149By letter dated January 30, 2002, Respondent advised

157Petitioner tha t it had denied his application to take the

168licensing examination on the following grounds:

174(1) Applicant has failed to provide proof

198(2) Applicant has failed to show 40% of

23061G6 - 5.003(3)(b) is [sic] from a general

238contractor, Coastal Con struction Group. No

244evidence that this business has an electrical

251license was provided.

254(4) The applicant, as the project manager

261for a general contractor, is not qualified to

277By Petiti on for Formal Hearing dated February 28, 2002,

287which included an Election of Rights, Petitioner elected to have

297a formal hearing pursuant to Subsection 120.57(1), Florida

305Statutes. On April 3, 2002, Respondent referred this matter to

315the Division of Admin istrative Hearings requesting a hearing. On

325April 4, 2002, an Initial Order was forwarded to the parties.

336On April 23, 2002, the case was scheduled for final hearing

347on June 13, 2002, in Orlando, Florida. On June 6, 2002,

358Petitioner's motion for continua nce was granted.

365On August 5, 2002, the case was rescheduled for final

375hearing on October 24, 2002. At the final hearing, Petitioner

385testified on his own behalf and offered nine exhibits, seven of

396which were admitted into evidence and marked Petitioner's

404Exhibits 1 - 7; one exhibit was withdrawn by Petitioner. The final

416exhibit which was a letter dated October 16, 2002, from

426Michael Dodson, Esquire, with attachments was not admitted into

435evidence but was proffered by Petitioner and marked Petitioner's

444Exhi bit A for proffer.

449Respondent presented five witnesses: Clarence Tibbs,

455Anthony Spivey, Robert Crabill, George Ayrish, and Kevin

463Harrington. Mr. Tibbs was qualified as an expert witness in the

474field of electrical engineering. Respondent presented three

481exhibits, which were admitted into evidence and marked

489Respondent's Exhibits 1 - 3.

494At the final hearing, the undersigned Administrative Law

502Judge requested that Respondent present certain documentary

509evidence which related to the status of Electrical Contra ctors

519Licensing Board member, Dawn Johnson, and transcripts of portions

528of the audio tape recording of the January 16 and 17, 2002,

540meeting of the Electrical Contractors Licensing Board, which

548purported to relate to the Electrical Contractors Licensing

556Boa rd's consideration of Petitioner's application to take the

565licensing examination. These items, as well as the Affidavit of

575Dawn Johnson, were submitted after the final hearing and were

585considered by the undersigned. In addition, Petitioner's

592objection fi led November 15, 2002, and Respondent's response

601filed the same day were considered. These additional documents

610are made a part of the record.

617On October 28, 2002, Petitioner filed a Motion for Summary

627Recommended Order. On October 30, 2002, the undersig ned entered

637an Order deferring ruling on Petitioner's motion. Petitioner's

645motion is denied in accordance with this Recommended Order.

654The three - volume Transcript of the proceedings was filed

664with the Division of Administrative Hearings on November 18,

67320 02. By agreement, confirmed by the undersigned, the parties

683had until December 16, 2002, to submit proposed recommended

692orders. Both parties timely filed Proposed Recommended Orders.

700FINDINGS OF FACT

703Based on the oral and documentary evidence presented a t the

714final hearing, the following findings of fact are made:

7231. Respondent is the state agency vested with the authority

733to test applicants seeking certification as electrical

740contractors.

7412. Petitioner is seeking certification (licensure) as an

749electri cal contractor. On December 12, 2001, Respondent received

758Petitioner's application to take the Electrical Contractors

765Unlimited examination.

7673. On December 24, 2001, Respondent mailed Petitioner a

776letter requesting additional information. The letter req uested

784that the additional information be received by Respondent no

793later than January 4, 2002. This date was later extended to

804January 8, 2002.

8074. On January 4 and January 7, 2002, Petitioner, through

817his attorney, forwarded the requested additional inf ormation to

826Respondent. Petitioner's application was complete on January 10,

8342002.

8355. Respondent, Electrical Contractors Licensing

840Board("Board"), met on January 16 and 17, 2002.

8506. The Board delegates initial consideration of

857applications to take certi fication examinations to an

865Applications Committee consisting of members of the Board who

874make recommendations to the full Board on each application. Each

884application is examined by at least two Applications Committee

893members; if both recommend "denial of the application," or, if

903one recommends "approval of the application" and one recommends

"912denial of the application," the application is reviewed by a

922third Applications Committee member.

