116Whether Petitioner, Clarence Goosby, suffered racial
122discriminatio n when he was terminated from employment for

132PRELIMINARY STATEMENT
134On June 27, 2001, Petitioner filed an Amended Charge of
144Discrimination with the Florida Commission on Human Relations.
152On September 10, 2002, the Florida Commission on Human Rela tions
163advised Petitioner of its Determination: No Cause. On October 7,
1732002, Petitioner filed his Petition for Relief.
180On October 15, 2002, the Division of Administrative Hearings
189received a Transmittal of Petition for Relief. On October 16,
1992002, an Ini tial Order was forwarded to both parties. On
210October 28, 2002, a hearing was scheduled for December 2 and 3,
2222002, in Orlando, Florida. On November 18, 2002, a continuance
232was granted on the joint motion of the parties.
241On December 10, 2002, the case wa s rescheduled for
251February 3 and 4, 2003. On January 30, 2003, the case was
263continued as a result of Respondent's Motion for Summary Final
273Order. On February 28, 2003, the case was rescheduled for
283April 28 and 29, 2003.
288The case was heard as reschedule d on April 28, 2003. At the
301hearing, Petitioner testified in his own behalf, presented three
310witnesses, and offered five exhibits, which were received into
319evidence and marked Petitioner's Exhibits 1 through 5.
327Respondent presented five witnesses and offe red 39 exhibits,
336which were received into evidence and marked Respondent's
344Exhibits 1 through 39. On May 28, 2003, an Unopposed Motion for
356Enlargement of Time for filing proposed recommended orders was
365granted enlarging the filing time to June 30, 2003. Both parties
376filed Proposed Recommended Orders.
380FINDINGS OF FACT
383Based on the oral and documentary evidence presented at the
393final hearing, the following findings of fact are made:
4021. Petitioner, Clarence Goosby, is an African - American, who
412was employed b y Respondent from October 13, 1999, until he was
424terminated on February 17, 2000.
4292. Respondent, Florida Extruders International, Inc., a
436manufacturing company located in Sanford, Florida, employs
443approximately 500 employees and is an "employer" as define d in
454Subsection 760.02(7), Florida Statutes.
4583. Some of the manufacturing activities at Respondent's
466plant are dangerous. One of these activities, melting aluminum
475scrap, takes place in the Cast House, which is noted as a
"487restricted area." Workers in t he Cast House wear fire -
498protective clothing.
5004. On February 17, 2000, an African - American employee,
510Broderick Demps ("Demps"), was noticed in the Cast House where he
523had gone to use the restroom. A Caucasian supervisor, William
533Wilson ("Wilson"), questio ned Demps regarding his presence in a
545restricted area and was advised by Demps that his supervisor had
556given him permission to use the restroom.
5635. Demps exited the Cast House and was followed by Wilson
574to another building, the Warehouse, Demps' workstati on. Wilson
583met another supervisor, Frank Witherspoon ("Witherspoon"), as he
593entered the Warehouse.
5966. Wilson and Witherspoon located Demps' supervisor, Warren
604Lawrence ("Lawrence"), who advised that he had not given Demps
616permission to enter the Cast Hou se.
6237. At this point, Demps began yelling at Wilson; his
633language was obscene and racial. The other supervisors tried,
642without success, to control Demps.
6478. Petitioner, hearing the altercation, left his work area
656in the same building, and recognized Dem ps (who he referred to as
669his "God - brother"), who continued yelling obscenities at Wilson.
680Petitioner's supervisor, Kenneth McKinney ("McKinney"), told
688Petitioner to return to his work area. Petitioner ignored
697McKinney's directive.
6999. Petitioner approac hed Wilson and the other supervisors
708and began yelling obscenities and racial slurs at Wilson. While
718standing in close proximity to Wilson and shouting at him,
728Petitioner made a quick move with his hand and arm.
73810. Wilson, believing that Petitioner was attempting to
746strike him, responded by striking Petitioner. Demps then struck
755Wilson in the head, knocking him to the floor.
76411. Both Petitioner and Demps jumped onto Wilson, striking
773and kicking him. Witherspoon, McKinney, and Lawrence physically
781pulle d Petitioner and Demps off Wilson. Petitioner and Demps
791continued yelling obscenities and racial slurs at Wilson as they
801were being removed from the Warehouse.
80712. Petitioner officiously injected himself into a volatile
815situation involving Demps and his supervisors. By his
823confrontational conduct, Petitioner precipitated a physical
829altercation among himself, Wilson, and Demps.
83513. Witherspoon contacted Dana Lehman ("Lehman"),
843operations manager and highest - level executive at Respondent's
852plant, by radio and advised him of the altercation.
86114. Lehman immediately went to the Warehouse, where a crowd
871of employees had gathered in addition to the individuals
880mentioned hereinabove.
88215. Lehman inquired of several employees regarding the
890altercation but no one reported having seen it. Lehman attempted
900to speak to Petitioner and Demps about the incident. Petitioner
910and Demps were confrontational; Lehman obtained no relevant
918information from them.
92116. Lehman questioned McKinney, Lawrence, and Witherspoon
928and r eceived their reports regarding the incident, which are
938detailed hereinabove. Wilson confirmed the descriptions and
945observations of the three supervisors/witnesses.
95017. McKinney, Petitioner's supervisor, recommended to
956Lehman that Petitioner be terminate d for unauthorized leaving of
966his work area and instigating a fight with a supervisor.
97618. Respondent had in the past terminated several employees
985of different ethnicities for fighting.
