156PRELIMINARY STATEMENT

158This case began on September 19, 2001, when Petitioner,

167Beverly Hills Development Corporation, requested the Florida

174Land and Water Adjudicatory Commission to adopt a rule to

184establish the Tuscany Community Development District. Th e

192proposed rule is attached to this Report as Appendix C. The

203matter was forwarded to the Division of Administrative

211Hearings on November 26, 2001, with a request that an

221Administrative Law Judge conduct a public hearing. By Notice

230of Hearing dated Decem ber 10, 2001, a public hearing was

241scheduled in Lecanto, Florida, on February 6, 2002. At the

251request of Petitioner, the public hearing was rescheduled to

260April 11, 2002, at the same location.

267Petitioner presented five witnesses and offered into

274evidenc e Petitioner's Exhibits 1 - 14, which were admitted

284without objection. The names and addresses of the witnesses

293are listed in Appendix A attached to this Report, and the

304exhibits are listed in Appendix B. Six members of the public,

315including two Citrus Cou nty employees, presented public

323comment. Their names and addresses (if given) are also found

333in Appendix A attached to this Report. In addition, they

343offered two exhibits, which are listed in Appendix B.

352Finally, on June 19, 2002, a letter was filed by a member of

365the public who resides in Beverly Hills, Florida. Because the

375record was closed on April 21, 2002, or ten days after the

387public hearing, the letter has not been considered in the

397preparation of this Report.

431FINDINGS OF FACT

434Based upon all of the evidence, the following findings of

444fact are determine d:

448A. Overview

4501. In this proceeding, Petitioner, Beverly Hills

457Development Corporation, seeks the adoption of a rule by the

467Florida Land and Water Adjudicatory Commission (Commission) to

475establish a new community development district just northeast

483of Beverly Hills in Citrus County, Florida. The proposed name

493for the new District is the Tuscany Community Development

502District (the District).

5052. The sole purpose of this proceeding was to consider

515the establishment of the District as proposed by Petitio ner.

525B. Summary of Evidence and Testimony

5313. The evidence indicates that all of the statements

540contained in the Petition, as amended, are true and correct.

5504. Edwin M. Bulleit, a certified public accountant with

559Prager, McCarthy and Sealy, testified t hat he and his attorney

570met individually with the different county commissioners for

578Citrus County regarding the proposed District, and although

586the commissioners had questions, they had no objections to the

596adoption of the proposed District. Mr. Bulleit further

604testified that he felt he adequately answered the questions of

614the commissioners.

6165. Mr. Bulleit testified that a community development

624district is a mechanism to finance, plan, and manage public

634improvements. Witness Bulleit further testified that such a

642mechanism allows development to pay for itself.

6496. Mr. Bulleit stated that in his experience, 80 to 90

660percent of developments in Florida are pursuing community

668development - type financing. Mr. Bulleit further testified

676that community develo pments provide the opportunity for tax

685exempt financing, the benefits of which include (i) lower

694interest rates, which make the development more financially

702sound and lots within the community development district more

711affordable, and (ii) access to long - t erm, 30 - year debt

724financing, which means the financing matches the long - term

734nature of the assets being financed.

7407. Mr. Bulleit testified that a community development

748district may exercise certain powers subject to the regulatory

757jurisdiction and permi tting authority of all applicable

765governmental bodies, agencies, and special districts having

772authority with respect to the community development district.

7808. Mr. Dale R. Miller, Vice - President of Petitioner,

790testified that Petitioner is a Florida corpo ration with

799offices in Beverly Hills, Florida. A certified copy of a

809Certificate of Active Status for Petitioner issued by the

818Florida Department of State was received into evidence as

827Exhibit 1.

8299. Mr. Miller indicated that the land area to be served

840by the proposed District consists of two parcels of unimproved

850real property containing approximately 951.14 acres located in

858the existing Beverly Hills Development of Regional Impact

866(Beverly Hills Property) and 560 acres located outside the

875Beverly Hills D evelopment of Regional Impact (King Land Trust

885Property) for a total acreage of approximately 1,511.14 acres.

