102STATEMENT OF THE ISSUE

106Whether Peti tioner is entitled to licensure by endorsement,

115pursuant to Section 489.115, Florida Statutes (2003).

122PRELIMINARY STATEMENT

124On or about April 4, 2003, Petitioner, William Lantrip

133(Petitioner), applied to Respondent, Construction Industry

139Licensing Boa rd (Board), for licensure as a certified plumber in

150the State of Florida. At that time, because Petitioner was

160licensed as a plumber in Georgia, he applied for licensure by

171endorsement pursuant to Section 489.115, Florida Statutes

178(2003). By Notice of In tent to Deny (Notice) dated June 25,

1902003, the Board denied Petitioner's application. According to

198the Notice, the application was denied because the Board

207determined that the licensure examination Petitioner took in

215Georgia was not substantially equivale nt to the licensure

224examination administered in Florida.

228Petitioner challenged the denial and timely requested a

236formal hearing. On August 7, 2003, the matter was referred to

247the Division of Administrative Hearings for assignment of an

256Administrative Law Judge to conduct the hearing and prepare a

266recommended order. By notice issued August 28, 2003, the matter

276was set for hearing and was conducted, as noted above.

286At the final hearing, Petitioner testified in his own

295behalf but called no other witnesses. Petitioner's Exhibits 1,

3042, and 3 were received into evidence. Respondent presented the

314testimony of two witnesses: 1) Stephen Allen, a psychometrician

323with the Department of Business and Professional Regulation;

331and 2) Timothy Vaccaro, executive direc tor of the Board.

341Respondent's Exhibits 1 and 2 were received into evidence.

350At the conclusion of the hearing, the time for filing proposed

361recommended orders was set for ten days from the date the

372Transcript was filed.

375A Transcript of the proceeding wa s filed on October 22,

3862003. Both parties filed Proposed Recommended Orders, which

394have been duly considered in the preparation of this Recommended

404Order.

405FINDINGS OF FACT

4081. On or about April 4, 2003, Petitioner applied for a

419certified plumbing contra ctor's license by endorsement.

4262. Applicants who seek a licensure by endorsement must

435have passed an examination that is substantially equivalent to

444the examination given in Florida or hold a license in another

455state or territory of the United States whe re the criteria for

467issuance of the license is substantially equivalent to Florida's

476criteria.

4773. At all times relevant to this proceeding, Petitioner

486was licensed or certified as a plumber in Georgia, Alabama, and

497Tennessee. For the purpose of his appl ication for licensure by

508endorsement, Petitioner submitted information to the Board

515regarding the examination he took in Georgia. Petitioner was

524not precluded from submitting information regarding the

531examinations he took in Alabama and Tennessee. Howeve r,

540Petitioner submitted the information regarding the examination

547he took in Georgia because it was the one he had taken most

560recently.

5614. Georgia gives three different plumbing examinations and

569issues three different plumbing licenses. One examination is

577for a journeyman's license. Another examination is for a

586Class I restricted plumbing license. Still, another examination

594is given for a Class II unrestricted plumbing license.

6035. In order to obtain his plumbing license in Georgia,

613Petitioner succe ssfully completed the Class I Restricted Georgia

622Examination (Georgia Examination).

6256. Florida issues only one certified plumbing contractor's

633license and that license is the equivalent of Georgia's Class II

644unrestricted plumbing license. To meet the exa mination

652requirement for licensure as a plumber in Florida, an applicant

662must successfully complete the Certification Examination for

669Plumbing Contractors (Florida Examination or Certification

675Examination for Plumbing Contractors).

6797. Stephen Allen, a ps ychometrician employed by the

688Department of Business and Professional Regulation, evaluated

695the Georgia Examination to determine if it were substantially

704equivalent to the Florida Examination. In determining whether

712the Georgia Examination and the Florida Examination were

720substantially equivalent, Mr. Allen considered and compared the

728material covered; the emphasis placed on various topics; the

737actual content of the examinations; the general characteristics

745of the examination; the number of questions; the amount of time

756allowed to complete the examination; the weight given to various

766areas or categories of the examinations; and the method of

776measuring knowledge in the various content areas.

7838. Based on a comprehensive review and analysis of the

793Georgia Ex amination and the Florida Examination, Mr. Allen

802properly determined that the Georgia Examination was not

810substantially equivalent to the Florida Examination.

