91This cause came on to be heard pursuant to Section 766.304,
102Florida Statutes, upon the S tipulation and J oint P etition of the
115parties, the original of which was filed January 8, 2003, for
126the entry of an order approv ing the resolution of a formal claim
139for compensation benefits heretofore filed in this cause in
148accordance with the provisions of Chapter 766, Florida Statutes,
157and a resolution of the exclusive remedy otherwise available as
167outlined in Chapter 766, Flori da Statutes.
174By the terms of their S tipulation, the parties have agreed
185that Petitioners, Agustin Ysabel and Jacqueline Ysabel, are the
194parents and natural guardians of Jeremias Ysabel (Jeremias), a
203minor; that Jeremias was born a live infant on Septembe r 20,
2151997, at Columbia Medical Center, d/b/a Osceola Regional
223Hospital, a hospital located in Kissimmee, Florida; and that his
233birth weight was in excess of 2,500 grams. The parties have
245further agreed that the physician delivering obstetrical
252services d uring the birth of Jeremias was Munira Zafar, M.D.
263who, at all times material hereto, was a participating physician
273in the Florida Birth - Related Neurological Injury Compensation
282Plan, as defined by Section 766.302(7), Florida Statutes.
290Finally, by their s tipulation, the parties have agreed that
300Jeremias suffered a "birth - related neurological injury," as that
310term is defined by Section 766.302(2), Florida Statutes.
318After due consideration of the interests of all parties,
327and being otherwise fully advised in the premises, it is
337ORDERED that:
3391. The S tipulation of the parties, filed of record
349January 8, 2003, is hereby approved, and the parties are
359directed to comply with the provisions thereof.
3662. The Petitioners, Agustin Ysabel and Jacqueline Ysabel,
374are t he parents and natural guardians of Jeremias Ysabel, a
385minor, are accorded an award of One hundred thousand dollars
395($100,000.00), pursuant to Section 766.31(1)(b), Florida
402Statutes, to be disbursed in accordance with the terms of the
413parties' Stipulation.
4153. Upon payment of the award of One hundred thousand
425dollars ($100,000.00) to the parents (claimants), attorney's
433fees and other expenses of Eleven thousand five hundred dollars
443($11,500.00) incurred in pursuing the subject claim, and payment
453of past exp enses, the claims of Petitioners (claimants) shall be
464deemed fully satisfied and extinguished, except to the extent of
474Respondent's continuing obligation under the provisions of
481Section 766.31, Florida Statutes, to pay future expenses as
490incurred.
4914. The Division of Administrative Hearings retains
498jurisdiction over this matter to resolve any dispute as to the
509interpretation of any provision of the parties' S tipulation and
519to resolve any disputes, should they arise, regarding the
528parties' compliance with th e terms of such S tipulation.
