143PRELIMINARY STATEMENT

145After consideration of a Report of Investigation of a

154Complaint, and upon the recommendation of its Advocate, on

163June 13, 2001, the Florida Commission on Ethics (Commission)

172entered an Order Finding Probable Cause to believe t hat the

183Respondent, Betty Burney, violated Section 112.3145, Florida

190Statutes. On October 29, 2001, this case was forwarded to the

201Division of Administrative Hearings for assignment to an

209Administrative Law Judge. On October 30, 2001, the case was

219assign ed to the undersigned Administrative Law Judge. On

228November 26, 2001, the case was set for hearing on January 29

240and 30, 2002, in Jacksonville, Florida.

246The final hearing was held January 29, 2002, in

255Jacksonville, Florida. The Advocate presented two wit nesses:

263Brian Teeple, Executive Director, Northeast Florida Regional

270Planning Council, and Frankie Knight, Candidate and Records

278Director, Supervisor of Elections Office, Duval County, Florida,

286and offered six exhibits which were received into evidence and

296numbered Exhibits 1 - 6. The Respondent, Betty Burney, failed to

307appear at the final hearing. A Transcript was ordered and filed

318with the Division of Administrative Hearings on February 7,

3272002. The Advocate submitted a Proposed recommended Order which

336w as thoughtfully considered by the undersigned.

343FINDINGS OF FACT

346Based on the evidence presented, the following findings of

355fact are made:

3581. The Respondent, Betty Burney, was appointed to the

367Northeast Florida Regional Planning Council on October 16, 199 6,

377for a term expiring October 1, 1998.

3842. The Northeast Florida Regional Planning Council is a

393broad - based agency that is authorized by Section 186.504,

403Florida Statutes. The Northeast Florida Regional Planning

410Council has two primary statutory responsi bilities:

417(1) reviewing local government comprehensive plans under Section

425163.3174, Florida Statutes; and (2) coordinating the

432developments of regional impact process under Section 380.06,

440Florida Statutes. Both of these activities are land planning

449re sponsibilities.

4513. The Respondent, as a member of the Northeast Florida

461Regional Planning Council, held a public position and, as such,

471was subject to the requirements of Subsection 112.3145(l)(a),

479Florida Statutes.

4814. As a member of the Northeast Flor ida Regional Planning

492Council, the Respondent was required to file a CE Form 1,

503Statement of Financial Interests, within 30 days of her

512appointment.

5135. The Respondent was specifically advised of the

521requirement to file a CE Form 1, Statement of Financial

531Interests, within 30 days in her appointment letter. In

540addition, the Executive Director of the Northeast Florida

548Regional Planning Council reviewed this requirement with the

556Respondent in an orientation session. The disclosure required

564to be filed withi n 30 days would have been for calendar year

5771995.

5786. The Respondent did not file a CE Form 1, Statement of

590Financial Interests, within 30 days of her appointment.

5987. The Respondent filed a CE Form 1, Statement of

608Financial Interests, dated April 21, 199 7, for the calendar year

6191996.

6208. As a member of the Northeast Florida Regional Planning

630Council, the Respondent was required to file a CE Form 1,

641Statement of Financial Interests, for the year 1997.

6499. The 1997 CE Form 1, Statement of Financial Interes ts,

660was due to be filed by July 1, 1998, with a grace period

673extending to September 1, 1998.

67810. The Respondent's name was on the list of persons

688required to file financial disclosures provided to the Duval

697County Supervisor of Elections by the Ethic s Commission in 1998,

708filings required for calendar year 1997.

71411. A CE Form 1, Statement of Financial Interests, was

724mailed to the Respondent by the Duval County Supervisor of

734Elections for 1997. When the Respondent failed to file her

744financial disclosu re by July 1, 1998, the Duval County

754Supervisor of Elections sent her a certified letter notifying

763her of her delinquency.

76712. The Respondent did not claim the certified letter, and

777never filed a CE Form 1, Statement of Financial Interests, for

788the year 1997.

791CONCLUSIONS OF LAW

79413. The Division of Administrative Hearings has

801jurisdiction over the parties to and the subject matter of this

812proceeding. Subsection 120.57(1), Florida Statutes.

81714. Section 112.322, Florida Statutes, and Rule 34 - 5.0015,

827Flori da Administrative Code, authorize the Commission to conduct

836investigations and to make public reports on complaints

844concerning violations of Part III, Chapter 112, Florida Statutes

853(the Code of Ethics for Public Officers and Employees).

