89This cause came on to be heard pursuant to Section 766.304,

100Florida Statutes, upon the stipulation and joint petition of the

110parties, filed May 7, 2002, for the entry of an order approving

122the resolution of a formal claim for c ompensation benefits

132heretofore filed in this cause in accordance with the provisions

142of Chapter 766, Florida Statutes, and a resolution of the

152exclusive remedy otherwise available as outlined in Chapter 766,

161Florida Statutes.

163By the terms of their stipula tion, the parties have agreed

174that Petitioners, St. Juste Alfred and Maria Paul, are the

184parents of Ricardo Alfred (Ricardo), a deceased minor, as well as

195co - personal representatives of their deceased son's estate; that

205Ricardo was born a live infant on Ju ly 3, 2001, at Broward

218General Medical Center, a hospital located in Fort Lauderdale,

227Florida; and that his birth weight was in excess of 2,500 grams.

240The parties have further agreed that the physician delivering

249obstetrical services during the birth of R icardo was Robert J.

260Bass, M.D., who, at all times material hereto, was a

270participating physician in the Florida Birth - Related Neurological

279Injury Compensation Plan, as defined by Section 766.302(7),

287Florida Statutes. Finally, by their stipulation, the pa rties

296have agreed that Ricardo suffered a "birth - related neurological

306injury," as that term is defined by Section 766.302(2), Florida

316Statutes.

317After due consideration of the interests of all parties, and

327being otherwise fully advised in the premises, it i s

337ORDERED that:

3391. The stipulation of the parties, filed May 7, 2002, is

350hereby approved, and the parties are directed to comply with the

361provisions thereof.

3632. The Petitioners, St. Juste Alfred and Maria Paul, as the

374parents and natural guardians of Ric ardo Alfred, a deceased

384minor, are accorded a lump sum award of One hundred thousand

395dollars ($100,000.00).

3983. Upon payment of the lump sum award of One hundred

409thousand dollars ($100,000.00) to the parents (claimants),

417payment for funeral expenses not t o exceed One thousand five

428hundred dollars ($1,500.00), attorney's fees and other expenses

437of Ten thousand five hundred dollars ($10,500.00) incurred in

447pursuing the subject claim, and payment of past expenses, the

457claims of the Petitioners (claimants) sha ll be deemed fully

467satisfied and extinguished.

4704. The Division of Administrative Hearings retains

477jurisdiction over this matter to resolve any dispute as to the

488interpretation of any provision of the parties' stipulation and

497to resolve any disputes, shoul d they arise, regarding the

507parties' compliance with the terms of such stipulation.
