106This cause came on to be heard pursuant to Sections 766.304

117and 766.305(6), Florida Statutes, 1 upon the stipulation and joint

127petition of the parties, filed March 12, 2004, for the entry of

139an order approving the resolution of a formal claim for

149compensation benefits heretofore filed in this cause in

157accordance with the provisions of Chapter 766, Florida Statutes,

166and a resolution of the exclusive remedy otherwise available as

176outlined in Chapter 766, Florida Statutes, and the letter of

186March 15, 2004, filed March 17, 2004, on behalf of Intervenor

197announcing it has no objection to the approval of Petitioners'

207and Respond ent's stipulation.

211By the terms of their stipulation, the parties have agreed

221that Petitioners, Aida Turkanovic and Hamdija Turkanovic, are

229the parents and natural guardians of Jenita Turkanovic (Jenita),

238a minor; that Jenita was born a live infant on Octo ber 12, 1999,

252at Memorial Hospital Jacksonville, a hospital located in Duval

261County, Florida; and that her birth weight exceeded 2,500 grams.

272The parties have further agreed that the physicians delivering

281obstetrical services during the birth of Jenita wa s Angela S.

292Martin, M.D., and Kimberly Van Scriver, M.D., who, at all times

303material hereto, were participating physicians in the Florida

311Birth - Related Neurological Injury Compensation Plan, as defined

320by Section 766.302(7), Florida Statutes. Finally, by their

328stipulation, the parties have agreed that Jenita suffered a

"337birth - related neurological injury," as that term is defined by

348Section 766.302(2), Florida Statutes.

352After due consideration of the interests of all parties,

361and being otherwise fully advis ed in the premises, it is

372ORDERED that:

3741. The stipulation of the parties, filed March 12, 2004,

384is hereby approved, and the parties are directed to comply with

395the provisions thereof.

3982. Petitioners, Aida Turkanovic and Hamdija Turkanovic, as

406the paren ts of Jenita Turkanovic, a minor, are accorded an award

418of One hundred thousand dollars ($100,000.00), pursuant to

427Section 766.31(1)(b), Florida Statutes, to be used for purposes

436consistent with the terms of the parties' stipulation.

4443. Upon payment of th e award of One hundred thousand

455dollars ($100,000.00) to the parents (claimants), attorney's

463fees and other expenses of Ten thousand one hundred twenty - two

475dollars and eighty cents ($10,122.80), and past expenses, the

485claims of Petitioners (claimants) shal l be deemed fully

494satisfied and extinguished, except to the extent of Respondent's

503continuing obligation under the provisions of Section 766.31, to

512pay future expenses as incurred.

5174. The Division of Administrative Hearings retains

524jurisdiction over this matter to resolve any dispute as to the

535interpretation of any provision of the parties' stipulation and

544to resolve any disputes, should they arise, regarding the

553parties' compliance with the terms of such stipulation.
