155STATEMENT OF THE ISSUES
159Is Petitioner, John J. Ardizone, the legal owner of
168personalized prestige license plate O/0 or is Intervenor, Linda
177Schnurmacher the legal owner of personalized prestige license
185plate O/0?
187PRELIMINARY STATEMENT
189In late 2001, the Department of Highway Safety and Motor
199Vehicles (Department) ascertained that two Florida personalized
206prestige license plates (personalized plate) bore the
213configuration uppercase "O" or zero, both being stamped with the
223same symbol on the license plate. Such dupli cation is
233prohibited by Section 320.0805(6), Florida Statutes.
239Decentralization of the issuing of personalized plates
246resulted in some inexactness in record keeping. In October
2551999, a redesigned computer system allowed the Department to
264begin to asc ertain the presence of duplicates in the system and
276to work through the process of eliminating the duplication
285through recall. Two registrants, Petitioner, John J. Ardizone
293and Intervenor, Linda Schnurmacher, were found to have the same
303configuration on t heir personalized plates, namely, "O/0," the
312capital letter and zero being stamped with the same character.
322The Department notified each party, neither of whom wished to
332surrender the configuration. The Department then determined
339that Linda Schnurmacher was first in time to have been issued
350the configuration. Consequently, by letter dated February 18,
3582002, the Department sent a recall notice to Petitioner to
368return his personalized plate. By a Petition dated February 25,
3782002, Petitioner challenged the Department's determination of
385the ownership of the configuration and requested a formal
394administrative hearing on the matter. On March 26, 2002, the
404Department filed a Motion for Notice to Interested Parties,
413which was granted by Order of April 3, 2002. Subsequently,
423Linda Schnurmacher filed a Motion to Intervene, which was
432granted by Order of May 13, 2002.
439At the hearing, Petitioner presented the testimony of Stan
448Kirkland and Nellie Causey. Petitioner's Exhibits 2, 11, 14
457through 18, 24, and 30 were admitted in evidence. The
467Department did not offer the testimony of any witnesses. The
477Department's Exhibits 1 through 12 were admitted in evidence.
486Linda Schnurmacher testified in her own behalf but did not offer
497any documentary evidence.
500A Transcrip t of this proceeding was filed with the
510Division on August 13, 2002. The parties timely filed their
520Proposed Recommended Orders.
523FINDINGS OF FACT
526Upon consideration of the oral and documentary evidence
534adduced at the hearing, the following relevant findi ngs of fact
545are made:
5471. With certain exceptions, the Department is vested with
556the statutory authority under Subsection 320.0805, Florida
563Statutes, to issue a personalized plate to the owner or lessee
574of any motor vehicle.
5782. In 1991, Data Form Corporat ion, a corporation owned,
588jointly at that time, by Linda Schnurmacher and her husband,
598Leonard Schnurmacher, leased a 1991 Infiniti automobile from
606Infiniti Financial Services whose address on the Vehicle
614Registration Certificate (Certificate) was the same as the
622Schnurmacher's address, to wit: 4101 North 48th Avenue,
630Hollywood, Florida. This vehicle was considered to be Linda
639Schnurmacher's personal vehicle. In 1991, the personalized
646plate with the configuration of uppercase "O" was registered to
656this v ehicle. It is not clear who originally owned the
667personalized plate, but apparently the personalized plate
674uppercase "O" was relinquished to the lessee, Data Form
683Corporation by the lessor, Infiniti Financial Services.
6903. The personalized plate uppercase "O" was placed on a
700series of vehicles, some leased by Data Form Corporation and
710driven personally by Linda Schnurmacher, and some leased
718directly by Linda Schnurmacher, from various lessors
725continuously since 1991. The registrant varied, sometimes the
733l essor, sometimes Data Form Corporation as lessee, sometimes
742Linda Schnurmacher as lessee.
7464. As part of the divorce settlement in 1998, Data Form
757Corporation, previously owned jointly by Linda Schnurmacher and
765Leonard Schnurmacher, went to Leonard Schnurm acher; and the
774right to use the personalized plate uppercase "O" went to Linda
785Schnurmacher
7865. Since 1991, each time a vehicle driven by Linda
796Schnurmacher was purchased, the selling motor vehicle dealership
804registered the vehicle, receiving from the the n present
813registrant the information necessary to assign the uppercase "O"
822personalized plate to the registrant Linda Schnurmacher's new
830vehicle.
