108STAT EMENT OF THE ISSUE

113The issue to be resolved in this proceeding is whether

123Petitioner, a foster home operator, committed violations of the

132Florida Statutes and the Florida Administrative Code, as alleged

141by Respondent, sufficient to justify Respondent' s refusal to

150renew Petitioner's license.

153PRELIMINARY STATEMENT

155Petitioner was notified by letter dated August 10, 2000,

164from Respondent's representative that Petitioner's foster home

171license would not be renewed. Inadequate food and medical care

181for children housed in Petitioner's foster home were the reasons

191stated in the letter for the refusal to renew.

200Petitioner timely sought an administrative proceeding to

207contest Respondent's decision not to renew, and the dispute was

217transferred to the Divisio n of Administrative Hearings.

225At the final hearing, Respondent presented three witnesses

233and five exhibits. Petitioner presented one exhibit and

241testimony of two witnesses.

245No transcript was provided. Neither party timely submitted

253a proposed recommended order, and none had been submitted at the

264time of preparation of this Recommended Order.

271FINDINGS OF FACT

2741. On December 20, 1999, Petitioner applied for renewal of

284her license to operate a foster care home. The license was due

296to expire on February 1 5, 2000. Respondent's investigation of

306the application was eventually concluded on June 15, 2000.

3152. By letter dated August 10, 2000, Petitioner was

324notified of Respondent's decision that, as a consequence of the

334Florida abuse report finding that Petit ioner had failed to

344provide adequate food and medical care to children in her care,

355her home would not be re - licensed as a foster home.

3673. At final hearing, Petitioner's testimony established

374that she did not intend to again operate a foster home. Her

386d esire in requesting a hearing was simply "to clear her good

398name" from the allegations contained in Florida abuse report

407number 1999 - 124723. She further admitted that her personal

417physician opposed renewal of her license due to Petitioner's

426heart conditio n. Petitioner offered copies of medical reports

435from a medical practitioner as proof that allegations of the

445abuse report were incorrect. Specifically, it is found that the

455medical records proffered at best show only that the children

465were taken to a doc tor on specific occasions and does little to

478rebut the abuse report’s allegations of inadequate food and

487medical care.

4894. Further, testimony of Respondent’s employees at final

497hearing established that Petitioner’s son, a convicted felon

505without exempti on status, had been residing in the home.

515Pursuant to applicable statutes, such a resident in the home

525also prevents re - licensure.

530CONCLUSIONS OF LAW

5335. The Division of Administrative Hearings has

540jurisdiction of the subject matter of and the partie s to this

552proceeding. Section 120.57(1), Florida Statutes.

5576. Respondent seeks to deny renewal of Petitioner's foster

566home care license due to the results of an abuse report dating

578from 1999. Respondent possesses a wide array of authority with

588regard t o denial, suspension, revocation and/or renewal of

597Petitioner's licensure status. Section 402.305, Florida

603Statutes, and Rule Chapter 65C - 22, Florida Administrative Code.

6137. Section 402.310, Florida Statutes, states in part:

621(1)(a) The department or local licensing

627agency may deny, suspend or revoke a license

635or impose an administrative fine not to

642exceed $100 per violation, per day, for the

650violation of any provision of ss. 402.301 -

658402.319 or rules adopted thereunder.

663However, where the violation c ould or does

671cause death or serious harm, the department

678or local licensing agency may impose an

685administrative fine, not to exceed $500 per

692violation per day.

695(b) In determining the appropriate

700disciplinary action to be taken for a

707violation as provide d in paragraph (a), the

715following factors shall be considered:

7201. The severity of the violation,

726including the probability that death or

732serious harm to the health and safety of any

741person will result or has resulted, the

748severity of the actual or poten tial harm,

756and the extent to which the provisions of

764ss. 402.301 - 402.319 have been violated.

7712. Actions taken by the licensee to

778correct the violation or to remedy

784complaints.

7853. Any previous violations of the

791licensee.

7928. Petitioner did not estab lish that matters underlying

801Respondent’s determination not to renew Petitioner’s license

808were untrue or that improprieties had been corrected. While

817sympathetic to Petitioner’s desire to clear her name, the

826purpose of this proceeding is to determine whet her her license

837should be renewed in the face of the abuse report, the testimony

849by Respondent employees that a felon resides in the home, and

860the testimony of Petitioner herself that her doctor does not

870want her to continue to operate a foster home.

879REC OMMENDATION

881Having considered the foregoing Findings of Fact,

888Conclusions of Law, the evidence of record, and the candor and

899demeanor of the witnesses, it is recommended that a final order

910be entered confirming the denial of Petitioner’s license to

919operate a foster home.
