitioner did not cooperate with him, but

593instead forced Mr. Ruiz to perform Petitioner's job by following

603through on parks projects until their completion.

6106. At the same time, Mayor de la Cruz felt that the

622condition of the parks was not improving. Mayor de la Cruz

633believed that Petitioner was at fault in failing to execute the

644Mayor's policies on maintaining and operating the parks.

6527. There is considerable dispute between Petitioner and

660his w itnesses and Respondent and its witnesses as to whether the

672perceptions of Mayor de la Cruz and Mr. Ruiz were accurate

683concerning the inadequacies of Petitioner's job performance.

690For instance, Mayor de la Cruz testified to a long list of jobs,

703such as th e erection of signage and repair of an air

715conditioning unit, that went undone or were finished too slowly

725under Petitioner. The Mayor also detailed dramatic improvement

733in the condition of the parks after the termination of

743Petitioner. On the other hand , Petitioner testified that

751Respondent did not have the funds for certain jobs, such as

762major drainage work, and that other work necessarily required a

772long time to complete. Petitioner also detailed dramatic

780deterioration in the condition of the parks af ter his

790termination.

7918. It is undisputed that Mayor de la Cruz fired Petitioner

802in late November 2000, a few days after firing Petitioner's

812Assistant Park Director, Rolanda Boada, for insubordination.

8199. It is not seriously disputed that Mayor de la Cruz did

831not fire Petitioner due to age discrimination. The Mayor claims

841that he fired Petitioner due to poor job performance.

850Petitioner claimed in a newspaper interview shortly after the

859termination that his termination was due to politics. While

868testifying, Petitioner repeated the same claim several times on

877direct until he finally -- and unconvincingly -- recalled that his

888age was also a reason for his termination.

89610. Whether Mayor de la Cruz fired Petitioner due to the

907Mayor's perception of poor job performan ce or insufficient

916loyalty is irrelevant to this case because the evidence fails to

927establish that the Mayor terminated Petitioner due to his age.

937CONCLUSIONS OF LAW

94011. The Division of Administrative Hearings has

947jurisdiction over the subject matter. Se ction 120.57(1),

955Florida Statutes.

95712. Section 760.10(1)(a), Florida Statutes, prohibits

963employment discrimination based on age.

96813. Petitioner has failed to prove that he lost his job

979due to discrimination based on Petitioner's age. Mayor de la

989Cruz was trying to regain the confidence of the public in the

1001administration of the city's parks. He either perceived that

1010Petitioner was not doing an adequate job in administering the

1020parks or that the Mayor needed a person more committed to the

1032Mayor and the implementation of his programs. Either way, the

1042Mayor did not fire Petitioner due to his age.

1051RECOMMENDATION

1052It is

1054RECOMMENDED that the Florida Commission on Human Relations

1062enter a final order dismissing Petitioner's Request for

1070Administrative Hearing .
