134STATEMENT OF THE ISSUE
138Whe ther the Petitioner is entitled to the award of Bid
149Number 2002024C as the lowest responsive bidder.
156PRELIMINARY STATEMENT
158On December 20, 2001, the Respondent, Department of
166Environmental Protection (Department or Respondent), issued
172an Invitation to Bid (ITB) for the mechanical removal of
182exotic plants within the Sebastian Inlet State Park (the
191project is identified in this record as Bid Number 2002024C).
201The Petitioner, Aqua - Terra, Inc. of Martin County, and others
212responded to the ITB.
216During the ranki ng of the bids, the Petitioner was
226scored based upon references provided to the Department. The
235Department contacted references who were asked to respond to
244a series of questions. The Petitioner believes the
252Department erroneously scored its references' responses to
259the questions posed.
262Accordingly, when it obtained written statements from
269the two references, the Petitioner filed the instant bid
278challenge to contest the score it was given. The bid protest
289was timely filed on January 24, 2002. The case w as not
301referred to the Division of Administrative Hearings until
309March 20, 2002.
312The case was promptly scheduled for hearing and all
321parties consented to the hearing date. A Notice of Hearing
331was issued on March 26, 2002. The Notice of Hearing provided
342that subpoenas would be issued upon request of the parties.
352Neither party requested subpoenas in this matter.
359At the hearing, Carlton Oaks testified on behalf of the
369Petitioner. The Petitioner was unable to get two references
378to voluntarily appear to tes tify. Nevertheless, the
386Petitioner attempted to move two reference letters into
394evidence. The Department objected to the admissibility of
402the evidence as hearsay. Such objection was sustained.
410As a result of the ruling, the Petitioner elected to
420withdraw the bid protest. Accordingly, this Recommended
427Order of Dismissal is being entered as there are no disputed
438issues of material fact to address.
444RECOMMENDATION
445Based on the foregoing, it is RECOMMENDED that the
454Department enter a Final Order dismissing the bid protest
463filed by the Petitioner regarding Bid Number 2002024C.