8316. In 1993, Petitioner John J. Ardizone applied for and
841was issued a personalized plate "zero" or "0." At t he time, the
854personalized plate uppercase "O" was in use on the vehicle
864driven by Linda Schnurmacher, registered in the name of Infiniti
874Financial Services, the lessor of the vehicle.
8817. From the perspective of the appearance of the symbols
891on the persona lized plate, the uppercase "O" and zero (0) are
903identical, struck with the same dye. While the dye itself has
914changed from time to time, since the early '70's the same is
926used to stamp both uppercase "O" and zero. Until 1999, this
937configuration was known internally to the Department as
945uppercase "O"; following 1999, it became known as "zero." These
955designations are used to regularize the representation due to
964the confusion, which sometime took place in the individual tag
974office in typing the configuratio n. Despite the name confusion,
984the configuration on the plate is determinative of duplication
993between two personalized plates.
9978. The personalized plate issued to Petitioner in 1993,
1006and each subsequent personalized plate issued to Petitioner, was
1015improp erly issued by the Department, there being a prohibition
1025on the issuance of two personalized plates with the same
1035configuration
10369. On October 1, 1999, the Department redesigned its motor
1046vehicle system whereby the letter "O" now defaults to the number
"1057ze ro." As a result of that process, the Department has
1068identified numerous duplications in personalized plate
1074configurations. Duplications of the same configuration on a
1082personalized plate are not allowed. Where there are
1090duplications of the same configu ration, the Department
1098determines ownership of that configuration by proving which
1106person had that configuration first.
111110. In sorting out the irregularities, discovered
1118following the institution of the computer system in October
11271999, in duplicate pers onalized plates, the Department has
1136consistently recalled the personalized plate of the most recent
1145registrant of a personalized plate.
115011. Personalized plates registered to leasing companies
1157are treated as being issued to the lessee as well as the lessor .
1171CONCLUSIONS OF LAW
117412. The Division of Administrative Hearings has
1181jurisdiction over the parties and the subject matter of this
1191proceeding pursuant to Subsection 120.57(1), Florida Statutes.
119813. The burden of proof is on the party asserting the
1209affirm ative of an issue before an administrative tribunal,
1218Florida Department of Transportation v. J.W.C. Company, Inc .,
1227396 So. 2d 778 (Fla. 1st DCA 1981). To meet this burden, the
1240Department must establish facts upon which its allegations are
1249based by a prepo nderance of the evidence. Department of Banking
1260and Finance, Division of Securities and Investor Protection v.
1269Osborne Stern and Company , 670 So. 2d 932 (Fla. 1996) and
1280Subsection 120.57(1)(j), Florida Statutes.
128414. Subsections 320.0805(4) and (6), Flori da Statutes
1292(2001), provide:
1294(4) The department is authorized to
1300reject requests [for personalized plates]
1305deemed by it to be objectionable, and the
1313department is further authorized to recall,
1319during a registration period, any issued
1325personalized licens e plate determined by it
1332to be obscene or otherwise objectionable .
1339* * *
1342(6) A personalized prestige license plate
1348shall be issued for the exclusive continuing
1355use of the applicant. An exact duplicate of
1363any plate may not be issued to any other
1372applic ant during the same registration
1378period. An exact duplicate of any plate may
1386not be issued for any succeeding year unless
1394the previous owner of a specific plate
1401relinquishes it by failure to apply for
1408renewal of reissuance for three consecutive
1414annual per iods following the original year
1421of issuance. (Emphasis furnished.)
142515. The improper issuance of a personalized plate owing to
1435the presence of the configuration on an existing personalized
1444plate at the time of issuance is reasonably considered
1453obje ctionable by the Department.
145816. The Department has met its burden to show that the
1469personalized plate issued to the Schnurmacher vehicle was not
1478only first in time but was properly issued on each occasion.
1489Likewise, the Department has met its burde n to show that the
1501initial issuance of Petitioner's personalized plate and each
1509subsequent issuance was in error.
1514RECOMMENDATION
1515Based on the foregoing Findings of Fact and Conclusions of
1525Law, it is
1528RECOMMENDED that the Agency enter a final order requiring
1537Petitioner John J. Ardizone to surrender the personalized plate
1546presently in his possession.
