95This cause came on to be heard pursuant to Section 766.304,

106Florida Statutes, upon the stipulation and joint petition of the

116parties, filed October 6, 2003, for the entry of an order

127app roving the resolution of a formal claim for compensation

137benefits heretofore filed in this cause in accordance with the

147provisions of Chapter 766, Florida Statutes, and a resolution of

157the exclusive remedy otherwise available as outlined in Chapter

166766, Fl orida Statutes.

170By the terms of their stipulation, the parties have agreed

180that Petitioners, Luz Corredor and Jose Alejandro Vasquez, are

189the parents of, and co - personal representatives of the Estate

200of, Alejandro Corredor (Alejandro), a deceased minor; th at

209Alejandro was born a live infant on April 23, 1997, at

220Plantation General Hospital, a hospital located in Plantation

228Florida; and that his birth weight was in excess of 2,500 grams.

241The parties have further agreed that the physician delivering

250obstetri cal services during the birth of Alejandro was Celina

260Poy - Wing, M.D., who was, at all times material hereto, a

272participating physician in the Florida Birth - Related

280Neurological Injury Compensation Plan, as defined by Section

288766.302(7), Florida Statutes. Finally, by their stipulation,

295the parties have agreed that Alejandro suffered a "birth - related

306neurological injury," as that term is defined by Section

315766.302(2), Florida Statutes.

318After due consideration of the interests of all parties,

327and being othe rwise fully advised in the premises, it is

338ORDERED that:

3401. The stipulation of the parties, filed October 6, 2003,

350is hereby approved, and the parties are directed to comply with

361the provisions thereof.

3642. Petitioners, Luz Corredor and Jose Alejandro Vas quez,

373as the parents of Alejandro Corredor, a deceased minor, are

383accorded a lump sum award of One hundred thousand dollars

393($100,000.00).

3953. Upon payment of the lump sum award of One hundred

406thousand dollars ($100,000.00) to the parents (claimants),

414pay ment of attorney's fees and other expenses of Ten thousand

425five hundred dollars ($10,500.00) incurred in pursuing the

434subject claim, and payment of past expenses, the claims of

444Petitioners (claimants) shall be deemed fully satisfied and

452extinguished.

4534. The Division of Administrative Hearings retains

460jurisdiction over this matter to resolve any dispute as to the

471interpretation of any provision of the parties' stipulation and

480to resolve any disputes, should they arise, regarding the

489parties' compliance wit h the terms of such stipulation.
