138The sole issue to be addressed is whether the Pet ition to

174PRELIMINARY STATEMENT

176On January 31, 2002, the Petitioner filed the Petition to

186cont ract the Gateway Services District with the Secretary of

196Florida Land and Water Adjudicatory Commission (Commission),

203the City of Fort Myers, Florida, and Lee County, Florida. An

214Addendum to the Petition was filed with the Secretary of the

225Commission on o r about March 25, 2002. A Second Addendum to

237the Petition was filed with the Secretary of the Commission on

248or about July 16, 2002. A Third Addendum to the Petition was

260filed with the Secretary of the Commission on or about July

27125, 2002. A copy of the Petition, including its exhibits, and

282the First, Second, and Third Addenda, was received into

291evidence as Petitioner's Composite Exhibit 9.

297On April 2, 2002, the Secretary of the Commission

306certified that the Petition contained all required elements,

348The Commission published a Notice of Receipt of Petition

357in the Florida Administrative Weekly on May 17, 2002. A copy

368of the Notice of Receipt of Petition was received into

378evidence as Petitioner's Exhibit 8.

383The local public hearing was scheduled in Fort Myers, Lee

393C ounty, Florida, for Tuesday, July 16, 2002, at 1:00 p.m. The

405Petitioner published notice of the hearing in accordance with

414Sections 190.046(1)(g) and 190.005(1)(d), Florida Statutes.

420The Proof of Publication of the Notice of Local Public Hearing

431was rece ived into evidence as Petitioner's Exhibit 4.

440The land currently within the District is located

448partially within the unincorporated Lee County, and partially

456within the incorporated City of Fort Myers, Florida. All of

466the property proposed for Contractio n from the District is

476located within the City of Fort Myers, Florida.

484Sections 190.046(1)(d)3. and 190.005(1)(c), Florida

489Statutes, provide that the county and each municipality

497containing all or a portion of the lands within the proposed

508District has th e option to hold a public hearing within forty -

521five (45) days of the filing of the petition.

530The City Council of the City of Fort Myers, Florida

540elected to hold such a hearing on March 4, 2002. After the

552public hearing, the City Council adopted a resolut ion in

562support of the contraction of the Gateway Services District.

571A certified copy of the resolution was received into evidence

581as Petitioner's Exhibit 5.

585The Board of County Commissioners of Lee County elected

594to hold a hearing on June 25, 2002. Afte r the public hearing,

607the Board of County of County Commissioners adopted a

616resolution in support of the contraction of the District. A

626certified copy of the resolution was received into evidence as

636Petitioner's Exhibit 6.

639At the local public hearing on July 16, 2002, the

649Petitioner presented the testimony of John Gnagey (Gnagey)

657Principal of The Worthington Group; James P. Ward (Ward) Vice

667President of Operations for Severn Trent Environmental

674Services, Inc., and an expert in special district and communi ty

685development district management, operations, planning and

691finance; Andrew D. Tilton (Tilton), Director of Water Resources

700for Johnson Engineering, Inc., and an expert in civil

709engineering with an emphasis in public infrastructure design,

717permitting, and cost estimation in construction for special

725districts and community development districts; and Carey

732Garland (Garland), an associate with Fishkind and Associates,

740Inc., and an expert in economics and finance, including

749financing and the use of community d evelopment districts and

759special taxing districts. The full names and addresses of

807No other persons or entities presented any witnesses or

816exhibits. No members of the public provided any comment.

825The one - volume transcript of the local public hearing was

836filed on Augus t 5, 2002, with the Division of Administrative

847Hearings. The original transcript and hearing exhibits are

855transmitted with this Report.

859FINDINGS OF FACT

862Overview

8631. The Petitioner is seeking the adoption of a rule by

874the Commission to contract a communi ty development district

883currently comprised of approximately 5,474 acres located

891within the boundaries of unincorporated Lee County, Florida

899and the incorporated City of Fort Myers, Florida. The name

909for the District, after contraction, will be the Gatewa y

919Services Community Development District. At the time the

927Petition was filed, the District consisted of approximately

9355,324 acres. However, on July 29, 2002, a Rule Amendment

946adopted by the Commission, and filed with the Secretary of

956State became effect ive, expanding the District to

964approximately 5,474 acres.

9682. The Petitioner seeks to contract the District by

977approximately 973 acres. The District, after contraction,

984will encompass approximately 4,501 acres.

9903. All of the property proposed to be c ontracted out of

1002the District is located within the City of Fort Myers,

1012Florida.

