109STATEMENT OF THE ISSUE

113The issue presented is whether Respondent violated the

121Final Order of Petitioner by failing to pay $1,250 to

132Pet itioner on or before the expiration of 30 days after the

144entry of the Final Order.

149PRELIMINARY STATEMENT

151Petitioner seeks enforcement of a Final Order previously

159entered against Respondent. Respondent timely requested an

166administrative hearing.

168At t he hearing, Petitioner presented the testimony of one

178witness and submitted three exhibits for admission in

186evidence. Respondent did not appear and did not otherwise

195submit any evidence in the proceeding.

201The identity of the witness and exhibits, and th e rulings

212regarding each, are set forth in the record of the hearing.

223Neither party requested a transcript of the hearing.

231Petitioner timely filed its Proposed Recommended Order ("PRO")

241on May 10, 2002. Respondent did not file a PRO.

251FINDINGS OF FACT

2541 . Petitioner is the state agency responsible for

263regulating the sale of alcoholic beverages. Respondent is

271licensed to sell alcoholic beverages pursuant to license

279number 15 - 02311, Series 4COP SRX. The licensed premises are

290located at 680 George J. King Boulevard, Port Canaveral,

299Florida, 32920.

3012. On October 2, 2000, Petitioner entered a Final Order

311that required Respondent to pay an administrative fine of

320$1,250 within 30 days of the date of entry of the order.

333Respondent appealed the Final Order to the First District

342Court of Appeal. The First District Court of Appeal upheld

352the Final Order. Respondent failed to pay any portion of the

363administrative fine.

365CONCLUSIONS OF LAW

3683. DOAH has jurisdiction over the subject matter and

377parties. Section 120.569 and 120.57, Florida Statutes (2001).

385DOAH provided the parties with adequate notice of the

394administrative hearing. (All section references are to

401Florida Statutes (2001) unless otherwise stated.)

4074. Petitioner has the burden of proof in this

416proceeding. Petitioner must show by clear and convincing

424evidence that Respondent committed the acts alleged in the

433Administrative Action and the reasonableness of any penalty to

442be imposed. Ferris v. Turlington , 510 So. 2d 292 (Fla.

4521987). Petitioner satisfied its burden of proof.

4595. Section 561.29(1) provides, in relevant part, that

467Petitioner may revoke Respondent's license upon a showing of:

476(k) Failure by the holder of any license

484issued under the Beverage Law to comply

491with a stipulation, conse nt order, or final

499order.

5006. Florida Administrative Code Rule 61A - 2.022(8)

508provides:

509Licensees or permitees who violate the

515accepted stipulation agreement or final

520order shall be issued a new administrative

527action under the same case number for

534failing to comply with the stipulation or

541final order which will be considered a

548separate violation of state law and the

555penalty for the violation will double.

561RECOMMENDATION

562Based upon the foregoing Findings of Fact and Conclusions

571of Law, it is

575RECOMMEND ED that Petitioner enter a Final Order finding

584Respondent guilty of violating Section 561.29; imposing an

592administrative fine of $2,500, pursuant to Rule 61A - 2.022(8);

603and permanently revoking alcoholic beverage license number 15 -

61202311, Series 4COP SRX.
