123STATEMENT OF THE ISSUES
127The issues in this case are whether Respondent committed
136violations of Section 458.331(1), (t), (q), and (m), Florida
145Statutes, justifying the imposition of disciplinary measures
152against Respondent's medical license, and if so, what penalties
161should be imposed.
164PRELIMINARY STATEMENT
166An Administrative Complaint was filed by Petitioner in
174Department of Health (D OH) Case No. 1999 - 58907, on February 25,
1872002, against Respondent's license to practice medicine. The
195Administrative Complaint charged Respondent with three violations
202of the medical practice act, specifically those proscriptions set
211forth in Section 458. 331(1)(t), (q), and (m), Florida Statutes.
221All three charges or counts in the Administrative complaint were
231premised on his care and treatment of patient J.S. on July 28,
2431999. Respondent timely disputed the allegations of the
251Administrative Complaint an d the case was referred to the Division
262of Administrative Hearings for formal hearing.
268At the final hearing, Petitioner presented the testimony of
277Joyti Patel, M.D., as an expert witness via teleconference and
287offered five (5) exhibits in evidence, inclu ding a transcript of
298the deposition of B.S., the husband of J.S., which was admitted
309with reservation pending a later ruling on Respondents
317objections to the deposition. Respondents Motion to exclude
325portions of B.S.s deposition testimony is now denied and the
335deposition transcript has been considered in preparing this
343Recommended Order.
345At the final hearing, Respondent testified in his own
354behalf, and offered the testimony of Thomas Brown, M.D., Sonya
364Johnson, Frederika Monpetit, and Valentina Aldret e; and the
373expert testimony of William Witt, M.D. and Herbert Ferrari, M.D.
383Respondent also presented a total of 13 exhibits.
391At the request of the parties, time was extended for the
402filing of proposed recommended orders (PROs). The two - volume
412Transcript was filed July 9, 2002. Petitioner and Respondent
421filed their respective PROs and those submittals have been
430considered in the preparation of this Recommended Order.
438FINDINGS OF FACT
4411. Petitioner is the state agency responsible for
449regulating the pract ice of medicine in Florida pursuant to
459Section 20.43 and Chapters 456 and 458, Florida Statutes.
4682. Respondent is a licensed medical physician in Florida
477holding license number ME 15595. Respondent received his Florida
486license in 1970 and at the ti me of the formal hearing, he had
500practiced medicine for 42 years . He is Board - certified in
512Anesthesiology with a Certificate of Added Qualification in Pain
521Management. He was Board - certified in anesthesiology in 1967
531and received his certificate of added qualification in Pain
540Management when it was first offered in 1993.
5483. Respondent first evaluated J.S. on December 11, 1998.
557At that time, J.S. sought treatment from Respondent for
566complaints of severe back and leg pain. She had quite a lengthy
578histor y of back problems, having suffered falls in 1986 and
5891994, and having undergone four previous back surgeries.
5974. J.S. had seen various physicians for her complaints,
606and was on various medications, including Prozac, Klonopin,
614Prilosec, Premarin, levothyr oxine, and hyoscyamine. She
621reported a history of thyroidectomy due to thyroid cancer,
630hysterectomy, sinus surgery, and excision of fibromatous tumor
638from her right shoulder. She also reported a history of
648seizures.
6495. On her initial visit to Responde nt's office, J.S.
659completed a Pain Management Questionnaire. On the
666questionnaire, she indicated she was often forgetful and
674suffered from memory deficits and problems with her ability to
684concentrate.
6856. Between December 1998 and July 28, 1999, J.S. wa s
696treated about seven times by Respondent for her back pain. The
707treatment consisted of insertion of an epidural catheter and
716infusion pump in her back, which would release various
725medications, for the purpose of relieving her back pain. J.S.
735often retur ned to the office for dressing changes, pump refills,
746and reinsertion of the epidural catheter. These procedures were
755all completed successfully, without complication. J.S. was very
763happy with the results, and reported that the medication
772administered vi a the pump was her only relief from pain.