9267. Each member of the Applications Committee is provided a

936workshe et as a part of the application package which lists

947reasons for denial drawn from Subsection 489.511(2)(a)(3),

954Florida Statutes.

9568. After each application is considered by members of the

966Applications Committee, the application with the Applications

973Commit tee's recommendations, reasons for denial (if applicable),

981and other comments are given to a staff employee who prepares an

993approved/denial list which is presented to the full Board for

1003consideration.

10049. The foregoing procedure was followed in the instant

1013case. On January 16, 2002, Board members, Roger Lange and Kim

1024DeBerry, who were members of the Applications Committee,

1032considered Petitioner's application; both recommended denial of

1039the application. Because there were two recommendations of

1047denial, the application was considered by a third Applications

1056Committee member, Dawn Johnson; she, too, recommended denial.

106410. Petitioner's application and the recommendations,

1070reasons for denial, and comments of the Applications Committee

1079were then given to a sta ff employee who prepared a summary list

1092of all applicants with the recommendations for approval or denial

1102by the Applications Committee with reasons given for denial for

1112submission to the full Board.

111711. The full Electrical Contractors Licensing Board

1124c onsidered Petitioner's application on January 17, 2002, and

1133unanimously denied the application.

113712. Petitioner was advised of the denial by letter dated

1147February 8, 2002.

115013. Petitioner's Applicant's Affidavit dated November 16,

11572001, indicates that he was seeking a license under

1166Subsection 489 .511(2)(a)(3)(a), Florida Statutes. The

1172Applicant's Affidavit specifically states:

1176489.511(2)(a)(3)(a), F.S. Has, within the

1181six (6) years immediately preceding the

1187filing of the application, at least three (3)

1195years proven "management experience" in the

1201trade or education equivalent thereto, or a

1208combination thereof, but not more than one -

1216half of such experience may be educational.

123514. The occupationa l skills and responsibilities of an

1244electrical contractor are unique and require experience and

1252understanding which are typically acquired by extensive, direct

"1260on - the - job" training in the electrical contracting trade.

127115. Petitioner is an experienced Gen eral Contractor's

1279project manager. His credentials as a General Contractor's

1287project manager are impressive and the projects he has supervised

1297are extensive. Petitioner has little or no direct supervisory

1306experience in the electrical contracting trade.

13121 6. Petitioner's construction management experience is as a

1321General Contractor project manager, not an Electrical Contractor

1329project manager or similar position, and, as a consequence, he

1339does not meet the "'management experience' in the trade"

1348statutory r equirement.

135117. Petitioner has an enviable academic record: an

1359Associate of Science Degree With Honors from Miami - Dade Community

1370College (1990), a Bachelor of Science in Building Construction

1379from University of Florida (1993), 21 hours of graduate studie s

1390at Florida International University leading towards a Master of

1399Building Construction degree.

140218. Petitioner's academic credentials have little direct

1409application to the electrical contracting trade and, as a

1418consequence, do not meet the "educational eq uivalent" to

1427management experience statutory requirement.

1431CONCLUSIONS OF LAW

143419. The Division of Administrative Hearings has

1441jurisdiction over the parties and subject matter. Subsection

1449120.57(1), Florida Statutes.

145220. Subsection 120.52(9), Florida Statu tes, reads, as

1460follows:

"1461License" means a franchise, permit,

1466certification, registration, charter, or

1470similar form of authorization required by

1476law, but it does not include a license

1484required primarily for revenue purposes when

1490issuance of the license is merely a

1497ministerial act.

149921. Subsection 489.511(1), Florida Statutes, vests

1505Respondent with the statutory authority to conduct certification

1513(licensure) examinations for persons seeking certification as an

1521electrical contractor. Subsection 489.511(2 ), Florida Statutes,

1528establishes criteria which entitle persons seeking certification

1535as an electrical contractor to take the certification

1543examination.

154422. Petitioner must establish that he meets licensure

1552application criteria by a preponderance of the e vidence.

1561Subsection 120.57(1)(j), Florida Statutes; Florida Department of

1568Transportation v. J.W.C. Co. , 396 So. 2d 778 (Fla. 1st DCA 1981);

1580Balino v. Department of Health and Rehabilitative Services ,

1588348 So. 2d 349 (Fla. 1st DCA 1977); Barbec v. Departmen t of

1601Professional Regulation, Board of Architecture and Interior

1608Design , 14 FALR 5312 (DOAH 1992).