895Mr. Miller also testified that the Beverly Hills Property and

905King Land Trust Property are contiguous (320 acres are

914adjacent to the east of the Beverly Hills Property, while 240

925acres are adjacent to the south of the Beverly Hills

935Property). The conceptual development plan's allotted acreage

942for each land use was received into evidence as a part of

954Composite Exhibit 4. The proposed District is e ntirely within

964the territorial limits of Citrus County, Florida.

97110. Mr. Miller further testified that the metes and

980bounds legal description of the external boundaries of the

989proposed District is as described in and attached to the

999Petition as Exhibit B and Exhibit B - 1 and introduced into

1011evidence at the hearing as a part of Composite Exhibit 4.

1022Petitioner filed an amended Exhibit B to its Petition, which

1032contained an amended legal description of the boundaries for

1041the proposed District.

104411. Mr. Mil ler indicated that the owners of the land to

1056be included within the boundaries of the proposed District are

1066Petitioner and William H. Cauthen, as Trustee of the King Land

1077Trust, Inc. Mr. Miller further testified that the owners of

1087the land to be included within the proposed District have

1097consented to establishing the proposed District. The written

1105consents of the owners of the land to be included in the

1117proposed District were attached to the Petition as Exhibits C

1127and C - 1, and introduced into evidence at the hearing as a part

1141of Composite Exhibit 4.

114512. Mr. Miller testified that the five persons

1153designated to serve as the initial members of the Board of

1164Supervisors of the proposed District are: Ronald J. Collins,

1173Dale R. Miller, Taylor Collins, Paul Bu chanan, and John

1183O'Kelley. The initial supervisors will serve on the Board of

1193Supervisors until replaced by elected members as provided by

1202Section 190.006, Florida Statutes. All of the initial

1210supervisors are residents of the State of Florida and citizen s

1221of the United States of America.

122713. Mr. Miller also stated that the proposed timetables

1236and related estimates of cost to construct the proposed

1245District's services and facilities, based upon available data,

1253were attached to the Petition as Exhibit D an d received into

1265evidence as a part of Composite Exhibit 4.

127314. Mr. Miller testified that the Statement of Estimated

1282Regulatory Costs (SERC) to establish the proposed District

1290were attached to the Petition as Exhibit E and received into

1301evidence as a par t of Composite Exhibit 4.

131015. The future general description, location, and extent

1318of public and private uses of land proposed for the area

1329within the proposed District will be incorporated into the

1338adopted and approved Citrus County Comprehensive Plan. Also,

1346the requested land use and zoning classifications permit the

1355planned residential and commercial development to be located

1363within the proposed District. Finally, for those portions of

1372the proposed District situated within the Beverly Hills DRI,

1381the proposed public and private uses of land are compatible

1391with all development orders issued pursuant to the DRI

1400process.

140116. Mr. Miller testified that the proposed public and

1410private uses of the land at issue were compatible with all of

1422the development or ders that have been issued pursuant to the

1433development of regional impact process.

143817. Gail Easley, a professional land planner with The

1447Gail Easley Company, testified that she reviewed the Petition

1456and its exhibits in conjunction with the State Compreh ensive

1466Plan and found that the proposed District will not be

1476inconsistent with any applicable element or portion of the

1485State Comprehensive Plan.

148818. Ms. Easley also testified that she reviewed the

1497Citrus County Comprehensive Plan, including the goals,

1504ob jectives, and policies, as well as other materials, and

1514found that the proposed District will not be inconsistent with

1524any applicable element or portion of the Citrus County

1533Comprehensive Plan.

153519. Ms. Easley further stated that the area of land

1545within th e proposed District is of sufficient size, is

1555sufficiently compact, and is sufficiently contiguous to be

1563developed as one functional interrelated community.

156920. Witnesses Bulleit, Miller, and Easley each testified

1577that the proposed District is the best alternative available

1586for delivering community development services and facilities

1593to the area that will be served by the proposed District.

160421. Witnesses Bulleit and Miller testified that

1611establishing the District will promote development of the land

1620w ithin the District by providing for a more efficient use of

1632its resources.

163422. Mr. Miller testified that the community development

1642services and facilities of the District will be compatible

1651with the capacity and uses of existing and local regional

1661commu nity development services and facilities.

166723. Mr. Miller also stated that the District provides a

1677perpetual entity capable of making reasonable provisions for

1685the operation and maintenance of the District's services and

1694facilities.

