131At issue in the proceeding is whether Aaron Colby Cross, a
142minor, suffe red an injury for which compensation should be
152awarded under the Florida Birth - Related Neurological Injury
161Compensation Plan.
163PRELIMINARY STATEMENT
165On October 9, 2001, Carl W. Cross and Mylene C. Cross, as
177parents and natural guardians of Aaron Colby Cros s (Aaron), a
188minor, filed a petition (claim) with the Division of
197Administrative Hearings (DOAH) for compensation under the Florida
205Birth - Related Neurological Injury Compensation Plan (the Plan
214DOAH served the Florida Birth - Related Neurological Injury
223Comp ensation Association (NICA), with a copy of the claim on
234December 24, 2001. 1 NICA reviewed the claim and on February 27,
2462002, gave notice that it had "determined that such claim is not
258a 'birth - related neurological injury' within the meaning of
268Section 7 66.302(2), Florida Statutes," and requested that "an
277order [be entered] setting a hearing in this cause on the issue
289of compensability of this claim." Such a hearing was duly -
300noticed and held on September 4, 2002.
307At hearing, Petitioners appeared through counsel, but
314offered no evidence. Respondent, given Petitioners' failure to
322offer proof, declined the opportunity to offer any evidence. The
332transcript of the hearing was not ordered, and the parties waived
343the opportunity to submit proposed final orders .
351FINDINGS OF FACT
3541. As observed in the preliminary statement, neither
362Petitioners nor anyone on their behalf offered any proof.
371Consequently, it must be resolved that Petitioners failed to
380demonstrate Aaron Colby Cross, a minor, suffered a "birth - rel ated
392neurological injury" as alleged in the claim for benefits.
401CONCLUSIONS OF LAW
4042. The Division of Administrative Hearings has jurisdiction
412over the parties to, and the subject matter of, these
422proceedings. Section 766.301, et seq. , Florida Statutes.
4293. The Florida Birth - Related Neurological Injury
437Compensation Plan was established by the Legislature "for the
446purpose of providing compensation, irrespective of fault, for
454birth - related neurological injury claims" relating to births
463occurring on or afte r January 1, 1989. Section 766.303(1),
473Florida Statutes.
4754. The injured "infant, his personal representative,
482parents, dependents, and next of kin," may seek compensation
491under the Plan by filing a claim for compensation with the
502Division of Administrati ve Hearings within five years of the
512infant's birth. Sections 766.302(3), 766.303(2), 766.305(1), and
519766.313, Florida Statutes. The Florida Birth - Related
527Neurological Injury Compensation Association, which administers
533the Plan, has "45 days from the dat e of service of a complete
547claim . . . in which to file a response to the petition and to
562submit relevant written information relating to the issue of
571whether the injury is a birth - related neurological injury."
581Section 766.305(3), Florida Statutes.
5855. If NICA determines that the injury alleged in a claim is
597a compensable birth - related neurological injury, it may award
607compensation to the claimant, provided that the award is approved
617by the administrative law judge to whom the claim has been
628assigned. Sec tion 766.305(6), Florida Statutes. If, on the
637other hand, NICA disputes the claim, as it has in the instant
649case, the dispute must be resolved by the assigned administrative
659law judge in accordance with the provisions of Chapter 120,
669Florida Statutes. Se ctions 766.304, 766.307, 766.309, and
677766.31, Florida Statutes.
6806. In discharging this responsibility, the administrative
687law judge must make the following determination based upon the
697available evidence:
699(a) Whether the injury claimed is a birth -
708relat ed neurological injury. If the claimant
715has demonstrated, to the satisfaction of the
722administrative law judge, that the infant has
729sustained a brain or spinal cord injury
736caused by oxygen deprivation or mechanical
742injury and that the infant was thereby
749re ndered permanently and substantially
754mentally and physically impaired, a
759rebuttable presumption shall arise that the
765injury is a birth - related neurological injury
773as defined in s. 766.303(2).
778(b) Whether obstetrical services were
783delivered by a partici pating physician in the
791course of labor, delivery, or resuscitation
797in the immediate post - delivery period in a
806hospital; or by a certified nurse midwife in
814a teaching hospital supervised by a
820participating physician in the course of
826labor, delivery, or res uscitation in the
833immediate post - delivery period in a hospital.
841Section 766.309(1), Florida Statutes. An award may be sustained
850only if the administrative law judge concludes that the "infant
860has sustained a birth - related neurological injury and that
870o bstetrical services were delivered by a participating physician
879at birth." Section 766.31(1), Florida Statutes.
8857. Pertinent to this case, "birth - related neurological
894injury" is defined by Section 766.302(2), Florida Statutes, to
903mean:
904. . . injury to th e brain or spinal cord of a
917live infant weighing at least 2,500 grams at
926birth caused by oxygen deprivation or
932mechanical injury occurring in the course of
939labor, delivery, or resuscitation in the
945immediate post - delivery period in a hospital,
953which renders the infant permanently and
959substantially mentally and physically
963impaired. This definition shall apply to
969live births only and shall not include
976disability or death caused by genetic or
983congenital abnormality.
9858. As the claimants, the burden rested on Petitioners to
995demonstrate entitlement to compensation. See Section
1001766.309(1)(a), Florida Statutes. See also Balino v. Department
1009of Health and Rehabilitative Services , 348 So. 2d 349, 350 (Fla.
10201st DCA 1977)("[T]he burden of proof, apart from statute, is on
1032the party asserting the affirmative issue before an
1040administrative tribunal.")
10439. Here, by failing to offer any proof, Petitioners failed
1053to sustain their burden to demonstrate that Aaron suffered a
"1063birth - related neurological injury." Accordingl y, the subject
1072claim has not been shown to be compensable under the Plan.
108310. Where, as here, the proof fails to support the
1093conclusion that the infant suffered a "birth - related neurological
1103injury," the administrative law judge [is required to] enter a n
1114order [to such effect] and . . . cause a copy of such order to be
1130sent immediately to the parties by registered or certified mail."
1140Section 766.309(2), Florida Statutes. Such an order constitutes
1148final agency action subject to appellate court review. Section
1157766.311(1), Florida Statutes.
1160CONCLUSION
1161Based on the foregoing Findings of Fact and Conclusions of
1171Law, it is
1174ORDERED that the petition for compensation filed by Carl W.
1184Cross and Mylene C. Cross, as parents and natural guardians of
1195Aaron Colby C ross, a minor, is hereby denied with prejudice.