86215. The burden of proof, absent a statutory directive to

872the contrary, is on the party asserting the affirmative of the

883issue in the proceedings. Department of Transportation v.

891J.W.C. Co., Inc. , 396 So. 2d 778 (Fla. 1st DCA 1981); Balino v.

904Department of Health and Rehabi litative Services , 348 So. 2d 349

915(Fla. 1st DCA 1981). The standard of proof in a proceeding in

927which the Commission seeks penalties under Subsection 112.3145,

935Florida Statutes, is "clear and convincing" evidence. Latham v.

944Florida Commission on Ethics , 694 So. 2d 83 (Fla. 1st DCA 1997).

956Therefore, the Advocate, on behalf of the Commission, has the

966burden of establishing by clear and convincing evidence the

975elements of the Respondent's alleged violations.

98116. The Respondent was appointed to the Northeas t Florida

991Regional Planning Council on October 16, 1996. Therefore, the

1000applicable law is Subsection 112.3145(2)(b), Florida Statutes,

1007(1996 Supp.), which provides:

1011Each state or local officer and each

1018specified state employee shall file a

1024statement of financial interests no later

1030than July 1 of each year. Each state or

1039local officer who is appointed and each

1046specified state employee who is employed

1052shall file a statement of financial

1058interests within 30 days from the date of

1066appointment or, in the case of a specified

1074state employee, from the date on which the

1082employment begins, except that any person

1088whose appointment is subject to confirmation

1094by the Senate shall file prior to

1101confirmation hearings or within 30 days from

1108the date of appointment, whiche ver comes

1115first.

111617. Subsection 112.3145(l)(a)2, Florida Statutes (1996

1122Supp.), defines "local officer" as:

1127Any appointed member of a board;

1133commission; authority, including any

1137expressway authority or transportation

1141authority established by general la w;

1147community college district board of

1152trustees; or council of any political

1158subdivision of the state, excluding any

1164member of an advisory body. A governmental

1171body with land - planning, zoning, or natural

1179resources responsibilities shall not be

1184considered an advisory body.

118818. As a member of a governmental body with land - planning

1200responsibilities, the Respondent was a "local officer" as the

1209term is defined in the statute. The testimony established that

1219she failed to make the initial disclosure required b y law, and

1231there is no question that she violated Subsection 112.3145(2),

1240as alleged.

124219. The Respondent is alleged to have failed to make

1252disclosure in 1998, for calendar year 1997. While there were

1262some changes to Section 112.3145 in 1997, the applicab le

1272portions, quoted above, remained the same.

127820. The Respondent remained a member of the Northeast

1287Florida Regional Planning Council in 1997 and, as a member and

"1298local officer," was required to make financial disclosure for

1307that year. Financial disclos ure for calendar year 1997 was due

1318July 1, 1998, with a grace period extending to September 1,

13291998. The Respondent did not file the required financial

1338disclosure for calendar year 1997.

1343PENALTY

134421. Section 112.317, Florida Statutes, sets out the

1352p enalties available on finding of a violation of the Code of

1364Ethics, with the maximum dollar amount being $10,000 per

1374allegation. In this case the Respondent exhibited complete

1382indifference to the filing requirements. Despite being advised,

1390both in her ap pointment letter and by the Executive Director of

1402the Northeast Florida Regional Planning Council, of the

1410necessity of filing within 30 days, she not only missed the

1421deadline but never filed at all. In April 1997, she did file a

1434CE Form 1, Statement of Fi nancial Interests (for calendar year

14451996), the copy of which revealed on its face a large - print

1458warning that failure to make disclosure exposes the officer to

1468fines of up to $10,000. Nevertheless, the next year, she failed

1480to make required annual disclos ure.

1486RECOMMENDATION

1487Based on the foregoing Findings of Fact and Conclusions of

1497Law, it is

1500RECOMMENDED that a final order and public report be entered

1510finding that the Respondent, Betty Burney, violated Subsection

1518112.3145(2)(b), Florida Statutes, in the tw o instances alleged,

1527and imposing a civil penalty of $2,000 for her failure to file a

1541CE Form 1, Statement of Financial Interests within 30 days of

1552her appointment to the Northeast Florida Regional Planning

1560Council and $2,000 for her failure to file her 19 97 CE Form 1,

1575Statement of Financial Interests for a total fine of $4,000.