161423 . Petitioner as a licensure applicant carries the

1623ultimate burden of persuasion of entitlement to take the

1632certification examination. Osborne Stern and C o., Inc. v.

1641Department of Banking and Finance, Division of Securities and

1650Investor Protection , 647 So. 2d 245, 250 (Fla. 1st DCA 1994);

1661Pershing Industries, Inc. v. Department of Banking and Finance ,

1670591 So. 2d 991 (Fla. 1st DCA 1991); Y oung v. Department of

1683Community Affairs , 567 So. 2d 2, 3 (Fla. 3d DCA 1990); Florida

1695Department of Transportation v. J.W.C. Co. , 396 So. 2d 778, 787

1706(Fla. 1st DCA 1981).

171024 . Discretionary authority is necessary for agencies

1718involved in the issuance of licenses and the deter mination of

1729fitness of applicants for licenses. Astral Liquors, Inc. v.

1738Department of Business Regulation , 463 So. 2d 1130 (Fla. 1985);

1748Permenter v. Younan , 31 So. 2d 387 (Fla. 1947); Solimena v.

1759State, Department of Business Regulation , 402 So. 2d 1240 ( Fla.

17703d DCA 1981); Brewer v. Insurance Commissioner and Treasurer ,

1779392 So. 2d 593 (Fla. 1st DCA 1981).

178725. In seeking a Subsection 120.57(1), Florida Statutes,

1795hearing, Petitioner has disputed material facts and is afforded

1804a de novo proceeding; Responden t's denial of Petitioner's

1813application to take the licensure examination carries no

1821presumption of correctness. Subsection 120.57(1)(k), Florida

1827Statutes; Moore v. State, Department of Health and

1835Rehabilitative Services , 596 So. 2d 759 (Fla. 1st DCA 1992) . As

1847a result, Petitioner has an opportunity to present evidence to

1857demonstrate his entitlement to take the certification

1864examination and any perceived shortcomings of the deliberative

1872process of Respondent are cured.

187726. The Florida Legislature may pres cribe standards that

1886all applicants must meet before qualifying for licensure

1894examinations. State ex rel. Kaplan v. Dee , 77 So. 2d 768 (Fla.

19061955); Clark v. Department of Professional Regulation, Board of

1915Professional Geologists , 584 So. 2d 59 (Fla. 1st D CA 1991).

192627. Requiring that a licensure applicant establish a

1934period of practical experience as a condition of licensure or

1944before admission to licensure examination is not uncommon. For

1953example, Subsection 471.013(1)(a)1, Florida Statutes(engineers);

1958S ubsection 458.311(1)(f)1c, Florida Statutes (medical doctors).

196528. In denying Petitioner's application to take the

1973licensure examination, Respondent alleged that: Applicant has

1980failed to provide proof of three years of management experience

1990in the electr ical trade as required pursuant to Subsection

2000489.511(2)(a)(3)(a), Florida Statutes.

200329. Subsection 489.511(2)(a)(3)(a), Florida Statutes,

2008reads, as follows:

2011(2)(a) A person shall be entitled to take

2019the certification examination for the purpose

2025of de termining whether he or she is qualified

2034to engage in contracting throughout the state

2041as a contractor if the person:

2047* * *

20503. Meets eligibility requirements

2054according to one of the following criteria:

2061a. Has, within the 6 years immediately

2068p receding the filing of the application, at

2076least 3 years' proven management experience

2082in the trade or education equivalent thereto,

2089or a combination thereof, but not more than

2097one - half of such experience may be

2105educational equivalent.

210730. Petitioner fail ed to provide persuasive evidence that

2116Petitioner's management experience as a General Contractor's

2123project manager met the statutorily required management criteria

2131because he failed to demonstrate that the management experience

2140was in the electrical contr acting trade. The evidence

2149demonstrated that Petitioner's management experience on

2155construction projects, as it related to electrical contracting,

2163was indirect and typically involved interaction with the

2171Electrical Contractor's project manager as opposed to being

2179directly involved with individuals in the field doing the work.

2189Similarly, Petitioner's academic record, while admirable, has

2196little application to electrical contracting.