10134. The sole purpose of this proceeding was to consider

1023the contraction of the District as proposed by the Petitioner.

1033Summary of Evidence and Testimony

1038A. Whether all statem ents contained within the

1046Petition have been found to be true and correct.

10555. Petitioner's Composite Exhibit 9 was identified for

1063the record as a copy of the Petition and its exhibits as filed

1076with the Commission, dated January 2002; the Addendum to the

1086Petition, dated March 25, 2002; and the Second Addendum to the

1097Petition, dated July 16, 2002; and the Third Addendum to the

1108Petition, dated July 25, 2002.

11136. Ward testified that he had reviewed the contents of

1123the Petition and Exhibits as supplemented a nd amended by the

1134addenda to the Petition. Ward testified that the Petition and

1144exhibits as supplemented and amended by the addenda, are true

1154and correct to the best of his knowledge.

11627. Tilton testified that he had reviewed Exhibits 1, 2,

1172and 3 of the P etition. Exhibit 1 is the metes and bounds

1185legal description and sketch of the existing District

1193boundaries. Exhibit 2 is the legal description and sketch of

1203the contraction parcels. Exhibit 3 is the amended legal

1212description and sketch of the District, after contraction.

12208. Tilton testified that the legal description of the

1229existing CDD boundaries was true and correct, and would be

1239amended by a proposed Rule Amendment filed with the Secretary

1249of State July 9, 2002, and effective July 29, 2002.

12599. Til ton testified that Exhibit 2 truly and accurately

1269depicted the legal description of the property proposed for

1278contraction from the District.

128210. A Third Addendum to the Petition, filed with the

1292Department of Administrative Hearings on July 29, 2002,

1300ident ified a scrivener's error in the proposed Rule Amendment

1310filed on July 9, 2002, and included a legal description and

1321sketch of the land within the District, after the contraction.

1331This legal description and sketch amends and replaces Exhibit

13403 of the Peti tion. This legal description was certified as

1351true and accurate by CES Engineering.

135711. Garland testified that his office had prepared

1365Exhibit 7 to the Petition, the Statement of Estimated

1374Regulatory Costs (SERC). Garland also testified the SERC

1382includ ed with the Petition was true and correct to the best of

1395his knowledge.

139712. Gnagey testified that at the time of the hearing,

1407Worthington Holdings, Inc. was the owner of all of the lands

1418to be contracted out of the District. Gnagey testified that a

1429por tion of the contraction property was under contract for

1439sale. A consent and joinder to the Petition to Contract,

1449executed by the contract purchaser was placed into the record

1459as Exhibit 3.

146213. The Petition does not contain the written consent of

1472the owne rs of all real property to be included in the new

1485District after contraction; nor was there any documentation or

1494other evidence demonstrating that either the District or those

1503giving their written consent to the contraction have control

1512by deed, trust agre ement, contract, or option of one - hundred

1524percent (100%) of the real property to be included in the new

1536District, after contraction. See Conclusion of Law 65.

154414. Based upon the foregoing, the Petition and its

1553exhibits, as amended and supplemented by th e addenda to the

1564Petition, are true and correct.

1569B. Whether the contraction of the District is

1577inconsistent with any applicable element or

1583portion of the State Comprehensive Plan or of

1591the effective local government comprehensive

1596plan.

159715. Ward address ed whether the contraction of the

1606District was inconsistent in any way with the State

1615Comprehensive Plan, Chapter 187, Florida Statutes. Ward also

1623reviewed the contraction of the District, in light of the

1633local government comprehensive plans.

163716. Ward t estified that the District would continue to

1647assist the local government in providing infrastructure

1654services required pursuant to its locally adopted

1661comprehensive plan. Furthermore, since the State

1667Comprehensive Plan requires local governments to provid e

1675infrastructure in accordance with locally adopted

1681comprehensive plans, the District would continue to function

1689and assist in meeting this objective of Chapter 187.

169817. Resolution No. 2002 - 11, adopted by the City Council

1709of the City of Fort Myers, Florid a, was introduced into

1720evidence as Petitioner's Exhibit 5. Pursuant to this

1728Resolution, the City Council made a determination that after

1737the contraction, the District is not inconsistent with

1745applicable elements or portions of the State Comprehensive

1753Plan or the City of Fort Myers local comprehensive plan.

