114STATEMENT OF THE ISSUE
118Whether the Petitioner should receive general revenue funds
126allocated to the Department of Children and Family Services.
135PRELIMINARY STATEMEN T
138By letter dated May 24, 2002, the Department of Children
148and Family Services (Department) notified the Petitioner,
155Bridget Ellingham, that her request for residential placement
163funding had been denied. The basis of the denial was stated to
175be the Depart ment's inability to commit funds in excess of its
187appropriation. In essence, the Department claimed it did not
196have funds available within its budget to provide the service
206requested by the Petitioner. The Petitioner, by and through her
216mother, challenge d the denial and timely sought an
225administrative review of the decision.
230The case was then forwarded to the Division of
239Administrative Hearings for formal proceedings and assigned DOAH
247Case No. 02 - 2673. A Notice of Hearing was entered and the
260matter was p romptly scheduled for hearing. Although continued
269by stipulation and consent of counsel, the case was ultimately
279heard on November 21, 2002.
284At the hearing, the Petitioner's mother, Tammy Desjardins,
292testified for the Petitioner. Petitioners Exhibit 1 w as
301received in evidence. The Respondent offered testimony from
309Stephen Stoltz. The Department's Exhibits 1 - 5 were admitted
319into evidence. All requests for official recognition were
327granted. The parties have outlined the pertinent provisions of
336Florida law and case precedent in their Proposed Recommended
345Orders. The Proposed Recommended Orders have been fully
353considered in the preparation of this order. The transcript of
363the proceedings was not filed.
368FINDINGS OF FACT
3711. The Petitioner is an 18 year - old female who is eligible
384for services as an individual with mental retardation. The
393Department (or its predecessor) first provided benefits to the
402Petitioner in 1985 based upon such eligibility (Downs Syndrome).
4112. Although an applicant for services i n the Departments
421District 15, the Petitioner currently attends a residential
429placement in Miami, Florida. From the undisputed evidence,
437Petitioner is performing well in her placement and is learning
447life skills. Petitioner exhibits child - like behaviors , however,
456and is dependent on adult supervision for her well being.
4663. The Petitioner is a client of the Departments
475Developmental Disabilities Program and would have received the
483benefits requested in this cause but for the lack of funds. It
495is the De partments position that the appropriations allocated
504to the Department by the Legislature did not provide sufficient
514funds to meet the Petitioners claim and that it would be
525unlawful for the Department to exceed its appropriated budget.
5344. Because the D epartment does not have funds for all of
546the eligible recipients (clients), the Department prioritizes
553the claims and places clients whose benefits are not provided on
564a waiting list. In fact, the Petitioner is on the Medicaid
575Waiver Program waiting list for the services sought.
5835. The Petitioners mother has provided for her daughter
592and incurred debt to do so. She must have financial assistance
603in order to keep the Petitioner at the school where she is doing
616well.
6176. The Department provides assistan ce for persons like
626Petitioner only when they are deemed to be in crisis. The
637Department maintains that the Petitioner does not currently meet
646its definition for crisis intervention.
6517. The Petitioners services from the Developmental
658Disabilities Program were canceled without notice to the
666Petitioner in 1988.
6698. The Petitioner timely sought benefits in 1998 or 1999
679and would be receiving the benefits now sought had the
689Department properly processed the application through the
696correct program.
6989. The Department appropriates funds through its district
706offices. In this case, District 15 (where the Petitioners
715mother resides) does not have funds available to meet the
725Petitioners claim. Whether statewide funds are unavailable is
733unknown.
73410. Wer e the Petitioners mother to abandon the
743Petitioner, it is unlikely the Petitioner could provide for her
753own needs; she would be in crisis.
760CONCLUSIONS OF LAW
76311. The Division of Administrative Hearings has
770jurisdiction over the parties to and the subje ct matter of these
782proceedings. Section 120.57, Florida Statutes.
78712. Section 216.311, Florida Statutes, prohibits the
794Department from spending money in excess of the amount
803appropriated to it. Nevertheless, while District 15 may not
812have the funds avai lable to commit for the Petitioners request,
823no evidence was presented as to the Departments inability to
833fund the service sought.
83713. The Petitioner has demonstrated she is eligible,
845entitled to benefits, and in dire need. Had the Department
855properly processed her request for benefits the Petitioner would
864be receiving assistance. Additionally, had the Department
871provided the Petitioner with a point of entry to challenge her
882withdrawal from the program she might have already received
891assistance.
89214. I t is therefore concluded that the Petitioner has
902demonstrated that she is in critical need of assistance. The
912Department has not established that there are no funds to meet
923the Petitioners claim. While District 15 may not have funds,
933had the Department properly processed the Petitioners
940application the Department could have provided for the
948Petitioners need.
950RECOMMENDATION
951Based on the foregoing Findings of Fact and Conclusions of
961Law, it is RECOMMENDED that the Department of Children and
971Family Servic es enter a final order granting Petitioners
980request for services.