7837. On July 28, 1999, Patient J.S. saw the Respondent for
794this same procedure. The evidence is undisputed that this type
804of treatment by Respondent was medically appropriate to address
813J.S.'s pain condition.
8168. Respondent placed a catheter through a needle, removed
825the needle, and tunneled the catheter i.e., placed it
835underneath the skin in the back of J.S. at the L2 - L3 level of
850her back. Respondent then injected medication, including
857Marcaine and Fentanyl int o the catheter between 11:33 a.m. and
86811:45 a.m. Shortly after the Respondent administered the last
877injection of Marcaine to J.S., she said her right leg was
888getting numb.
8909. Because J.S. stated she had leg numbness, Respondent
899turned off the pump to pre vent the further release of
910medications into J.S. He then left the room to talk to a new
923patient. Respondent returned to the room approximately five
931minutes later upon being informed by his office staff that there
942was a problem with J.S. When Respondent entered the room, he
953found that J.S. was pale, unresponsive, and barely breathing;
962her heart rate was 39.
96710. The intrathecal space is the spinal canal where spinal
977fluid is located. The epidural space is close to the
987intrathecal space, and it is easy to go from one space to the
1000other when trying to inject within the epidural space.
100911. Having Marcaine enter the intrathecal space and having
1018the patient experience a high spinal are known complications
1027of the procedure performed on J.S.
103312. A high s pinal can cause significant numbness. As
1043the medication rises up the spinal fluid, it can cause visual
1054dilation, cardiovascular vascular collapse, and respiratory
1060problems. For this reason, the occurrence of a high spinal is
1071risky.
107213. A physician know s a high spinal may be occurring if
1084a patient complains of numbness in the lower extremities. As
1094the medication rises upwards toward the upper extremities, the
1103patient can complain of difficulty breathing, and experience a
1112drop in blood pressure and hea rt rate. Such patients become
1123obtunded, or unresponsive, requiring resuscitation.
112814. It is uncontroverted that J.S. sustained a high
1137spinal on July 28, 1999, which is a serious medical complication
1148and life - threatening situation. One of the dangers to J.S .
1160during the time she experienced the high spinal was the
1170deprivation of oxygen to her organs, including her brain.
117915. Respondent had left the room and did not return until
1190he was notified by office staff of a problem with J.S. As a
1203result, Respondent did not know how long Patient J.S. had been
1214without adequate perfusion of her organs, although he estimated
1223that it could have been anywhere from 30 seconds to two minutes.
123516. As depicted in Petitioner's proposed recommended order
1243and undisputed by Responden t, treatment and legend drugs
1252administered to J.S. from about noon on July 28, 1999, until
1263about 6 p.m., when Respondent called for an ambulance, are as

219217. Following Respondent's 911 call for a ambulance crew to
2202transpo rt J.S. to Fort Walton Beach Medical Center at
2212approximately 5:58 p.m., Emergency Medical Services (EMS)
2219personnel arrived at approximately 6:15 p.m.
222518. When the EMS personnel arrived at the Respondents
2234office, J.S. was unstable, with a high heart rat e of 153, pale,
2247and unresponsive.
224919. At approximately 6:40 p.m., J.S. arrived at Fort Walton
2259Beach Medical Center and was admitted to the Emergency Room.
226920. Respondent was not allowed to see J.S. at the hospital .
228121. As established by testimony of Dr. Patel, Petitioners
2290Expert, the Standard of Care required of the Respondent after he
2301administered Marcaine to J.S. and heard her state that her right
2312leg had become numb, was to closely monitor the patient by
2323looking for the signs of a developing "high spi nal." Respondent
2334failed to meet the Standard of Care in treating J.S. when he
2346left her in the treatment room with only a licensed practical
2357nurse (LPN) with no specific training in resuscitation or
2366dealing with potential complications arising from the pro cedure.