176318. The Florida Department of Community Affairs reviewed

1771the Petition and provided a letter dated April 16, 2002, which

1782was placed into Evidence as Petitioner's Exhibit 7. The

1791letter states that the P etition A "is consistent with the

1802goals, objectives and policies of Lee County's Comprehensive

1810Plan.”

181119. Based on the testimony and exhibits in the record,

1821the proposed District will not be inconsistent with any

1830applicable element or portion of the Sta te Comprehensive Plan,

1840the Lee County Comprehensive Plan, or City of Fort Myers

1850Comprehensive Plan.

1852C. Whether the area of land within the district,

1861after contraction, is of sufficient size, is

1868sufficiently compact, and is sufficiently

1873contiguous to be d evelopable as one functional

1881interrelated community.

188320. Testimony on this criterion was provided by Ward and

1893Tilton. The lands that comprise the District, after

1901contraction, will consist of approximately 4,501 acres,

1909located within the borders of unin corporated Lee County, and

1919the incorporated City of Fort Myers.

192521. From a management perspective, the District, after

1933contraction, will continue to be sufficiently sized, compact

1941and contiguous to be developed as a functional interrelated

1950community. Th e property remaining within the District will

1959continue to be amenable to receiving services through a

1968community development district.

197122. From an engineering perspective, the District, after

1979contraction, will still be larger than other community

1987developm ent districts. It is contiguous and relatively

1995compact. The land remaining within the District can be well -

2006served by water management facilities, water and sewer and

2015irrigation, roads lighting, landscaping and parks provided by

2023the District.

202523. From a d evelopment planning perspective, the owner

2034of the property, which will be contracted out of the District,

2045intends to market the contraction property for development as

2054three separate, stand - alone communities. This property will

2063be developed independently from the property remaining within

2071the District. Its utility needs will be serviced by the City

2082of Fort Myers.

208524. From development planning, engineering, and

2091management perspectives, the area of land to be included in

2101the proposed District is of suffici ent size, is sufficiently

2111compact, and is sufficiently contiguous to be developed as a

2121single functionally interrelated community.

2125D. Whether the district, after contraction, is the

2133best alternative available for delivering

2138community development services and facilities to

2144the area that will be served by the contracted

2153district.

215425. The District currently provides certain

2160infrastructure improvements and facilities to the property

2167which will remain in the District.

217326. Currently, no services or facilities are provided by

2182the District to the property to be contracted out of the

2193District. Ward, Tilton, and Garland testified concerning

2200whether the District, as contracted, is the best alternative

2209available for delivering community development services and

2216fac ilities to the area remaining in the District.

222527. Ward testified that since the 1980's, the District

2234has provided and maintained infrastructure which services the

2242existing residents of the District, and is also available to

2252service future residents of th e District. The District is

2262responsible for financing, operating and maintaining this

2269infrastructure. Based upon its historical track record, and

2277its current activities, the District will continue to serve

2286these purposes.

228828. Tilton testified that, from an engineering

2295perspective, the District is an excellent alternative for

2303providing community services and facilities to the property

2311remaining in the District because it provides a higher level

2321of service than would be afforded by Lee County or the City o f

2335Fort Myers. This higher level of service meets the desire of

2346the residents within the District.

235129. Garland testified that, from an economic

2358perspective, the District as contracted, will still consist of

2367approximately 5,799 equivalent residential units . There will

2376be no financial impact to the landowners remaining in the

2386District because neither the capital assessments nor the

2394operations and maintenance assessments will be affected by the

2403contraction. Currently, the contraction parcel is not taking

2411an y of the load for capital assessments or operations and

2422maintenance assessments.

242430. Garland also testified that the contraction property

2432is geographically closer to infrastructure facilities

2438available from the City of Fort Myers, than it is to District

2450f acilities. Therefore, the District is not the best

2459alternative for providing this infrastructure to the

2466contraction property.

246831. From economic, engineering, and special district

2475management perspectives, the District, after contraction, is

2482the best alter native available for delivering community

2490development services and facilities to the area that will

2499continue to be served by the District.

2506E. Whether the community development services and

2513facilities of the district, as contracted, will

2520be incompatible wi th the capacity and uses of

2529existing local and regional community development

2535services and facilities.

253832. The services and facilities which will continue to

2547be provided by the District are not incompatible with uses and

2558existing local and regional facil ities and services. The

2567District's facilities and services within the boundaries, as

2575contracted, will not duplicate any existing regional services

2583or facilities which are provided to the lands within the

2593District by another entity. None of the proposed s ervices or

2604facilities are presently being provided by another entity for

2613the lands to remain within the District.

