92STATEMENT OF THE ISSUE
96The issue is whether Respondents committed an unlawful act
105of housing discrimination against Petitioner based on his
113national origin, in violation of Section 760.23(2), Florida
121Statutes.
122PRELIMINARY STATEMENT
124On January 25, 2002, the Florida Commission on Human
133Rela tions issued a Determination of No Reasonable Cause.
142By Petition for Relief filed February 7, 2002, Petitioner
151alleged that Respondent The Continental Group, which is the
160management company for Petitioner's condominium building, and
167Respondent Al Soto, th e Executive Vice President of The
177Continental Group, committed various acts of housing
184discrimination against Petitioner based on his Chinese national
192origin. On April 15, 2002, Petitioner filed an Amended Petition
202for Relief.
204At the hearing, Petition er called four witnesses and
213offered into evidence 34 exhibits: Petitioner Exhibits 2 - 6, 10,
22413, 15, 21 - 32, 34 - 35, 40 - 41, 44, 46, 57, 59 - 60, 62 - 65, and 68.
246Respondent called five witnesses and offered into evidence three
255exhibits: Respondent Exhibits 1 - 3. All exhibits were admitted
265except Petitioner Exhibit 10 was not admitted for the truth of
276its contents.

299FINDINGS OF FACT
3021. Petitioner was born in Shanghai, China, in 1948, and is
313of Chinese national origin. He moved to the United States at 12
325years of age. He speaks Chinese and English, as well as other
337languages. He has substantial financial expertise.
3432. Petitioner has resided at the Brickell Townhouse for
352eight years. He owns the fee simple to Unit 6P. Respondent The
364Continental Group (Continental Group) is a property management
372company that provides services to a large number of condominium,
382homeowner, and co - op asso ciations, especially in Dade and
393Broward counties. Respondent Al Soto is an executive vice
402president of Continental Group and has served in this capacity
412for five years.
4153. Brickell Townhouse comprises 360 condominium units.
422Continental Group has been t he property manager for Brickell
432Townhouse for 10 years. Continental Group provides management,
440administrative, and maintenance services to Brickell Townhouse
447through several employees assigned to the condominium. Mr. Soto
456oversees 44 properties managed by Continental Group.
463Continental Group has assigned Carlos Rodriguez to serve as the
473property manager of Brickell Townhouse. Mr. Rodriguez is one of
48340 managers whom Mr. Soto supervises.
4894. For several years, Petitioner has been critical of the
499managem ent provided by the Board of Directors of the condominium
510association and Continental Group. The directors are elected by
519the condominium owners to operate the condominium association.
527Petitioner has run for election as a director several times, but
538has never been elected.
5425. The condominium owners and condominium association have
550been subject to unusual stress for several years, as they have
561been undertaking substantial repairs and pursuing insurance
568claims arising from considerable damage that Bricke ll Townhouse
577sustained from Hurricane Andrew. Petitioner often makes
584important points in questioning or confronting directors or
592employees of Continental Group, but these encounters often
600deteriorate to heated exchanges between Petitioner, on the one
609hand , and individual directors or an employee, on the other
619hand.
6206. At one meeting, Petitioner made an ethnically
628derogatory remark to a Jewish attorney, who was serving as a
639director at the time. Petitioner often resorted to profanity
648during the meetings when he received unsatisfactory answers to
657the questions that he had asked. Petitioner often uttered
"666fuck" and "shit" and once referred to the wives of some of the
679directors as "bitches." Some of the female unitowners became
688concerned about their secur ity at the meetings, so the Board of
700Directors had to provide security at the meetings.
7087. In a heated exchange during a meeting of the Board of
720Directors on January 4, 2001, Petitioner approached a director
729and loudly called him an "asshole." Pushing Mr . Rodriguez, who
740was trying to keep the approaching Petitioner from reaching the
750director, the director shouted, "get away from me, you fucking
760Chink."
