171STATEMENT OF THE CASE

1751. On July 15, 2003, Deliris Betancourt, as Personal

184Representative of the Estate of Rey A. Pa gan (Rey), a deceased

196minor, filed a petition with the Division of Administrative

205Hearings (DOAH) to resolve whether Rey suffered an injury

214compensable under the Florida Birth - Related Neurological Injury

223Compensation Plan (Plan) and, if so, whether the hos pital

233(Osceola Regional Hospital) at which his birth occurred,

241complied with the notice provisions of the Plan.

2492. DOAH served Respondent, Florida Birth - Related

257Neurological Injury Compensation Association (NICA), with a copy

265of the petition on July 17, 2 003, 1 and on August 12, 2003, NICA

280filed a Motion for Summary Final Order, pursuant to Section

290120.57(1)(h). 2 The predicate for NICA's motion was its assertion

300that, indisputably, the physician named in the petition as

309having provided obstetrical services at Rey's birth (Heidy Puig,

318M.D.) was not, at the time, a "participating physician," as

328defined by law, since she had neither paid the assessment

338required for participation nor was she exempt from payment of

348the assessment. Section 766.302(7). Attached to the motion was

357an affidavit of the Custodian of Records for NICA attesting to

368such facts.

3703. On October 16, 2003, a teleconference was held to

380address NICA's motion. Notably, at hearing, Petitioners,

387Osceola Regional Hospital, and Dr. Puig agreed with NICA that,

397at the time of Rey's birth, Dr. Puig was not a "participating

409physician" in the Plan since she had neither paid the assessment

420required for participation nor was she exempt from payment of

430the assessment.

4324. Given the record, it is undisputed the physician who

442provided obstetrical services at Rey's birth was not, at the

452time, a "participating physician," as that term is defined by

462Section 766.302(7). Consequently, NICA's Motion for Summary

469Final Order is, for reasons appearing more fully in th e

480Conclusions of Law, meritorious.

484CONCLUSIONS OF LAW

4875. The Division of Administrative Hearings has

494jurisdiction over the parties to, and the subject matter of,

504these proceedings. Section 766.301, et seq.

5106. The Florida Birth - Related Neurological Injur y

519Compensation Plan was established by the Legislature "for the

528purpose of providing compensation, irrespective of fault, for

536birth - related neurological injury claims" relating to births

545occurring on or after January 1, 1989. Section 766.303(1).

5547. The i njured "infant, her or his personal

563representative, parents, dependents, and next of kin," may seek

572compensation under the Plan by filing a claim for compensation

582with the Division of Administrative Hearings. Sections

589766.302(3), 766.303(2), 766.305(1), a nd 766.313. The Florida

597Birth - Related Neurological Injury Compensation Association,

604which administers the Plan, has "45 days from the date of

615service of a complete claim . . . in which to file a response to

630the petition and to submit relevant written info rmation relating

640to the issue of whether the injury is a birth - related

652neurological injury." Section 766.305(3).

6568. If NICA determines that the injury alleged in a claim

667is a compensable birth - related neurological injury, it may award

678compensation to the claimant, provided that the award is

687approved by the administrative law judge to whom the claim has

698been assigned. Section 766.305(6). If, on the other hand, NICA

708disputes the claim, as it has in the instant case, the dispute

720must be resolved by the ass igned administrative law judge in

731accordance with the provisions of C hapter 120. Sections

740766.304, 766.307, 766.309, and 766.31.

7459. In discharging this responsibility, the administrative

752law judge must make the following determination based upon the

762avai lable evidence:

765(a) Whether the injury claimed is a

772birth - related neurological injury. If the

779claimant has demonstrated, to the

784satisfaction of the administrative law

789judge, that the infant has sustained a brain

797or spinal cord injury caused by oxygen

804d eprivation or mechanical injury and that

811the infant was thereby rendered permanently

817and substantially mentally and physically

822impaired, a rebuttable presumption shall

827arise that the injury is a birth - related

836neurological injury as defined in s.

842766.303(2) .

844(b) Whether obstetrical services were

849delivered by a participating physician in

855the course of labor, delivery, or

861resuscitation in the immediate post - delivery

868period in a hospital; or by a certified

876nurse midwife in a teaching hospital

882supervised by a participating physician in

888the course of labor, delivery, or

894resuscitation in the immediate post - delivery

901period in a hospital.

905Section 766.309(1). An award may be sustained only if the

915administrative law judge concludes that the "infant has

923sustaine d a birth - related neurological injury and that

933obstetrical services were delivered by a participating physician

941at birth." Section 766.31(1).

94510. Pertinent to this case, "participating physician" is

953defined by Section 766.302(7), to mean:

959. . . a physici an licensed in Florida to

969practice medicine who practices obstetrics

974or performs obstetrical services either

979full - time or part - time and who had paid or

991was exempt from payment at the time of

999injury the assessment required for

1004participation in the birth - rel ated

1011neurological injury compensation plan for

1016the year in which the injury occurred.

102311. Here, it is undisputed that the physician who provided

1033obstetrical services during the birth of the infant was not a

"1044participating physician" as that term is defin ed by Section

1054766.302(7), and as that term is used in Sections 766.301 through

1065766.316. Consequently, NICA's Motion for Summary Final Order is

1074granted. Sections 120.57(1)(h), 766.309(1) and (2), and

1081766.31(1).

108212. Where, as here, the administrative law judge

1090determines that ". . . obstetrical services were not delivered

1100by a participating physician at the birth, he [is required to]

1111enter an order [to such effect] and . . . cause a copy of such

1126order to be sent immediately to the parties by registered or

1137certified mail." Section 766.309(2). Such an order constitutes

1145final agency action subject to appellate court review. Section

1154766.311(1).

1155CONCLUSION

1156Based on the Statement of the Case and Conclusions of Law,

1167it is

1169ORDERED that the claim for compensati on filed by Deliris

1179Betancourt, as Personal Representative of the Estate of Rey A.

1189Pagan, a deceased minor, is dismissed with prejudice.
