54SUMMARY FINAL ORDER
57This cause originated from action of counsel for the
66Department of Community Affairs (DCA). By e - mail dated July 3,
782003, in the case of Preserving Rural Property Values, Inc., et
89al., vs. Alachua County, et al. , DOAH Case No. 02 - 2676, DCA's
102counsel advised the county attorney for Alachua County as
111follows:
112[Y]ou may advise the Commission, if you wish,
120that the Department is unaware of a ny
128violation of Florida Statutes relating to the
135mediation and settlement negotiations.
139Certainly the facts set forth in Mr. Russ's
147letter do not constitute a violation.
153Subsequently, Counsel for Petitioners filed a Petition
160alleging that the foregoing statement of counsel for DCA
169constituted an unpromulugated rule in violation of Section
177120.54(1)(a), Florida Statutes.
180In response, DCA filed a Motion for Summary Final Order on
191August 4, 2003, requesting dismissal of the Petition on the
201basis that the statement of its counsel did not constitute a
212rule as that term is defined in Chapter 120, Florida Statutes .
224By separate motion dated August 6, 2003, Petitioners moved
233to strike the motion of the Department, stating that the
243Department's motion failed t o dispute any fact alleged by the
254Petitioners in their initial Petition.
259By order dated August 6, 2003, counsel for Petitioners was
269directed to respond to DCA's Motion for Summary Final Order no
280later than August 14, 2003. Counsel for Petitioners timely
289responded to the undersigned's order.
294A review of the Motion for Summary Final Order, Response of
305Petitioners to DCA's Motion for Summary Final Order, and other
315pleadings filed in this matter has been completed.
323Accordingly, ruling at this time upon DC A's Motion for
333Summary Final Order appears to be in order and in the best
345interest and most effective use of the administrative law
354system.
355CONCLUSIONS OF LAW
3581. The Division of Administrative Hearings has jurisdiction
366over the parties to, and the s ubject matter of, this proceeding
378pursuant to Section 120.56, Florida Statutes.
3842. Petitioners allege that DCA, through DCA's counsel, has
393adopted a policy. Counsel's statement of DCA's position is
402nothing more than his legal opinion and, without more, d oes not
414rise to the level of stated agency policy. Therefore, it is not
426a rule as defined in Section 120.52(15), Florida Statutes.
4353. Subsection 120.57(1)(h), Florida Statutes, reads in
442pertinent part as follows:
446Any party to a proceeding in which an
454administrative law judge of the Division of
461Administrative Hearings has final order
466authority may move for a summary final order
474when there is no genuine issue as to any
483material fact. A summary final order shall
490be rendered if the administrative law judg e
498determines from the pleadings, depositions,
503answers to interrogatories, and admissions
508on file, together with affidavits, if any,
515that no genuine issue as to any material
523fact exists and that the moving party is
531entitled as a matter of law to the entry o f
542a final order.
545Accordingly, upon review of the pleadings in this matter,
554the Motion for Summary Final Order is granted, Final Hearing
564scheduled in this cause for August 18, 2003, is cancelled, and
575the Petition is dismissed. All other pending motions are
584dismissed as moot.
