107STATEMENT OF THE ISSUE

111Whether Petitioner is entitled to a passing grade on the

121practical portion of the Florida Minimum Standards Examination

129for firefighters taken May 22, 2 002.

136PRELIMINARY STATEMENT

138When Petitioner applied for re - certification as a

147firefighter in November 2001, his existing certification was

155scheduled to expire May 22, 2002. Because he had not been

166active as a firefighter for the past three years, Petiti oner was

178required to sit for and pass the four - section practical portion

190of the Florida Minimum Standards Examination (the practical

198examination) to maintain his certification.

203Petitioner sat for and failed all four sections of the

213practical examination administered December 5, 2001. Petitioner

220was permitted by rule to re - take the practical examination,

231which by happenstance was scheduled for May 22, 2002, the date

242his certification was to expire. Petitioner re - took the

252practical examination on May 22, 2002. Thereafter Respondent

260notified Petitioner that he had failed two sections of the

270examination, that his application for re - certification was

279denied, and that he would have to complete additional training

289before being permitted to re - apply for certifi cation.

299Petitioner thereafter requested a formal administrative

305hearing to challenge the scoring of the examination he took on

316May 22, 2002, the matter was referred to the Division of

327Administrative Hearings, and this proceeding followed.

333At the fina l hearing, Respondent presented its case first

343to expedite the proceeding. Respondent presented the testimony

351of Larry McCall and Ralph Chase, Jr., both of whom are field

363representatives with the State Fire Marshal's Bureau of Fire

372Standards and Training. Field representatives, including

378Mr. McCall and Mr. Chase, were responsible for administering and

388grading the practical examinations Petitioner took on

395December 5, 2001, and May 22, 2002. Respondent offered seven

405exhibits, each of which was accepted int o evidence. Petitioner

415presented no testimony and no exhibits.

421The transcript of the final hearing was filed on

430December 4, 2002. Respondent's Proposed Recommended Order,

437filed December 23, 2002, has been considered by the undersigned

447in the preparatio n of this Recommended Order. Petitioner did

457not file a proposed recommended order.

463FINDINGS OF FACT

4661. At times pertinent to this proceeding, Petitioner held

475certification as a firefighter (Firefighter Certificate of

482Completion #81191) issued by the St ate Fire Marshal. For at

493least three years prior to December 5, 2001, Petitioner had not

504been active as a firefighter or as a volunteer firefighter with

515an organized fire department. Pursuant to Section 633.352,

523Florida Statutes, Petitioner was required to successfully

530complete the practical portion of the Florida Minimum Standards

539Examination for firefighters to retain his certification. 1/

5472. The practical examinations at issue in this proceeding

556consisted of four sections: the Self Contained Breath ing

565Apparatus (SCBA) section, the Hose and Nozzle Operation section,

574the Ladder Operation section, and the Fireground Skills section.

583A candidate must pass each section to pass the practical

593examination.

5943. On November 16, 2001, Petitioner applied to s it for the

606practical examination scheduled for December 5, 2001.

613Petitioner sat for and failed all four sections of the practical

624examination administered December 5. Respondent's Rule 4A -

63237.0527(6), Florida Administrative Code, permits a candidate to

640re take the practical examination once without further training.

649Petitioner thereafter applied to retake the examination, which

657was scheduled for May 22, 2002.

6634. Petitioner passed the Hose and Nozzle Operation and the

673Ladder Operation sections of the pra ctical examination on

682May 22, and the scoring on those sections are not at issue in

695this proceeding. At issue in this proceeding is whether

704Petitioner failed the SCBA section and/or the Fireground Skills

713section of the practical examination administered M ay 22, 2002.

7235. The SCBA section of the practical examination consisted

732of questions for which a candidate was awarded credit and

742certain items that a candidate was required to successfully

751complete (fatal items). If a candidate missed a fatal item, th e

763candidate failed the SCBA section of the examination and,

772consequently, the entire practical examination.

7776. The Firegrounds Skills section of the examination tests

786a candidate on a variety of skills a firefighter is expected to

798demonstrate while figh ting a fire, and the candidate is awarded

809a score for his or her performance.

8167. To pass each part of the practical examination,

825including the SCBA and the Fireground Skills sections, a

834candidate must achieve a score of 70 points and must not miss a

847fat al item.

8508. The SCBA section of the practical examination requires

859the candidate to properly don certain protective gear in 1

869minute and 45 seconds. The failure to complete the exercise in

880the allotted time is a fatal item. In addition, the candidate

891must activate and check a personal alarm system as part of the

903exercise. The failure of the candidate to properly wear and

913activate the alarm system is also a fatal item.

9229. The greater weight of the credible evidence established

931that Petitioner's per formance on the SCBA section of the

941practical examination was appropriately and fairly graded.

948Petitioner failed to timely complete the exercise, which is a

958fatal item. Petitioner failed to properly activate the personal

967alarm system, which is also a fat al item. Petitioner was

978awarded no points for 5 of 10 items for which points could be

991awarded (each item was worth 10 points). Even if he had passed

1003the fatal items noted above, Petitioner would have failed the

1013SCBA section because he failed to achieve a passing score of 70

1025on that section of the examination. Petitioner failed to

1034establish that he was entitled to additional credit for the SCBA

1045section of the practical examination.

105010. Petitioner received a failing score on the Firegrounds

1059Skills secti on of the practical examination administered May 22,

10692002. The greater weight of the credible evidence established

1078that Petitioner's performance on the Firegrounds Skills section

1086of the practical examination administered May 22, 2002, was

1095appropriately an d fairly graded. Of the 100 points available

1105for this section of the examination, Respondent established that

1114Petitioner deserved no credit for the following: 20 points on

1124the forcible entry part of the section; 12 points on the ladders

1136and fire service tools part of the section; and 4 points on the

1149hazardous materials part of the section. Consequently,

1156Respondent established that Petitioner was entitled to a total

1165of 64 points on the Firegrounds Skills section of the practical

1176examination administered M ay 22 2002, which is a failing grade.

1187Petitioner failed to establish that he was entitled to

1196additional credit for the Firegrounds Skills section of the

1205practical examination administered May 22, 2002.

121111. Respondent established that the administratio n and

1219grading of the subject exams were consistent with the provisions

1229of Chapter 4A - 37, Florida Administrative Code, which set forth

1240by rule applicable guidelines for the practical examination.

1248CONCLUSIONS OF LAW

125112. The Division of Administrative Hear ings has

1259jurisdiction over the parties hereto and the subject matter

1268hereof pursuant to Chapter 120, Florida Statutes.

127513. Petitioner has the burden of proving by a

1284preponderance of the evidence that he is entitled to passing

1294grades on all sections of the practical examination. See Harac

1304v. Department of Professional Regulation , 484 So. 2d 1333 (Fla.

13143d DCA 1986); State ex rel. I. H. Topp v. Board of Electrical

1327Contractors for Jacksonville Beach, Florida , 101 So. 2d 583

1336(Fla. 1st DCA 1958); and State e x rel. Glaser v. J. M. Pepper ,

1350155 So. 2d 383 (Fla. 1st DCA 1963). Petitioner did not meet

1362that burden in this proceeding.

1367RECOMMENDATION

1368Based upon the foregoing Findings of Fact and Conclusions

1377of Law, it is RECOMMENDED that Petitioner enter a final order

1388adopting the Findings of Facts and Conclusions of Law set forth

1399herein. It is further RECOMMENDED that the final order deny

1409Petitioner's application for re - certification as a firefighter.
