112STATEMENT OF THE ISSUE
116The issue is whether Respondent Southern Hay Sales Inc.,
125(Southern Hay) and its surety, Respondent Old Republic Surety
134Company (Old Republic), are liable for funds due to Petitioner
144from the sale of agricultural prod ucts.
151PRELIMINARY STATEMENT
153On or about June 6, 2002, Petitioner filed a complaint with
164the Florida Department of Agriculture and Consumer Services
172(Department). The complaint alleged that Southern Hay or its
181surety, Old Republic, owed funds to Petitione r for hay purchased
192by Southern Hay under the provisions of the Agricultural Bond
202and License Law, Sections 604.15 through 604.34, Florida
210Statutes.
211Southern Hay filed an answer on or about June 24, 2002.
222The answer denied the factual allegations of th e complaint.
232On July 19, 2002, the Department referred this matter to
242the Division of Administrative Hearings (DOAH). The case was
251transferred to Judge Don W. Davis on October 7, 2002. A Notice
263of Hearing issued scheduling the case for formal hearing on
273October 8, 2002.
276At the hearing, Petitioner presented the testimony of two
285witnesses. Southern Hay presented the testimony of two
293witnesses and two exhibits. Old Republic made no appearance.
302A transcript of the hearing procedure was not filed with
312D OAH. Southern Hay and Petitioner filed Proposed Findings of
322Fact and Conclusions of Law which have been considered in the
333preparation of this Recommended Order.
338FINDINGS OF FACT
3411. Petitioner is a producer of agricultural products as
350defined by Section 604.15(5), Florida Statutes. Petitioner
357produces hay on a farm owned by Petitioner near Jasper, Florida.
3682. Respondent Southern Hay is a dealer in agricultural
377products as defined by Section 604.15(1), Florida Statutes.
3853. Hay is a natural product o f a farm and, therefore, an
398agricultural product as defined in Section 604.15(3), Florida
406Statutes.
4074. Old Republic is Southern Hay's surety.
4145. Both Petitioner and Southern Hay have participated in a
424business arrangement since at least 1997, whereby P etitioner
433grew and sold to Southern Hay varying quantities of hay.
443Petitioner would cut, process, and then store the hay in
453trailers provided by Southern Hay. Petitioner would deem
461Southern Hay to be indebted for a load of hay when a trailer of
475hay was h auled away by Southern Hay personnel.
4846. On January 16, 2002, Petitioner received a signed check
494from Southern Hay. While there is a dispute as to who filled
506out the check, resolution of that question is not relevant for
517purposes of this matter. Suff ice it to say that Southern Hay's
529check number 1183 was written in the amount of $2,596.45 and
541dated January 16, 2002. Delivery of the check to Petitioner
551satisfied all outstanding invoices for payment where hay had
560been picked up, with the exception of P etitioner's invoice
570number 302 documenting an obligation to Petitioner from Southern
579Hay in the amount of $1,241.95 for hay. Southern Hay's
590representative maintained at final hearing that an additional
598check was issued on February 15, 2002, which included payment
608for invoice number 302. No cancelled check was presented to
618corroborate the testimony of Southern Hay's representative and
626such omission, coupled with the general demeanor of the
635representative, prevents the testimony of the representative,
642Andre w Snider, from being credited in this regard.
6517. Southern Hay and its surety, Old Republic, currently
660owes Petitioner for an unpaid invoice in the amount of
670$1,241.95.
672CONCLUSIONS OF LAW
6758. The Division of Administrative Hearings has
682jurisdiction ov er this subject matter and the parties to this
693action pursuant to Sections 120.569, 120.57(1), and 604.21(6),
701Florida Statutes.
7039. Section 604.15, Florida Statutes, contains the
710following definitions in pertinent part:
715(1) 'Dealer in agricultural prod ucts' means
722any person, whether itinerant or domiciled
728within this state, engaged within this state
735in the business of purchasing, receiving, or
742soliciting agricultural products from the
747producer or her or his agent or
754representative for resale or processi ng for
761sale; acting as an agent for such producer
769in the sale of agricultural products for the
777account of the producer on a net return
785basis; or acting as a negotiating broker
792between the producer or her or his agent or
801representative and the buyer.

808(3) 'Agricultural products' means the
813natural products of the farm, nursery,
819grove, orchard, vineyard, garden, and apiary
825(raw or manufactured); . . .
831* * *
834(5) 'Producer' means any producer of
840agricultural products produced in the state.
8461 0. Section 604.17, Florida Statutes, requires dealers in
855agricultural products to have a license to engage in such
865business.
86611. Before dealers receive their licenses, they must
874deliver to the Department a surety bond or a certificate of
885deposit. The s urety bond or certificate of deposit secures
895payment to producers for agricultural products sold to dealers.
904Section 604.20(1), Florida Statutes.
90812. Petitioner has met its burden of proving, by a
918preponderance of the evidence, that Respondents are ind ebted to
928Petitioner for unpaid invoices in the amount of $1,241.95.
938RECOMMENDATION
939Based upon the findings of fact and conclusions of law,
949it is
951RECOMMENDED:
952That the Florida Department of Agriculture and Consumer
960Services enter a final order re quiring Respondent Southern Hay
970Sales, Inc., or its surety, Respondent Old Republic Surety
979Company, to pay Petitioner for an unpaid invoice in the amount
990of $1,241.95.