220131. In denying Petitioner's application to take the

2209licensure examination, Respondent also alleged that:

2215Applicant has failed to show 40 percent of the work experience in

22273 - phase electrical work, as required pursuant to Rule 61G6 -

22395.001(1), Florida Administrative Code.

224332. Rule 61G6 - 5.003, Florida Administrative Code, reads, i n

2254pertinent part, as follows:

2258* * *

22612. The experience required must include:

2267a. For an electrical contractor, at least 40%

2275of work that is 3 - phase service.

228333. Petitioner's assertion that his General Contractor

2290project manager's management ex perience, already determined to be

2299non - qualifying, included 40 percent work experience in three -

2310phase electrical service, is not persuasive.

231634. In denying Petitioner's application to take the

2324licensure examination, Respondent further alleged that: The

2331W - 2's submitted pursuant to Rule 61G6 - 5.003(3)(b) are from a

2344general contractor, Coastal Construction Group. No evidence that

2352this business has an electrical license was provided.

236035. Rule 61G6 - 5.003(3)(b), Florida Administrative Code,

2368reads, in pertinen t part, as follows:

2375(3) All applicants attempting to

2380demonstrate qualification by experience

2384pursuant to Section 489.511(2)(a)3.a., b.,

2389c., must forward the following to the Board:

2397* * *

2400(b) Statements prepared and signed in the

2407presence o f a notary by some person or

2416persons other than the applicant for

2422examination listing chronologically the

2426active experience of the applicant for

2432examination in the trade, including the name

2439and address of employers, and dates of

2446employment along with copie s of W - 2 forms.

245636. The reference to W - 2 forms evidencing employment by a

2468General Contractor and no W - 2 forms evidencing employment by an

2480Electrical Contractor reinforces the determination that

2486Petitioner lacked management experience in the electrical

2493co ntracting trade and failed to meet the statutory criteria. As

2504noted, merely having some degree of supervisory authority over

2513the various trades at a construction site does not satisfy the

2524statutory criteria of "management experience in the trade."

253237. Su bsection 489.113(3), Florida Statutes, reads as

2540follows:

2541(3) A contractor shall subcontract all

2547electrical, mechanical, plumbing, roofing,

2551sheet metal, swimming pool, and air -

2558conditioning work, unless such contractor

2563holds a state certificate or registr ation in

2571the respective trade category, . . . ."

2579One reason Florida law requires a General Contractor to

2588subcontract electrical work is because it is unique and requires

2598special skill, knowledge, and experience. The same logic compels

2607the conclusion that a lack of management experience in the

2617electrical contracting trade would disqualify an applicant

2624seeking certification as an electrical contractor.

263038. Subsection 120.60(1), Florida Statutes, reads, as

2637follows:

2638(1) Upon receipt of an application for a

2646license, an agency shall examine the

2652application and, within 30 days after such

2659receipt, notify the applicant of any apparent

2666errors or omissions and request any

2672additional information the agency is

2677permitted by law to require. An agency shall

2685not deny a license for failure to correct an

2694error or omission or to supply additional

2701information unless the agency timely notified

2707the applicant within this 30 - day period. An

2716application shall be considered complete upon

2722receipt of all requested information and

2728correction of any error or omission for which

2736the applicant was timely notified or when the

2744time for such notification has expired.

2750Every application for a license shall be

2757approved or denied within 90 days after

2764receipt of a completed application unless a

2771shorter period of time for agency action is

2779provided by law. The 90 - day time period

2788shall be tolled by the initiation of a

2796proceeding under ss. 120.569 and 120.57. An

2803application for a license must be approved or

2811denied within the 90 - day or shorter tim e

2821period, within 15 days after the conclusion

2828of a public hearing held on the application,

2836or within 45 days after a recommended order

2844is submitted to the agency and the parties,

2852whichever is later. The agency must approve

2859any application for a license or for an

2867examination required for licensure if the

2873agency has not approved or denied the

2880application within the time periods

2885prescribed by this subsection.

2889Respondent met the statutory requirements of Subsection

2896120.60(1), Florida Statutes.

2899RECOMMENDATION

2900Based on the foregoing Findings of Fact and Conclusions of

2910Law, it is

2913RECOMMENDED that a final order be entered denying

2921Petitioner's application to take the Certified Electrical

2928Contractor's Licensure Examination.
