246STATEMENT OF THE ISSUES
250At issue is the amount and manner of payment of the
261parental award, the amount owing for attorney's fees and costs
271incurred in pursing the claim, and the amount owing for past
282expenses.
283PRELIMINARY STATEMENT
285On February 11, 2004, an Order on Compensability and Notice
295was entered in the above - styled case which resolved that the
307claim was compensable and that, with regard to the participating
317physician, the notice provis ions of the Florida Birth - Related
328Neurological Plan (Plan) were satisfied, but with regard to the
338hospital, they were not. Pertinent to this proceeding, the
347Order concluded:
349Where, as here, the administrative law judge
356determines that the infant has susta ined a
364birth - related neurological injury and that
371obstetrical services were delivered by a
377participating physician at birth, he is
383required to make a determination as to how
391much compensation, if any, should be
397awarded. § 766.31, Fla. Stat.[ 1 ] In this
406ca se, the issues of compensability and the
414amount of compensation to be awarded were
421bifurcated. Accordingly, absent agreement
425by the parties, and subject to the approval
433of the administrative law judge, a hearing
440will be necessary to resolve any disputes
447r egarding the amount and manner of payment
455of "an award to the parents or legal
463guardians of the infant," the "[r]easonable
469expenses incurred in connection with the
475filing of . . . [the] claim . . .
485including reasonable attorney's fees," and
490the amount owing for "expenses previously
496incurred." § 766.31(1), Fla. Stat.
501Consequently, it was ordered that:
506. . . the parties are accorded 30 days from
516the date of this order to resolve, subject
524to approval by the administrative law judge,
531the amount and manne r of payment of an award
541to the parents or legal guardians, the
548reasonable expenses incurred in connection
553with the filing of the claim, including
560reasonable attorney's fees, and the amount
566owing for expenses previously incurred. If
572not resolved within su ch period, the parties
580shall so advise the administrative law
586judge, and a hearing will be scheduled to
594resolve such issues. Once resolved, a final
601award will be entered consistent with
607Section 766.31, Florida Statutes.
611Here, the parties were unable to reach agreement. Therefore, a
621hearing was scheduled for June 21, 2004, to resolve the issues.
632On June 15, 2004, the parties filed their Pre - Award Hearing
644Stipulation which, together with the parties' stipulations at
652hearing, resolved the factual matters addressed in paragraph 1
661of the Findings of Fact. At hearing, Petitioner,
669Dajuanda Alexander, testified on her own behalf. No other
678witnesses were called and no exhibits were offered.
686The transcript of the hearing was filed July 8, 2004.
696Although offere d the opportunity to do so, the parties waived
707the opportunity to submit proposed orders.
713FINDINGS OF FACT
7161. Here, the parties have stipulated that Petitioner,
724Dajuanda Alexander, as the parent of Elliott L. Davis, III
734(Elliott), a minor, be awarded $10 0,000.00, to be paid in lump
747sum, as well as $10,000.00 for attorney's fees and $500.00 for
759costs incurred in connection with the filing of the claim. The
770parties have further agreed that, apart from a claim for travel -
782related expenses, discussed infra , n o monies are owing and no
793claim is made by Petitioner for past expenses.
8012. With regard to the claim for travel - related expenses,
812Petitioner seeks to recover "approximately $27,000.00," based
820upon her estimate that she incurred, on average, costs of
830$6, 000.00 per year in travel - related expenses associated with
841Elliott's medical needs, including "going to and from doctors'
850offices, various visits for neurology, eye doctor, ER visits,
859hospital to and from, prosthesis, vision therapy, Nemours
867Clinic, pulmon ary, occupational therapy, [and] physical
874therapy." (Transcript, page 8) Notably, however, not one iota
883of proof was offered to demonstrate the dates of travel, the
894distance traveled, the method of travel, the purposes of travel,
904or any other factor on w hich a conclusion could be drawn that
917the expenses claimed were reasonable in amount and were incurred
927for travel related to medically necessary care, treatment or
936other needs, as required for reimbursement under the Plan.
945§ 766.31(1)(a), Fla. Stat. Cons equently, the proof fails to
955support an award for travel - related expenses.
963CONCLUSIONS OF LAW
9663. The Division of Administrative Hearings has
973jurisdiction over the parties to, and the subject matter of,
983these proceedings. § 766.301, et seq ., Fla. Stat.
9924. Pertinent to this case, Section 766.31(1), Florida
1000Statutes, provides that where, as here, a claim for compensation
1010has been approved, "the administrative law judge shall make an
1020award providing compensation for the following items relative to
1029such injur y:"
1032(a) Actual expenses for medically
1037necessary and reasonable medical and
1042hospital, habilitative and training,
1046residential, and custodial care and service,
1052for medically necessary drugs, special
1057equipment, and facilities, and for related
1063travel . . . .
1068* * *
1071Expenses included under this paragraph shall
1077be limited to reasonable charges prevailing
1083in the same community for similar treatment
1090of injured persons when such treatment is
1097paid for by the injured person.
1103(b) Periodic payments of an award to the
1111parents or legal guardians of the infant
1118found to have sustained a birth - related
1126neurological injury, which award shall not
1132exceed $100,000. However, at the discretion
1139of the administrative law judge, such award
1146may be made in a lump sum.
1153(c) Rea sonable expenses incurred in
1159connection with the filing of a claim under
1167ss. 766.301 - 766.316, including reasonable
1173attorney's fees, which shall be subject to
1180the approval and award of the administrative
1187law judge. In determining an award for
1194attorney's fe es, the administrative law
1200judge shall consider the following factors:
12061. The time and labor required, the
1213novelty and difficulty of the questions
1219involved, and the skill requisite to perform
1226the legal services properly.
12302. The fee customarily char ged in the
1238locality for similar legal services.
12433. The time limitations imposed by the
1250claimant or the circumstances.
12544. The nature and length of the
1261professional relationship with the claimant.
12665. The experience, reputation, and
1271ability of the la wyer or lawyers performing
1279services.
12806. The contingency or certainty of a fee.
12885. Here, the parties agreed that Petitioner,
1295Dajuanda Alexander, as the parent of Elliott L. Davis, III, a
1306minor, be awarded $100,000.00, to be paid in lump sum, as well
1319as $10,000.00 for attorney's fees and $500.00 for costs incurred
1330in pursing the claim. The parties' agreement, being reasonable
1339in nature and amount is approved; however, Petitioner's claim
1348for travel - related expenses must, for reasons appearing in the
1359Find ings of Fact, be denied.
1365CONCLUSION
1366Based on the foregoing Findings of Fact and Conclusions of
1376Law, it is
1379ORDERED that the following benefits are awarded:
13861. Petitioner, Dajuanda Alexander, as the parent of
1394Elliott L. Davis, III, a minor, is awarded $100 ,000.00, to be
1406paid in lump sum.
14102. Petitioner, Dajuanda Alexander, as the parent of
1418Elliott L. Davis, III, a minor, is also awarded $10,000.00 for
1430attorney's fees and $500.00 for costs incurred in connection
1439with the filing of the claim.
14453. Petitioner's claim for past expenses is denied.