7618. The Board of Directors employs Continental Group, which
770employs Mr. Soto. Neither Continental Gro up nor Mr. Soto is
781responsible for the statements of any member of the Board of
792Directors, and the record does not suggest that Continental
801Group or Mr. Soto in any way condoned or endorsed the ethnic
813epithet directed against Petitioner.
8179. Since the Janu ary 4 incident, the director and
827Petitioner have mended their relationship. At the time of the
837hearing, they were the parties to a pending contract for the
848purchase and sale of a unit at Brickell Townhouse.
85710. On May 7, 2001, Petitioner attended a two - a nd - one -
872half - hour meeting of the Board of Directors. Mr. Soto was also
885in attendance. Over 50 other residents were present at the
895meeting, during which Petitioner asked a half dozen questions.
90411. Unhappy with the responses that he had received from
914Mr . Soto, Petitioner approached him as soon as the meeting
925concluded and tried to ask more questions. Mr. Soto informed
935Petitioner that he had had his chance to ask questions and now
947the meeting was over. Petitioner replied, "you're an asshole."
956Mr. Soto walked away from Petitioner, who followed him and
966pushed Mr. Soto into a wall. A couple of other employees of
978Continental Group separated Petitioner from Mr. Soto, who was
987then able to leave the room.
99312. By letter dated May 21, 2001, attorneys for
1002Conti nental Group warned Petitioner that he had acted in an
"1013aggressive, threatening and abusive" way toward Mr. Soto, and
1022Petitioner's actions constituted civil assault and battery. The
1030letters ordered Petitioner to cease and desist from this
1039behavior, or els e Continental Group would pursue all available
1049civil and criminal remedies. Petitioner has construed these
1057warnings as coercive and threatening misconduct.
106313. In July 2001, another incident took place when
1072Petitioner or his longterm companion, who also resides at
1081Brickell Townhouse, received an invoice for an elevator fee in
1091connection with the occupancy of a first - floor unit by a new
1104tenant of theirs. In the past, the condominium association had
1114not assessed this fee because the occupancy of a first - fl oor
1127unit did not require the use of an elevator.
113614. Immediately upon receiving the invoice, Petitioner
1143telephoned the management office and spoke with one of
1152Continental Group's employees, who told him that the Board of
1162Directors had changed the rules to require that all unitowners
1172pay this fee. Petitioner immediately visited the management
1180office where he found two young female employees of Continental
1190Group. Referring to these employees as "airheads," Petitioner
1198demanded to speak to Mr. Rodriguez. Wh en Mr. Rodriguez
1208appeared, Petitioner shouted to him that he was a "criminal
1218gangster."
121915. The record describes other intense confrontations and
1227angry exchanges between Petitioner, on the one hand, and various
1237directors, Continental Group, and employ ees of Continental
1245Group, on the other hand -- more insults, more animosity, and more
1257perceptions of unfairness, but no evidence whatsoever suggests
1265the presence of discrimination against Petitioner based on his
1274Chinese origin.
127616. The sole mention of Pet itioner's Chinese origin is
1286from a director, not one of the Respondents, and even Petitioner
1297does not suggest that the person uttering this epithet has
1307committed a discriminatory act against Petitioner. The sole act
1316clearly linked to the conditions of occ upancy of a unit -- the
1329changed fee schedule -- involves only the Board of Directors and
1340not the Respondents. The record affords no basis for an
1350inference of ethnic discrimination in housing.
1356CONCLUSIONS OF LAW
135917. The Division of Administrative Hearings h as
1367jurisdiction over the subject matter. Section 120.57(1),
1374Florida Statutes. (All references to Sections are to Florida
1383Statutes.)
138418. Section 760.23(2) provides:
1388It is unlawful to discriminate against any
1395person in the terms, conditions, or
1401privilege s of sale or rental of a dwelling,
1410or in the provision of services or
1417facilities in connection therewith, because
1422of race, national origin, sex, handicap,
1428familial status, or religion.
143219. Petitioner has failed to prove any housing
1440discrimination whats oever in this case.
1446RECOMMENDATION
1447It is
1449RECOMMENDED that the Florida Commission on Human Relations
1457enter a final order dismissing the Petition for Relief.
