180PRELIMINARY STATEMENT

182On September 7, 2001, Cecilia Roberts Young, as grandmother

191and guardian of Alon zo Hall, Jr., a minor (Alonzo), filed a

203petition (claim) with the Division of Administrative Hearings

211(DOAH) for compensation under the Florida Birth - Related

220Neurological Injury Compensation Plan (Plan).

225DOAH served the Florida Birth - Related Neurological I njury

235Compensation Association (NICA) with a copy of the claim on

245September 12, 2001. NICA reviewed the claim and on January 22,

2562002, gave notice that it had "determined that such claim is not

268a 'birth - related neurological injury' within the meaning of

278S ection 766.302(2), Florida Statutes," and requested that "an

287order [be entered] setting a hearing in this cause on the issue

299of compensability."

301The final hearing was initially convened on January 28,

3102003; however, upon review of the record, it became app arent

321that Andrew Cracker, M.D., the participating physician, was not

330named in the petition and had not been served a copy of the

343claim. Consequently, the hearing was continued to accord

351Petitioner an opportunity to file an amended petition naming

360Dr. Cra cker, and to serve a copy of the amended petition on

373Dr. Cracker.

375On March 5, 2003, Petitioner filed an amended petition,

384which named Dr. Cracker as the physician providing obstetric

393services at Alonzo's birth, and served Dr. Cracker with a copy

404of the a mended petition on March 10, 2003. Thereafter, on

415October 2, 2003, the hearing was reconvened to resolve whether

425the claim was compensable.

429At hearing, Cecilia Roberts Young testified on her own

438behalf, and Petitioner's Exhibits 1 - 9 were received into

448evi dence. No other witnesses were called, and no further

458exhibits were offered.

461The transcript of the hearing was filed October 29, 2003,

471and the parties were accorded 10 days from that date to file

483proposed orders. Respondent elected to file such a proposa l and

494it has been duly considered.

499FINDINGS OF FACT

502Fundamental findings

5041. Petitioner, Cecilia Roberts Young, is the maternal

512grandmother and legal guardian of Alonzo Hall, Jr., a minor.

522Alonzo was born a live infant on January 25, 1997, at HCA Putnam

535Community Hospital, a hospital located in Palatka, Florida, and

544his birth weight exceeded 2,500 grams.

5512. The physician providing obstetrical services at

558Alonzo's birth was Andrew Cracker, M.D., who, at all times

568material hereto, was a "participating phy sician" in the Florida

578Birth - Related Neurological Injury Compensation Plan, as defined

587by Section 766.302(7), Florida Statutes. 1

593Coverage under the Plan

5973. Pertinent to this case, coverage is afforded by the

607Plan for infants who suffer a "birth - related n eurological

618injury," defined as an "injury to the brain . . . caused by

631oxygen deprivation or mechanical injury, occurring in the course

640of labor, delivery, or resuscitation in the immediate post -

650delivery period in a hospital, which renders the infant

659perm anently and substantially mentally and physically impaired."

667§ 766.302(2), Fla. Stat. See also §§ 766.309 and 766.31, F la.

679Stat.

6804. Here, indisputably, Alonzo is permanently and

687substantially mentally and physically impaired. What remains to

695resolve is whether the proof supports the conclusion that, more

705likely than not, Alonzo's neurologic impairment resulted from an

"714injury to the brain . . . caused by oxygen deprivation or

726mechanical injury, occurring in the course of labor, delivery,

735or resuscitat ion in the immediate post - delivery period," as

746required for coverage under the Plan.

752The cause and timing of Alonzo's

758neurologic impairment

7605. To address the cause and timing of Alonzo's neurologic

770impairment, Petitioner offered selected medical records relating

777to Alonzo's birth and subsequent development (Petitioner's

784Exhibits 1 and 2); the deposition of Michael Duchowny, M.D., a

795pediatric neurologist (Petitioner's Exhibit 3); the results of

803Dr. Duchowny's neurologic examination of Alonzo, as well as

812Dr . Duchowny's conclusions following review of the medical

821records (Petitioner's Exhibits 5 - 7); the deposition of

830Donald Willis, M.D., an obstetrician (Petitioner's Exhibit 4);

838Dr. Willis' conclusions following review of the medical records

847(Petitioner's Exh ibit 8); and the testimony of Cecilia Young, as

858well as her deposition (Petitioner's Exhibit 9).

8656. As for the cause and timing of Alonzo's impairments, it

876was Dr. Duchowny's opinion, based on the results of his

886neurologic examination and review of the me dical records, that

896Alonzo's impairments were prenatal (developmental) in origin,

903having occurred prior to the onset of labor, and not associated

914with oxygen deprivation or mechanical injury during labor,

922delivery, or resuscitation. As for Dr. Willis, he was also of

933the opinion that the medical records revealed no evidence of

943oxygen deprivation or other trauma associated with Alonzo's

951birth. Notably, the opinions of Doctors Duchowny and Willis are

961consistent with the medical records, and are credited. Fi nally,

971the lay views of Ms. Young likewise do not suggest an

982association between events surrounding Alonzo's birth and his

990neurologic impairment. Consequently, it must be concluded that

998the proof failed to demonstrate, more likely than not, that

1008Alonzo's neurologic impairment was occasioned by an injury to

1017the brain caused by oxygen deprivation or mechanical injury

1026occurring in the course of labor, delivery, or resuscitation in

1036the immediate post - delivery period.