262033. Ward, Tilton, and Garland testified concerning

2627whether the community development services and facilities of

2635the district, as contracted , would be incompatible with the

2644capacity and uses of existing local and regional community

2653development services and facilities.

265734. Ward testified that the District provides services

2665and facilities which compliment the general purpose local

2673governments’ services and facilities. For example, the

2680District has constructed drainage facilities. These services

2687address the requirements for infrastructure of the local

2695government. After contraction, the District will continue to

2703provide these infrastructure ser vices.

270835. Tilton testified that the services and facilities

2716provided by the District work very well in concert with the

2727adjacent facilities of the general purpose local government.

2735The roadways, utilities, and water management facilities

2742constructed by the District are integrated into the overall

2751system of the adjacent areas.

275636. From a management perspective and an engineering

2764perspective, the facilities and services to be provided by the

2774District, after the contraction, will not be incompatible with

2783the existing local and regional community development services

2791and facilities.

2793F. Whether the area that will be served by the

2803district, after contraction, is amenable to

2809separate special district government.

281337. As cited previously, from economics, eng ineering,

2821and special district management perspectives, the area of land

2830to be included in the proposed District is of sufficient size,

2841is sufficiently compact, and is sufficiently contiguous to be

2850developed and become a functionally interrelated community .

2858The community to be included in the District, after

2867contraction, will continue to require basic infrastructure

2874systems. A determination was made when the District was

2883formed, that the District could best provide these services.

2892This determination will not change as a result of the

2902contraction.

290338. From engineering, economic and management

2909perspectives, the area that will be served by the amended

2919District is amenable to separate special - district government.

2928G. Other requirements imposed by statute or rule.

293639. Chapter 190, Florida Statutes, and Chapter 42 - 1,

2946Florida Administrative Code, impose specific requirements

2952regarding the Petition and other information to be submitted

2961to the Commission.

2964Elements of the Petition

296840. The Commission has certified that the Petition to

2977Contract the Gateway Services District meets all of the

2986required elements of Section 190.005(1)(a), Florida Statutes.

2993Statement of Estimated Regulatory Costs (SERC)

299941. The SERC contains an estimate of the costs and

3009benefits to all persons directly affected by the proposed rule

3019to contract the District -- the State of Florida and its

3030citizens, the County and its citizens, the City and its

3040citizens, the landowners within the District after

3047contraction, and the Petitioner.

305142. Beyond administrative costs related to rule

3058adoption, the State and its citizens, are not anticipated to

3068incur any costs from contracting the District.

307543. Administrative costs incurred by Lee County and the

3084City of Fort Myers related to this Petition are minim al and

3096should be offset by the filing fees paid by the Petitioner.

310744. Landowners remaining within the District will

3114continue to pay non - ad valorem or special assessments for

3125certain facilities. The contraction of District will have no

3134impact on the leve l of capital assessments or operations and

3145maintenance assessments paid by residents remaining in the

3153District. Benefits to landowners in the District will

3161continue to be a higher level of public services and amenities

3172than might otherwise be available, c onstruction, operation and

3181maintenance of District - sponsored improvements to the area on

3191a timely basis, and a larger share of direct control over

3202community development services and facilities within the area.

321045. Sections 190.046(1)(g) and 190.005(1)(a) , Florida

3216Statutes, require the Petition to include a SERC which meets

3226the requirements of Section 120.541, Florida Statutes. The

3234Petition contains a SERC. It meets the requirements of

3243Section 120.541, Florida Statutes.

3247Other Requirements

324946. Sections 190.046(1)(g) and 190.005(1)(d), Florida

3255Statutes, require the Petitioner to publish notice of the

3264local public hearing in a newspaper of general circulation in

3274Lee County for four consecutive weeks prior to the hearing.

3284The notice was published in The Ne ws - Press, a newspaper of

3297general circulation in Lee County for four consecutive weeks,

3306on June 18, 2002, June 25, 2002, July 2, 2002, and July 9,

33192002. The Affidavit of Publication was placed into evidence

3328as Petitioner’s Exhibit 4.

3332Lee County Support for Establishment

333747. Pursuant to the requirements of Sections

3344190.046(1)(g) and 190.005(1)(b), Florida Statutes, Petitioner

3350filed a copy of the Petition with the City of Fort Myers and

3363Lee County prior to filing the Petition with the Commission.