169524. Mr. Miller fur ther testified that there is no real

1706property located within the external boundaries of the

1714District that is not going to be included within the District.

172525. Witnesses Bulleit and Easley testified that the area

1734that will be served by the proposed Distr ict is amenable to

1746separate special - district government.

175126. Louis G. Badami, Director of Utilities for Citrus

1760County, testified that the District would be compatible with

1769the capacity and uses of the existing local and regional water

1780and sewer faciliti es, including those of Citrus County and

1790Rolling Oaks Utilities, Inc. (Rolling Oaks). The latter

1798utility is privately owned and provides water and wastewater

1807service in an area adjacent to the District. Mr. Badami's

1817testimony focused only on the water an d wastewater service

1827territories of Citrus County and Rolling Oaks. More

1835specifically, he went on record as opposing a request to

1845expand the present service territory of Rolling Oaks. He

1854further testified that if the District was merely a funding

1864mechani sm to construct and install utilities and there was no

1875expansion of Rolling Oaks' service territory without following

1883applicable rules and regulations, he would recommend to Citrus

1892County that it not oppose the District.

189927. Robert A. Knight, Director of Utility Regulation for

1908Citrus County, testified that he was not testifying for or

1918against the proposed District, but rather only about a legal

1928matter regarding the ability of Rolling Oaks to serve the

1938proposed District. In this regard, Mr. Knight did not object

1948to approval of the proposed District in light of the

1958stipulation by Petitioner's representative at the public

1965hearing that Rolling Oaks would follow applicable rules and

1974regulations with respect to expanding its service territory.

198228. Four members of the general public provided comment

1991and asked questions concerning the consumption of water and

2000the nature of the expected development within the proposed

2009District. They are concerned that given the present supply of

2019water in Citrus County, there may n ot be sufficient water from

2031existing wells to serve the hundreds of new homes that will be

2043built in the District.

2047CONCLUSIONS OF LAW

205029. The Division of Administrative Hearings has

2057jurisdiction over this matter pursuant to Chapters 120 and

2066190, Florida Statutes.

206930. The proceeding and local public hearing were

2077properly noticed pursuant to Section 190.005, Florida

2084Statutes, by publication of an advertisement in a newspaper of

2094general circulation in Citrus County once each week for the

2104four consecutive we eks immediately prior to the local public

2114hearing.

211531. Petitioner has met the requirements of Section

2123190.005, Florida Statutes, with respect to submitting the

2131Petition and satisfying the filing fee requirements.

213832. Petitioner bears the burden of establ ishing that the

2148Petition meets the relevant statutory criteria set forth in

2157Section 190.005(1)(e), Florida Statutes. Petitioner has met

2164that burden.

216633. All portions of the Petition and other submittals

2175have been completed and filed as required by law.

21843 4. All statements contained within the Petition, as

2193amended or supplemented at the local public hearing, are true

2203and correct.

220535. The proposed District will not be inconsistent with

2214any applicable element or portion of the State Comprehensive

2223Plan.

222436. The proposed District will not be inconsistent with

2233any applicable element or portion of the Citrus County

2242Comprehensive Plan.

224437. The area of land within the proposed District is of

2255sufficient size, is sufficiently compact, and is sufficiently

2263contiguou s to be developed as one functional interrelated

2272community.

227338. The proposed District is the best alternative

2281available for delivering community development services and

2288facilities to the area that will be served by the proposed

2299District.

230039. The communi ty development services and facilities of

2309the proposed District will be compatible with the capacity and

2319uses of existing local and regional community development

2327services and facilities, including water and wastewater

2334facilities.

233540. The area that will b e served by the proposed

2346District is amenable to separate special - district government.

235541. The Commission is not the forum to consider or

2365modify the existing service territory of Rolling Oaks;

2373therefore, that issue is not germane to this proceeding.

2382RECOMMENDATION

2383Based on the foregoing Findings of Fact and Conclusions

2392of Law, it is

2396RECOMMENDED that the Florida Land and Water Adjudicatory

2404Commission, pursuant to Chapters 120 and 190, Florida

2412Statutes, and Chapter 42 - 1, Florida Adminis trative Code,

2422establish the Tuscany Community Development District, as

2429requested by Petitioner, by formal adoption of the proposed

2438rule attached to this Report as Appendix C.