237522. Additionally, as established by the testimony of
2383Dr. Patel, Respondent failed to meet the Standard of Care when
2394he failed to call in a timely manner for emergency personnel to
2406transport J.S. to the hospital where she would have been better
2417monitored and treated for complications. Instead, he pursued
2425resucitative measures on J.S. for about six hours. A time
2435period which extended about four and one - half hours beyond the
2447maximum time period that Dr. Patel, Petitioner's expert, opined
2456was acce ptable.
245923. An additional aggravating factor in this matter is
2468Respondent's prior disciplinary history with the State of Ohio
2477received in evidence pursuant to Rule 64B8 - 8.002, Florida
2487Administrative Code.
2489CONCLUSIONS OF LAW
249224. The Division of Administ rative Hearings has
2500jurisdiction over the parties and the subject matter.
2508The parties received adequate notice of the administrative
2516hearing. Section 120.57(1), Florida Statutes.
252125. The burden of proof is on Petitioner. Petitioner must
2531show by clear and convincing evidence that Respondent committed
2540the violations alleged in Administrative Complaint and the
2548reasonableness of any proposed penalty. Department of Banking
2556and Finance, Division of Securities and Investor Protection vs.
2565Osborne Stern and Company , 670 So. 2d 932, 935 (Fla. 1996);
2576State ex rel. Vining v. Florida Real Estate Commission , 281 So.
25872d 487 (Fla. 1973); Ferris v. Turlington , 510 So. 2d 292 (Fla.
25991st DCA 1987).
260226. Petitioner satisfied its burden of proof with regard
2611to Count o ne of the Administrative Complaint. The proof is
2622clear and convincing that Respondent violated the Standard of
2631Care with regard to the time that he permitted to elapse before
2643EMS personnel were called and transported J.S. to the hospital.
2653Additionally, R espondent violated this standard through his
2661absence from the treatment room after symptoms of a high spinal
2672were beginning to be manifested. Clear and convincing evidence
2681has both qualitative and quantitative requirements. The factual
2689testimony of Petit ioner's expert, and the records submitted in
2699the case satisfy both the qualitative and quantitative
2707requirements for clear and convincing evidence.
271327. The evidence is not clear and convincing with regard
2723to Count two of the Administrative Complaint, alle ging violation
2733of the proscription against failure to keep adequate records
2742justifying the course of treatment. Respondent kept appropriate
2750records. Further, the parties do not dispute the propriety of
2760the procedure performed by Respondent on J.S. The c ourse of
2771treatment reflected in records of J.S., should not be confused
2781with the real issue at hand, i.e., whether Respondent violated
2791the Standard of Care by waiting an excessive length of time
2802before sending J.S. to the hospital.
280828. Count three of th e Administrative Complaint accuses
2817Respondent of the violation of administering legend drugs in
2826inappropriate or excessive quantities. Credible evidence that
2833Respondent committed this violation does not rise to level of
2843the required standard of clear and convincing. Accordingly,
2851Respondent is not guilty of commission of this alleged offense.
286129. Pursuant to Section 458.331(2), Florida Statutes, the
2869Board of Medicine is empowered to revoke, suspend, or otherwise
2879discipline the license to practice medicine of any physician
2888found to have committed a violation of the offenses alleged in
2899this cause.
290130. Rule 64B8 - 8.001 - 2, Florida Administrative Code (1999)
2912places the appropriate penalty for violating the standard of
2921care proscribed by Section 458.331(1)(t), Fl orida Statutes,
2929within a guideline range of t wo years probation to revocation, or
2941denial of licensure; and an administrative fine from $250 to
2951$5,000.
2953RECOMMENDATION
2954Based upon the foregoing Findings of Fact and Conclusions
2963of Law, it is
2967RECOMMENDED:
2968That in accordance with Petitioner's disciplinary
2974guidelines, that a final order be entered finding Respondent
2983guilty of violating Section 458.331(1)(t), Florida Statutes;
2990suspending Respondent's license for one year to be re - instated
3001o nly upon completion of 20 hours of continuing medical education
3012above the minimum required for maintenance of licensure with the
3022area of study for such additional hours to be determined by the
3034Board of Medicine; and imposition of a fine of $5,000.