8169. The area in which the examinations are significantly

825different is the isometric area or cate gory. First, the

835relative weight on the isometric area of the examinations varies

845greatly. On the Florida Examination, the weight given to the

855isometric area is 31 percent. On the Georgia Examination, the

865weight given to the isometric area is, at most, only 6 percent.

877Second, the knowledge of isometrics is measured differently on

886the examinations. The Florida Examination requires that the

894candidate demonstrate knowledge of isometrics by having the

902candidate draw five different isometric drawings, whic h show the

912room's plumbing based on the fixtures to be installed. The five

923drawings are graded on legibility, orientation, flow, angles,

931piping, labeling, and vents. The Georgia Examination is a

940multiple choice examination and measures knowledge of isome trics

949by the candidate's selecting the correct answer from four

958possible answers.

96010. The Georgia Examination successfully completed by

967Petitioner to obtain his master plumber's restricted license is

976not substantially equivalent to the Florida Examination .

98411. Petitioner is ineligible for licensure by endorsement

992because the examination he took in Georgia is not substantially

1002equivalent to the Florida Examination.

1007CONCLUSIONS OF LAW

101012. The Division of Administrative Hearings has

1017jurisdiction over the p arties to and the subject matter of this

1029proceeding pursuant to Sections 120.569 and 120.57, Florida

1037Statutes (2003).

103913. Section 489.115(2), Florida Statutes (2003),

1045authorizes the Board to issue a certificate of registration to

1055applicants who submit app lications, the appropriate fee, and

1064otherwise meet the provisions of the section under which they

1074seek licensure.

107614. In this case, Petitioner seeks to obtain a plumber's

1086license in Florida pursuant to Section 489.115(3), Florida

1094Statutes (2003). That pr ovision authorizes an applicant, who

1103meets the requirements in that provisions contained therein, to

1112obtain a license by endorsement.

111715. Section 489.115(3), Florida Statutes (2003), states

1124(3) The board shall certify as qualified

1131for certification b y endorsement any

1137applicant who:

1139(a) Meets the requirements for

1144certification as set forth in this section;

1151has passed a national, regional, state, or

1158United States territorial licensing

1162examination that is substantially equivalent

1167to the examination required by this part;

1174and has satisfied the requirements set forth

1181in s. 489.111;

1184(b) Holds a valid license to practice

1191contracting issued by another state or

1197territory of the United States, if the

1204criteria for issuance of such license were

1211substanti ally equivalent to Florida's

1216current certification criteria; or

1220(c) Holds a valid, current license to

1227practice contracting issued by another state

1233or territory of the United States, if the

1241state or territory has entered into a

1248reciprocal agreement wit h the board for the

1256recognition of contractor licenses issued in

1262that state, based on criteria for the

1269issuance of such licenses that are

1275substantially equivalent to the criteria for

1281certification in this state.

128516. Petitioner holds a valid plumber's li cense in Georgia

1295and seeks to qualify for certification as a plumber under

1305Section 489.115(3)(a), Florida Statutes (2003), which authorizes

1312certification by endorsement, if the applicant has passed a

1321regional, state, or United States territorial licensing

1328examination that is substantially equivalent to the Florida

1336Examination.

133717. As the applicant for licensure by endorsement or the

1347party asserting the affirmative of the issue, Petitioner has the

1357burden of proof. See Department of Banking and Finance,

1366Div ision of Security and Investor Protection v. Osborne Stern

1376and Co. , 670 So. 2d 932, 934 (Fla. 1st DCA 1996); and Florida

1389Department of Transportation v. J.W.C. Co. , 396 So. 2d 778 (Fla.

14001st DCA 1981).

140318. Petitioner has failed to meet his burden.

141119. Sec tion 489.108, Florida Statutes (2003), grants to

1420the Board rulemaking authority to implement the provisions of

1429Chapter 489, Florida Statutes (2003).

143420. With regard to the examinations required as a

1443condition of licensure, Section 455.217(1)(b), Florida Statutes

1450(2003), requires that the Board "shall by rule specify the

1460general areas of competency to be covered on the examination,

1470the relative weight to be assigned in grading each area tested,

1481the score necessary to achieve a passing grade . . . ."

149321. Pu rsuant to its rulemaking authority, the Board has

1503promulgated Florida Administrative Code Rule 61G4 - 16.001(12)

1511which provides in relevant part:

1516(12) Certification Examination for

1520Plumbing Contractors. The certification

1524examination shall consist of two tests.

1530(a) Test one shall consist of questions

1537relating to the business and financial

1543management of a contracting firm. The

1549content areas to be covered and the

1556approximate weights to be assigned to

1562said areas are set forth in subsection

156961G4 - 16.001(2 0), F.A.C.