1042CONCLUSIONS OF LAW

10457. The Division of Admi nistrative Hearings has

1053jurisdiction over the parties to, and the subject matter of,

1063these proceedings. § 766.301, et seq , Fla. Stat .

10728. The Florida Birth - Related Neurological Injury

1080Compensation Plan was established by the Legislature "for the

1089purpose o f providing compensation, irrespective of fault, for

1098birth - related neurological injury claims" relating to births

1107occurring on or after January 1, 1989. § 766.303(1), Fla. Stat.

11189. The injured "infant, her or his personal

1126representative, parents, depende nts, and next of kin," may seek

1136compensation under the Plan by filing a claim for compensation

1146with the Division of Administrative Hearings. §§ 766.302(3),

1154766.303(2), 766.305(1), and 766.313, Fla. Stat. The Florida

1162Birth - Related Neurological Injury Comp ensation Association,

1170which administers the Plan, has "45 days from the date of

1181service of a complete claim . . . in which to file a response to

1196the petition and to submit relevant written information relating

1205to the issue of whether the injury is a birth - related

1217neurological injury." § 766.305(3), Fla. Stat.

122310. If NICA determines that the injury alleged in a claim

1234is a compensable birth - related neurological injury, it may award

1245compensation to the claimant, provided that the award is

1254approved by the adm inistrative law judge to whom the claim has

1266been assigned. § 766.305(6), Fla. Stat. If, on the other hand,

1277NICA disputes the claim, as it has in the instant case, the

1289dispute must be resolved by the assigned administrative law

1298judge in accordance with th e provisions of C hapter 120, F lorida

1311Statutes. §§ 766.304, 766.309, and 766.31, Fla. Stat.

131911. In discharging this responsibility, the administrative

1326law judge must make the following determination based upon the

1336available evidence:

1338(a) Whether the inj ury claimed is a

1346birth - related neurological injury. If the

1353claimant has demonstrated, to the

1358satisfaction of the administrative law

1363judge, that the infant has sustained a brain

1371or spinal cord injury caused by oxygen

1378deprivation or mechanical injury and th at

1385the infant was thereby rendered permanently

1391and substantially mentally and physically

1396impaired, a rebuttable presumption shall

1401arise that the injury is a birth - related

1410neurological injury as defined in s.

1416766.303(2).

1417(b) Whether obstetrical services were

1422delivered by a participating physician in

1428the course of labor, delivery, or

1434resuscitation in the immediate post - delivery

1441period in a hospital; or by a certified

1449nurse midwife in a teaching hospital

1455supervised by a participating physician in

1461the cours e of labor, delivery, or

1468resuscitation in the immediate post - delivery

1475period in a hospital.

1479§ 766.309(1), Fla. Stat. An award may be sustained only if the

1491administrative law judge concludes that the "infant has

1499sustained a birth - related neurological in jury and that

1509obstetrical services were delivered by a participating physician

1517at birth." § 766.31(1), Fla. Stat.

152312. Pertinent to this case, "birth - related neurological

1532injury" is defined by Section 766.302(2), to mean:

1540injury to the brain or spinal cor d of a live

1551infant weighing at least 2,500 grams for a

1560single gestation or, in the case of a

1568multiple gestation, a live infant weighing

1574at least 2,000 grams at birth caused by

1583oxygen deprivation or mechanical injury

1588occurring in the course of labor, delive ry,

1596or resuscitation in the immediate

1601postdelivery period in a hospital, which

1607renders the infant permanently and

1612substantially mentally and physically

1616impaired. This definition shall apply to

1622live births only and shall not include

1629disability or death cau sed by genetic or

1637congenital abnormality.

163913. As the claimant, the burden rested on Petitioner, as

1649the proponent of the issue, to demonstrate that Alonzo suffered

1659a "birth - related neurological injury." § 766.309(1)(a), Fla.

1668Stat. See also Balino v. Dep artment of Health and

1678Rehabilitative Services , 348 So. 2d 349, 350 (Fla. 1st DCA

16881997)("[T]he burden of proof, apart from statute, is on the

1699party asserting the affirmative issue before an administrative

1707tribunal.")

170914. Here, the proof failed to support t he conclusion that,

1720more likely than not, Alonzo's neurologic impairments resulted

1728from an "injury to the brain . . . caused by oxygen deprivation

1741or mechanical injury occurring in the course of labor, delivery,

1751or resuscitation." Consequently, the record developed in this

1759case failed to demonstrate that Alonzo suffered a "birth - related

1770neurological injury," within the meaning of Section 766.302(2),

1778and the claim is not compensable. §§ 766.302(2), 766.309(1),

1787and 766.31(1), Fla. Stat.

179115. Where, as here , the administrative law judge

1799determines that ". . . the injury alleged is not a birth - related

1813neurological injury . . . he [is required to] enter an order [to

1826such effect] and . . . cause a copy of such order to be sent

1841immediately to the parties by regi stered or certified mail."

1851§ 766.309(2), Fla. Stat. Such an order constitutes final agency

1861action subject to appellate court review. § 766.311(1), Fla.

1870Stat.

1871CONCLUSION

1872Based on the foregoing Findings of Fact and Conclusions of

1882Law, it is

1885ORDERED tha t the claim for compensation filed by

1894Cecilia Roberts Young, as grandmother and guardian of

1902Alonzo Hall, Jr., a minor, is dismissed with prejudice.
