134PRELIMINARY STATEMENT

136Petitioner Edna Shepherd is a member of the Florida

145Retirement System a nd applied for disability retirement benefits

154in September 2001. The Division of Retirement (Division), after

163several attempts to have Ms. Shepherd submit all the documents

173necessary to process her application, dismissed her claim by

182final agency action l etter on March 25, 2002. Ms. Shepherd

193timely requested a hearing, which is the subject of this

203Recommended Order .

206In addition to Petitioner's testifying in her own behalf,

215she presented five exhibits, which were admitted. Mark Sadler,

224Administrator for the Disability Section of the Division of

233Retirement testified for the Division, and, in addition, the

242Division submitted six exhibits, which were accepted into

250evidence. The Division requested and was granted official

258recognition of Chapter 60S - 4.0035, F lorida Administrative Code ,

268and the rules of the Division of Retirement.

276Respondent submitted a Proposed Recommended Order which was

284read and considered.

287FINDINGS OF FACT

2901. Petitioner Edna Shepherd is a member of the Florida

300Retirement System.

3022. I n September 2001, Ms. Shepherd submitted an

311application for disability retirement benefits to the Division

319of Retirement.

3213. The application was not complete and several documents

330were needed to process the application.

3364. By letter dated September 27, 2001, the Division wrote

346Ms. Shepherd acknowledging receipt of the disability application

354and requesting additional information. Enclosed with the letter

362were two blank FR - 13b forms (Physician's Statement Forms), which

373were necessary to complete the appl ication.

3805. Petitioner did not respond to the September 27, 2001,

390letter, so the Division mailed another request on October 29,

4002001. Again two blank FR - 13bs were included with the letter.

4126. On November 29, 2001, the Division mailed a third

422request for information to Petitioner. Blank forms were also

431included with this letter.

4357. By letter dated January 3, 2002, the Division mailed a

446fourth request to Ms. Shepherd again requesting information

454necessary to complete her application for disability retire ment

463benefits.

4648. After the Division did not receive a response to its

475previous letters mailed to Petitioner, it sent a letter dated

485February 4, 2002, by certified mail to Ms. Shepherd advising her

496that she had 21 days from the date of the letter to sub mit the

511necessary information or her application would be cancelled.

5199. Finally, after more than six months since submission of

529her application, the Division sent a letter dated March 25,

5392002, by certified mail to Ms. Shepherd notifying her that her

550disa bility application was cancelled and giving her 21 days to

561request a hearing. She did receive this letter and this timely

572appeal followed.

57410. Petitioner's attorney made two submissions to the

582Division dated September 14, 2001, and February 22, 2002;

591how ever, they did not contain the requested physician

600statements.

60111. As of the hearing, the requested physician statements

610still had not been supplied to the Division.

61812. The applicant is responsible for ensuring the Division

627receives the information nece ssary to process an application for

637disability retirement benefits.

640CONCLUSIONS OF LAW

64313. The Division of Administrative Hearings has

650jurisdiction over the subject matter and parties in this case.

66014. The Florida Retirement System was created by the

669Leg islature in 1970 and is codified in Chapter 121, Florida

680Statutes (2001).

68215. Rule 60S - 4.0035(4), Florida Administrative Code ,

"690Retirement Application and Effective Retirement Date" provides:

697When a member's application for retirement

703benefits is received , the Division will:

709(a) Acknowledge the receipt of the member's

716application and advise him of any required

723information or documents that have not yet

730been received. Such information may

735include, but is not limited to, birthdate

742verification, beneficiar y designation,

746option selection as required by Rule 60S -

7544.010, F.A.C., spousal acknowledgement if

759option 1 or 2 is selected as required by

768subsection 60S - 4.010(9), F.A.C., any

774payments due the member's account for

780purchase of additional service credit or a

787written statement from the member that the

794member does not wish to claim such service

802credit, and final certification of earnings.

808(b) Establish the effective retirement date

814as provided in paragraph 60S - 4.0035(3)(a),

821F.A.C., for normal or early retirem ent, or

829as provided in paragraph 60S - 4.0035(3)(b),

836F.A.C., for disability retirement.

840(c) Send follow - up notices, reminding the

848member of any required information or

854documents that have not yet been received.

861(d) If all the required information or

868documents have not been received by the

875Division after 3 follow - up notices have been

884sent to the member, a certified letter will

892be sent advising the member he has 21 days

901to provide such information or documents

907without loss of benefits.

911(e) If all th e required information or

919documents have not been received by the

926Division after the 21 days specified in the

934certified letter, a final agency action

940letter will be sent to the member advising

948the member that his application is cancelled

955and he must reappl y to receive benefits,

963with a new retirement date established upon

970application.

97116. The Division in September 2001, received

978Ms. Shepherd's initial application for disability benefits. The

986Division mailed more than three follow - up n otices to

997Ms. Shepherd requesting additional information. Despite the

1004numerous letters that were sent to her, neither Ms. Shepherd nor

1015her attorney supplied the requested information.

102117. Ms. Shepherd was notified that if she failed to submit

1032the r equired information, her application would be cancelled.

1041She was given a final agency action letter and she still did not

1054supply the requested statements.

105818. Petitioner has the burden of providing sufficient

1066evidence to support her case. The burde n of proof in an

1078administrative proceeding is on the party asserting the

1086affirmative of the issue unless the burden is otherwise

1095established by statute. Florida Department of Transportation v

1103J.W.C. Co., Inc. , 396 So. 2d 778 (Fla. 1 DCA 1981); Balino v.

1116D epartment of Health and Rehabilitative Services , 348 So. 2d 349

1127(Fla. 1 DCA 1977). Petitioner must demonstrate by a

1136preponderance of the evidence that she is entitled to the agency

1147action she proposes, that is, the reinstatement of her

1156disability retireme nt application. Ms. Shepherd received more

1164than three notices requesting she complete her application. She

1173failed to act, so the Division, in accord with its rule,

1184cancelled her application. No evidence was introduced by the

1193Petitioner to support her re quest of the Division to rescind the

1205cancellation.

120619. Based upon a lack of record evidence, there is no

1217basis for the Division of Retirement to grant Ms. Shepherd's

1227request to reinstate her disability retirement application.

1234However, this decision is not a bar to re - application.

1245RECOMMENDATION

1246Based upon the foregoing findings of fact and conclusions

1255of law, it is

1259RECOMMENDED:

1260That the Division of Retirement issue a Final Order denying

1270the request of Petitioner Edna M. Shepherd to reinstate her

1280disabi lity retirement application.