99019. Respondent's employees' handbook ( Policies and
997Procedures Handb ook ) reads, in pertinent part, as follows:
1007Conduct Meriting Immediate Discharge
1011Certain actions are such serious breaches of
1018responsibilities to the company that no prior
1025warnings or probation notices are required
1031and may result in immediate discharge. F or
1039example:
1040* * *
1043Fighting or hitting another employee, or
1049similar disorderly conduct, during work hours
1055or on company premises.
1059Willful disobedience (insubordination)
106220. Petitioner was aware of Respondent's prohibition
1069against fighting and i nsubordination.
107421. Lehman discharged Petitioner on the day of the incident
1084for fighting and insubordination.
1088CONCLUSIONS OF LAW
109122. The Division of Administrative Hearings has
1098jurisdiction of the subject matter of and the parties to this
1109proceeding. Su bsection 120.57(1), Florida Statutes.
111523. Subsection 760.10(1)(a), Florida Statutes, provides
1121that it is an unlawful employment practice for an employer:
1131(1)(a) To discharge or to fail or refuse
1139to hire any individual, or otherwise to
1146discriminate agai nst any individual with
1152respect to compensation, terms, conditions,
1157or privileges of employment because of such
1164individual's race, color, religion, sex,
1169national origin, age, handicap, or marital
1175status.
117624. Florida courts have determined that federal
1183di scrimination law should be used as guidance when construing
1193provisions of Section 760.10, Florida Statutes. Harper v.
1201Blockbuster Entertainment Corp. , 139 F.3d 1385 (11th Cir. 1998);
1210Florida Department of Community Affairs v. Bryant , 586 So. 2d
12201205 (Fla. 1st DCA 1991).
122525. The United States Supreme Court established, in
1233McDonnell - Douglas Corporation v. Green , 411 U.S. 792 (1973) and
1244Texas Department of Community Affairs v. Burdine , 450 U.S. 248
1254(1981), the analysis to be used in cases alleging discrimina tion
1265under Title VII, which is persuasive in the instant case, as
1276reiterated and refined in the case of St. Mary's Honor Center v.
1288Hicks , 509 U.S. 502 (1993).
129326. This analysis illustrates that a petitioner has the
1302burden of establishing, by a preponderan ce of evidence, a prima
1313facie case of discrimination. If that prima facie case is
1323established, the respondent must articulate a legitimate, non -
1332discriminatory reason for the action taken. The burden then
1341shifts back to the petitioner to go forward with e vidence to
1353demonstrate that the offered reason is merely a pretext for
1363unlawful discrimination. The Supreme Court stated in Hicks ,
1371before finding discrimination in that case, that:
1378[T]he fact finder must believe the
1384plaintiff's explanation of intentional
1388discrimination.
1389509 U.S. at 519.
139327. In the Hicks case, the Court stressed that even if the
1405fact finder does not believe the proffered reason given by the
1416employer, the burden still remains with the petitioner to
1425demonstrate a discriminatory motive for t he adverse employment
1434action taken.
143628. To establish a prima facie case of discrimination,
1445Petitioner must show that: he is a member of a protected class;
1457he suffered an adverse employment action; he received disparate
1466treatment from other similarly situ ated individuals in a non -
1477protected class; and that there is sufficient evidence of bias
1487to infer a causal connection between his race and the disparate
1498treatment. McDonnell - Douglas Corporation v. Green , 411 U.S. 792
1508(1973); Canino v. U.S. E.E.O.C. , 707 F .2d 468, (11th Cir. 1983);
1520Andrade v. Morse Operations, Inc ., 946 F.Supp. 979 (M.D. Fla.
15311996) .
153329. Petitioner has demonstrated that he is member of a
1543protected class and suffered an adverse employment action; he
1552has failed to demonstrate that he was the victim of dissimilar
1563treatment from an individual in a non - protected class or that
1575there was any relationship between his race and his discharge.
1585Petitioner failed to demonstrate that Wilson, the Caucasian
1593supervisor, who was involved in the physical alte rcation, was a
1604similarly situated employee. Wilson was a supervisor and, more
1613importantly, he was doing his job when Petitioner unnecessarily
1622involved himself in a volatile situation causing a fight. The
1632evidence revealed that Wilson's conduct was approp riate given
1641Petitioner's aggressive onslaught. Silvera v. Orange County
1648School Board , 244 F.3d 1253, 1259 (11th Cir. 2001).
165730. Petitioner's officious conduct raised the level of a
1666verbal confrontation to a physical altercation. His conduct
1674clearly viol ated reasonable, published employee regulations. No
1682credible evidence was presented that his discharge from
1690employment was because of his race. Petitioner's conclusory
1698allegations that his discharge was racially motivated is not
1707sufficient to raise a inf erence of discrimination where an
1717employer has offered evidence of legitimate, non - discriminatory
1726reasons for his discharge. Coutu v. Martin County Board of
1736County Commissioners , 47 F.3d 1068, 1073 (11th Cir. 1995); Young
1746v. General Foods Corp. , 840 F.2d 825, 830 (11th Cir. 1988).
175731. While Petitioner failed to establish a prima facie
1766case, Respondent offered legitimate, non - discriminatory reasons
1774for Petitioner's discharge.
1777RECOMMENDATION
1778Based on the foregoing Findings of Fact and Conclusions of
1788Law, it is
1791RECOMMENDED that the Florida Commission on Human Relations
1799enter a final order dismissing the Petition for Relief filed in
1810this case.