1574(b) Test two shall consist of questions

1581relating to general knowledge of the

1587plumbing trade. The content areas to be

1594covered and the approximate weights to be

1601assigned to said areas shall be as follows:

16091. 20% Drainage;

16122. 20% Water Distribution;

16163. 15% Natural Gas Piping;

16214. 20% Medical Gas Piping;

16265. 10% Industrial Piping;

16306. 5% Swimming Pools, Wells and

1636Irrigation;

16377. 5% Solar;

16408. 5% Fire Protection; and

16459. Test two shall include, but shall not

1653be limit ed to, five plumbing isometric

1660drawings. The content of the drawings shall

1667conform to the content areas listed in 1.

1675through 8. above. Each of the isometric

1682drawings is worth up to a maximum of 10

1691points. Based on the criteria listed below,

1698each drawing will be independently evaluated

1704by three graders. At least two of the

1712graders must agree that a criterion is

1719correct in order for that criterion to be

1727graded as correct and points to be awarded.

1735If one or more criterion is determined to be

1744incorrect by at least two of the graders,

1752points will not be awarded for that

1759criterion. The awarded points for all

1765criteria will be summed and converted to a

177310 point scale to determine the score for

1781each drawing. The following are the

1787criteria and points used by th e graders to

1796evaluate each of the five isometric

1802drawings.

1803a. Legibility. Drawing is clear and

1809readable. Drawing is sufficient in size.

1815Lines and labels are distinguishable.

1820(8 points)

1822b. Orientation. All fixtures are shown

1828in the correct locat ion relative to each

1836other. (20 points)

1839c. Flow. Direction of flow is shown when

1847going from vertical to horizontal. The

1853direction of flow must be indicated even if

1861the direction is implied for all waste lines

1869and all fixture connections. Direction of

1875flow is not required for vent lines. (12

1883points)

1884d. Angles. Isometric drawing uses 30 - 60 -

189390 degree angles. All angles used on the

1901drawing are displayed at the appropriate

1907orientation. (8 points)

1910e. Piping. All pipes, fittings, traps,

1916clean - ou ts, and similar portions of the

1925piping structure are included on the

1931drawing. All piping is shown exactly as on

1939the drawing (regardless of specific code

1945requirements). The piping must display the

1951correct elevation in reference to the floor

1958plan. (20 poin ts)

1962f. Labeling. All fixtures are labeled

1968according to the legend provided in the

1975examination instructions. (4 points)

1979g. Vents. All vents are properly

1985indicated. (16 points)

1988h. Fixtures. All fixtures shown on the

1995floor plan are appropriate ly indicated on

2002the isometric drawing. (12 points)

2007(Emphasis supplied.)

200922. According to Florida Administrative Code

2015Rule 61G4 - 16.001(12)(b)9. quoted above, the Certification

2023Examination for Plumbing Contractors shall consist of five

2031plumbing isome tric drawings, which shall conform to content

2040areas listed in Subsections 1 through 8 of the Rule. The

2051criteria for grading the isometric drawings are listed in

2060Florida Administrative Code Rule 61G4 - 16.001(12)(b)9.a.

2067through h.

206923. The evidence establish ed and is undisputed that

2078Petitioner is licensed as a plumber in Georgia. However,

2087Petitioner failed to establish that the Georgia Examination,

2095which he successfully completed, is substantially equivalent to

2103the Florida Examination. Contrary to the asser tion of

2112Petitioner , the evidence established that the Georgia

2119Examination is not substantially equivalent to the Florida

2127Examination.

212824. The evidence established that the Georgia Examination

2136and the Florida Examination vary significantly with regard to

2145t he method of determining a candidate's knowledge of isometrics

2155and the weight given to that section.

216225. Having failed to establish that the Georgia

2170Examination, which he successfully completed, is substantially

2177equivalent to the Florida Examination, Petit ioner does not

2186qualify for certification by endorsement pursuant to

2193Section 489.115(3)(a), Florida Statutes (2003). Moreover,

2199Petitioner failed to establish that he is eligible for licensure

2209by endorsement pursuant to Section 489.115(3)(b) or (c), Florida

2218Statutes.

2219RECOMMENDATION

2220Based upon the foregoing Findings of Fact and Conclusions

2229of Law, it is

2233RECOMMENDED that the Construction Industry Licensing Board

2240enter a final order denying Petitioner's application for

2248licensure by endorsement.