337348. As p ermitted by Sections 190.046 and 190.005(1)(c),

3382Florida Statutes, the City Council of the City of Fort Myers

3393held a public hearing on March 4, 2002, to consider the

3404contraction of the Gateway Services District.

341049. At the conclusion of its public hearing on March 4,

34212002, the City Council adopted Resolution 2002 - 11 expressing

3431support for the Commission to promulgate a rule contracting

3440the Gateway Services District.

344450. The City of Fort Myers City Council Resolution

3453specifically found that all six (6) of the statutory factors

3463for evaluating the contraction of community development

3470districts found in Section 190.005(1)(e), Florida Statutes,

3477had been met by the Petitioner in this matter.

348651. As permitted by Sections 190.046 and 190.005(1)(c),

3494Florida Stat utes, the Board of County Commissioners of Lee

3504County held a public hearing on June 25, 2002, to consider the

3516contraction of the Gateway Services District.

352252. At the conclusion of the public hearing on June 25,

35332002, the Board of County Commissioners of Lee County adopted

3543Resolution No.02 - 06 - 43, expressing support for the Commission

3554to promulgate a rule contracting the Gateway Services

3562District.

3563CONCLUSIONS OF LAW

356653. This proceeding is governed by Chapters 120 and 190,

3576Florida Statutes, and Chapter 42 - 1, Florida Administrative

3585Code.

358654. The proceeding was properly noticed pursuant to

3594Section 190.005, Florida Statutes, by publication of an

3602advertisement in a newspaper of general circulation in Lee

3611County once each week for the four (4) consecutive w eeks

3622immediately prior to the hearing.

362755. The Petitioner has met the requirements of Sections

3636190.046(1)(g) and 190.005, Florida Statutes, regarding the

3643submission of the Petition.

364756. The Petitioner bears the burden of establishing that

3656the Petition meets the relevant statutory criteria set forth

3665in Section 190.005(1)(e), Florida Statutes.

367057. All portions of the Petition and other submittals

3679have been completed and filed as required by law.

368858. All statements contained within the Petition as

3696amen ded and supplemented by the Addenda to the Petition, and

3707at the hearing are true and correct.

371459. The contraction of the District is not inconsistent

3723with any applicable element or portion of the State

3732Comprehensive Plan or the effective City of Fort Mye rs

3742Comprehensive Plan.

374460. The area of land within the proposed District is of

3755sufficient size, is sufficiently compact, and is sufficiently

3763contiguous to be developable as one functional interrelated

3771community.

377261. The proposed District is the best al ternative

3781available for delivering community development services and

3788facilities to the area that will be served by the District.

379962. The community development services and facilities of

3807the proposed District will not be incompatible with the

3816capacity an d uses of existing local and regional community

3826development services and facilities.

383063. The area to be served by the proposed District is

3841amenable to separate special district government.

384764. Notwithstanding the above, as found in Finding of

3856Fact B, t he Petition does not contain the written consent of

3868the owners of the real property to be included in the new

3880District, after contraction; nor was there any documentation

3888or other evidence demonstrating that either the District or

3897those giving their writte n consent to the contraction have

3907control by deed, trust agreement, or contract, or option of

3917one - hundred percent (100%) of the real property to be included

3929in the new District, after contraction. Section

3936190.005(1)(a)2., Florida Statutes, requires that a Petition

3943for establishment of a community development district (CDD)

3951contain the written consent of the owners of all of the real

3963property to be included in the proposed CDD, or documentation

3973demonstrating that the Petitioner has control by deed, trust

3982ag reement, contract, or option of one - hundred percent (100%)

3993of the real property to be included in the proposed CDD.

4004Section 190.046(1)(e), Florida Statutes, requires the written

4011consent of all landowners whose land is being deleted through

4021contraction (wh ich has been proven here), but paragraphs (f) -

4032(g) of Section 190.046(1), Florida Statutes, would appear to

4041require the Petitioner to follow all of the requirements

4050specified in Section 190.005, including the "consent"

4057requirement of Section 190.005(1)(a)2. , Florida Statutes.

406365. Nevertheless, Petitioner argues that emphasis should

4070be placed on the word "procedures" in Section 190.046(1)(g),

4079Florida Statutes, and that that does not necessarily include

4088satisfaction of the "consent" requirements of Section

40951 90.005(1)(a)2., Florida Statutes, where there is a request to

4105contract more than 250 acres from a CDD, as here. This

4116interpretation appears to be consistent with the Commission's

4124past practice. See , e.g. , Exhibit 1. See also In Re:
