107STATEMENT OF THE ISSUE

111Whether the Petitioner owes the amount assessed in the

120Respondent's Final Agency Audit Report for a Medicaid

128overpayment of $6,487.20.

132PRELIMINARY STATEMENT

134This case began on April 21, 2000, when the Respondent,

144Agency for Health Care Administration, Medicaid Program

151Integrity Office (Respondent or Agency), completed a review of

160the Petitioner's Medicaid claim for the period February 22,

1691997 through February 22, 1999. For the two - year period of

181the audit the Agency determined that the Petitioner, Lily -

191Scott Formato, d/b/a Tender Loving Childbirth (Petitioner),

198had been overpaid $15,039.05. The overpayment was based upon

208a rejection of claims that were in whole or in part not

220covered by Medicaid.

223The Petitioner requ ested an administrative hearing to

231contest the findings of the audit, and the case was forwarded

242to the Division of Administrative Hearings and assigned DOAH

251Case No. 01 - 4525MPI. Thereafter, the case was remanded to the

263Agency after the parties represented the issues had been or

273would be settled.

276On May 7, 2003, the Agency filed a Motion to Reopen the

288Proceeding as the parties had failed to amicably resolve the

298case. On June 5, 2003, the case was reopened as DOAH Case No.

31103 - 1920MPI. On July 7, 2003, the case was scheduled for

323formal hearing. Both the order reopening the case and the

333notice of hearing were furnished to Petitioner at the address

343of record. Neither was returned to the Division of

352Administrative Hearings as undelivered by the postal service.

360It is presumed the Petitioner received the notice of hearing.

370Prior to the hearing, the Agency filed a Motion for an

381Order Deeming Request for Admissions Admitted. An order to

390the Petitioner to show cause why the motion should not be

401granted was r eturned by the postal service with the notice

"412moved left no address" and "unable to forward." Similarly,

421the Agency's effort to supply the Petitioner with its

430prehearing exhibits was undeliverable to the Petitioner at the

439address of record.

442At the hearing, the Agency requested that the admissions

451be deemed admitted as the Petitioner failed or refused to

461timely respond to the discovery. Such motion was granted.

470Additionally, it was determined that the Petitioner had moved

479subsequent to notice of the h earing. The Petitioner failed to

490appear for hearing and thereby waived a challenge of the

500findings set forth by the audit.

506Additionally, the Agency timely filed a Motion for Costs

515to which the Petitioner has not responded. Having determined

524the Agency should prevail in this cause, it is further

534determined the Agency is entitled to recover costs of the

544audit and administrative proceeding.

548A transcript of the proceeding was filed with the

557Division of Administrative Hearings on August 12, 2003.

565Thereafter , the Agency timely filed a Proposed Recommended

573Order that has been considered in the preparation of this

583Recommended Order. The Petitioner did not file a post - hearing

594proposed recommended order. All citations are to Florida

602Statutes (2002) unless otherwise indicated.

607FINDINGS OF FACT

6101. Petitioner was an authorized Medicaid provider during

618the period of the audit.

6232. Petitioner's Medicaid provider number was 376782500.

6303. As a Medicaid provider, the Petitioner was obligated

639to comply with the Medic aid Provider Agreement(s), statutes,

648rules, and policy guidelines that the Agency uses to govern

658Medicaid providers.

6604. During the audit period of this case, the Petitioner

670was required to maintain all "Medicaid - related records" to

680support the Medicaid invoices and claims for which payment was

690requested of the Agency.

6945. In fact, by law the records are to be maintained for

706a five - year period of time so that the Petitioner would be

719able to "satisfy all necessary inquiries by the agency." See

729Section 409.9 07(3)(c).

7326. In this case the Agency computed the overpayment

741based upon the records submitted by the Petitioner. The

750Petitioner did not contest the randomness of the clusters

759applied by the Agency in creating the overpayment amount.

7687. The Petitioner billed for the payments in the

777overpayment amount and received payment from the Agency.

7858. The overpayment to Petitioner was originally

792calculated to be $15,039.05. At hearing the Agency announced

802the overpayment had been reduced to $6,487.20.

8109. Base d upon the failure of the Petitioner to appear at

822hearing and the return of the mail that had been provided to

834the Petitioner's last known address, the Agency believes the

843Petitioner is out of business and has relocated to an unknown

854address.

855CONCLUSIONS OF LAW

85810. The Division of Administrative Hearings has

865jurisdiction over the parties to and the subject matter of

875these proceedings. Section 120.57.

87911. Based upon the admissions in this cause and the

889failure of the Petitioner to appear at hearing, the A gency has

901established the overpayment of the Medicaid claims as set

910forth in the Final Agency Audit Report dated April 21, 2000.

92112. Additionally, the Agency is entitled to recover a

930reasonable amount to cover the costs of pursuing this matter,

940including, expert witness fees, process server fees,

947investigative fees and mailing costs.

952RECOMMENDATION

953Based on the foregoing Findings of Fact and Conclusions

962of Law, it is RECOMMENDED that the Agency for Health Care

973Administration enter a final order against the Petitioner for

982a Medicaid overpayment in the amount of $6,487.20, together

992with reasonable costs incurred in this cause.
