124STATEMENT OF THE ISSUES

128The issues are whether Respondent violated various

135provisions of law governing the operation of restaurants and, if

145so, what penalty should be imposed.

151PRELIMINARY STATEMENT

153By Administrative Complain t filed June 27, 2002, Petitioner

162alleged that Respondent maintained gyro meat at 103 degrees

171Fahrenheit, in violation of Food Code Section 3 - 501.16(A);

181allowed food debris on reach - in gaskets, in violation of Food

193Code Section 4 - 601.11(A); and allowed dri ed food debris on dish

206shelves and grease on hood filters, in violation of Food Code

217Section 4 - 602.13.

221Respondent disputed the material allegations and demanded a

229formal hearing.

231At the hearing, Petitioner called two witnesses and offered

240into evidence s even exhibits. Respondent called one witness and

250offered into evidence two exhibits. All exhibits were admitted.

259The court reporter filed the transcript on September 26,

2682002. Petitioner filed a Proposed Recommended Order on

276October 3, 2002.

279FINDINGS O F FACT

2831. Respondent operates the restaurant known as Middle East

292Connections, which is located inside a shopping mall at 19575

302Biscayne Boulevard in Aventura, Florida. This restaurant is

310part of the food court inside the mall.

3182. Petitioner's inspect or conducted inspections of the

326restaurant on July 23, October 18, and October 29, 2001. These

337inspections revealed numerous violations.

3413. The inspection on October 29, 2001, identified that

350Respondent was holding hot gyro meat at a temperature that w as

362at least 30 degrees cooler than the minimum temperature required

372for this meat. Additionally, Respondent was maintaining the

380steam table at too low a temperature; thus, chicken was at a

392dangerously cool temperature of 103 degrees Fahrenheit.

3994. The Oc tober 29 inspection also revealed dried food

409debris on the gaskets of the reach - in coolers. The risk of this

423violation is that food handlers may be obtaining ready - to - eat

436food, which may become contaminated if the food handlers touch

446dirty cooler gaskets.

4495. The October 29 inspection also uncovered dried food

458debris on the dish shelves and grease on the hood filters.

469Dried food debris poses a contamination risk, and greasy hood

479filters pose a fire hazard.

4846. Respondent's first defense is that its princi pal did

494not acquire the restaurant from its former operator until

503February 11, 2002. However, Respondent's principal initiated a

511license transfer in August 2001. Petitioner promptly

518transferred the license. Petitioner's policy is not to issue

527two licens es for the same location, so that, if Respondent were

539to prevail on this argument, the restaurant would have been

549unlicensed during the time of these violations due to the action

560of Respondent's principal in initiating a transfer of the

569license.

5707. The documentation of the transaction between the

578current and former operators states that the change in ownership

588took place on July 1, 2001, and the inspector saw Respondent's

599principal at the restaurant after the license transfer.

6078. Respondent's second def ense is that it has corrected

617all violations and is operating the restaurant in compliance

626with the law. This claim is credited, although it operates more

637in mitigation than as a defense.

643CONCLUSIONS OF LAW

6469. The Division of Administrative Hearings has

653jurisdiction over the subject matter. Section 120.57(1),

660Florida Statutes. (All references to Sections are to Florida

669Statutes. All references to Rules are to the Florida

678Administrative Code.)

68010. Rule 61C - 4.010(1) adopts Food Code Chapter 3. Rule

69161C - 4.010(5) adopts Food Code Chapter 4.

69911. Food Code Section 3 - 501.16(A)(1) provides that

708potentially hazardous foods shall be maintained at 140 degrees

717Fahrenheit or above. Food Code Section 4 - 601.11(A) provides

727that "equipment food contact surfaces shal l be clean to sight

738and touch." Food Code Section 4 - 602.13 provides that "nonfood -

750contact surfaces of equipment shall be cleaned at a frequency

760necessary to preclude accumulation of soil residues."

76712. Section 509.261(1) provides for a fine of $1000 per

777offense, suspension or revocation of a license, and mandatory

786attendance at an educational program sponsored by the

794Hospitality Education Program for any violation of law by a

804restaurant.

80513. In its proposed recommended order, Petitioner seeks a

814fine of $ 2000, suspension of the license until the first payment

826is received, installments as set by the Director of the Division

837of Hotels and Restaurants, and attendance at an educational

846class.

847RECOMMENDATION

848It is

850RECOMMENDED that the Division of Hotels a nd Restaurants

859enter a final order imposing a $2000 fine upon such terms as the

872Director determines are appropriate.
