121STATEMENT OF THE ISSUE
125Whether the Petitioner should receive benefits for the
133services requested.
135PRELIMINARY STATEMENT
137On August 3, 2001, the Respondent, Department of Children
146and Family Services (Department), issued a letter notifying
154the Petitioner that his request for services could not be
164granted. The basis of the denial was the lack of monies
175available within the limits of the Department's appropriated
183general revenue funds and the prohibition against spending
191funds in excess of its appropriation. The Petitioner timely
200challenged the denial of services and the matter was referred
210to the Divisi on of Administrative Hearings for formal
219proceedings.
220At the hearing, the father testified on behalf of his
230son's interests. The Department presented testimony from
237Evelyn Alvarez and the Respondent's Exhibits 1 - 3 were received
248in evidence.
250The Transcript of these proceedings was filed on
258October 2, 2002. The Department's Proposed Recommended Order
266was filed on October 15, 2002, and has been considered in the
278preparation of this Recommended Order. The Petitioner did not
287file a proposed order.
291FINDINGS OF FACT
2941. The Petitioner is a 20 - year - old male who has been
308diagnosed with mental retardation. The Petitioner resides
315with his parents who provide for his care. Currently the
325Petitioner receives medical benefits through the father's
332health insurance. He also receives some funding through
340social security benefits.
3432. The Petitioner is a client of the Developmental
352Disabilities Program and his eligibility to receive benefits
360is not disputed by the Department. The Petitioner is eligible
370for benefits. T he Petitioner applied for, and has been
380denied, dental, companion, personal care assistance, and
387respite benefits.
3893. The Petitioner would have received the benefits
397requested but for the lack of funding in the appropriations
407for the Department.
4104. Because of the lack of funding, the Department
419prioritizes those who will receive benefits. Unfortunately,
426the Petitioner is on a waiting list for the Medicaid Waiver
437Program, and the Individual and Family Support Program does
446not have sufficient funds appro priated to pay for the services
457requested by the Petitioner.
4615. The Department may not use general revenue funds to
471fund services for persons awaiting enrollment in the Medicaid
480Waiver program.
4826. The Petitioner's parents need assistance in providing
490for the care of their son. The Petitioner must be attended
501lest he be considered "at risk." The parents have incurred
511debt to provide for their son, have pursued all avenues for
522assistance known to them, and have unselfishly tended to his
532needs. The only w ay the Petitioner may now receive additional
543benefits would be if the parents abandon their son so that he
555might be deemed "in crisis."
5607. The Petitioner did not become a client of the
570Developmental Disabilities Program until after July 1, 1999.
578CONCLUSIONS OF LAW
5818. The Division of Administrative Hearings has
588jurisdiction over the parties to and the subject matter of
598these proceedings. Section 120.57, Florida Statutes.
6049. Section 216.311(1), Florida Statutes, provides:
610(1) No agency or branch of state
617government shall contract to spend, or
623enter into any agreement to spend, any
630moneys in excess of the amount appropriated
637to such agency or branch unless
643specifically authorized by law, and any
649contract or agreement in violation of this
656chapter shall be null and void.
66210. The Department has demonstrated that there are
670insufficient funds in the general revenue appropriations to
678provide the services sought by the Petitioner. Since he is
688technically not "in crisis" the Petitioner must wait for the
698services for which he is entitled and eligible.
706RECOMMENDATION
707Based on the foregoing Findings of Fact and Conclusions
716of Law, it is RECOMMENDED that the Department of Children and
727Family Services enter a Final Order denying the benefits
736sought by the Petitioner at this time.
