99STATEMENT OF THE ISSUE
103The issue presented is whether Petitioner is entitled to be
113reimbursed for its attorney's fees incurred in the underlying
122proceeding.
123FINDINGS OF FACT
1261. On December 31, 1997, Resp ondent Department of
135Insurance issued its Notice of Intent to Issue Cease and Desist
146Order, alleging that Petitioner And Justice for All, Inc., d/b/a
156Legal Club of America, was engaged in the legal expense
166insurance business without being properly licensed , and
173Petitioner requested an evidentiary hearing regarding that
180Notice of Intent. That cause was thereafter transferred to the
190Division of Administrative Hearings and assigned DOAH Case No.
19998 - 0442.
2022. Prior to the scheduled evidentiary hearing, the par ties
212stipulated that there remained no genuine issues of material
221fact and that the controversy could be resolved based upon an
232agreed record, a joint pre - hearing stipulation, and proposed
242recommended orders. After the submission of those documents, a
251Rec ommended Order was entered on February 3, 2000, finding that
262Petitioner was not selling legal expense insurance and,
270therefore, was not subject to regulation by the Department.
2793. On May 2, 2000, the Department entered its Final Order
290modifying portions o f the Recommended Order and finding that
300Petitioner was selling legal expense insurance and was subject
309to regulation by the Department.
3144. Petitioner appealed that Final Order. On September 26,
3232001, the District Court of Appeal of Florida, First Distri ct,
334filed its Opinion finding that the Department improperly
342rejected the holdings in the Recommended Order, reversing the
351Department's Final Order, and remanding the cause for entry of
361an order consistent with its Opinion.
3675. On January 11, 2002, the Dep artment entered its Amended
378Final Order determining that Petitioner was not selling legal
387expense insurance and was not subject to regulation by the
397Department.
3986. On May 1, 2002, Petitioner filed its Motion for
408Attorney's Fees in this cause seeking an a ward for fees incurred
420in the underlying proceeding in the amount of $7,500, pursuant
431to Section 120.595(3), Florida Statutes. On May 14, 2002, the
441Department filed its Response to Motion for Attorney's Fees,
450alleging that the Department does not dispute the factual or
460legal basis for Petitioner's Motion and further alleging that
469the Department has no objection to the Motion being granted.
479CONCLUSIONS OF LAW
4827. The Division of Administrative Hearings has
489jurisdiction over the parties hereto and the subjec t matter
499hereof. Sections 120.569 and 120.57(1), Florida Statutes.
5068. The amount of attorney's fees sought by Petitioner
515appears to be reasonable.
519It is, therefore,
522ORDERED that:
5241. Petitioner's Motion for Attorney's Fees is granted.
5322. Respondent De partment of Insurance is hereby ordered to
542pay Petitioner And Justice for All, Inc., d/b/a Legal Club of
553America, the amount of $7,500 in attorney's fees.
