152PRELIMINARY STATEMENT

154In correspondence dated September 3, 2003, the Department

162of Education ("Department") notified Maria Guerrero that her

172response on the Essay subtest portion of the General Knowledge

182Test administered on July 26, 2003, had been invalidated because

192Ms. Guerrero failed to follow the Department's policy on

201cheating. Ms. Guerrero timely requested an administrative

208hearing, and the Department forwarded the matter to the Division

218of Admini strative Hearings for assignment of an administrative

227law judge.

229At the hearing, the Department presented the testimony of

238Kathy Fearon and Lourdes Fernandez, and Department's Exhibits A

247through F were received into evidence. Ms. Guerrero testified

256in her own behalf, and offered no exhibits. Anna Fernandez,

266Ms. Guerrero's daughter, acted as interpreter, with the

274Department's agreement.

276The one - volume transcript of the proceedings was filed with

287the Division of Administrative Hearings on February 10, 2004,

296and the parties timely filed proposed findings of fact and

306conclusions of law, which have been considered in the

315preparation of this Recommended Order.

320FINDINGS OF FACT

323Based on the oral and documentary evidence presented at the

333final hearing and on the entire record of this proceeding, the

344following findings of fact are made:

3501. On June 18, 2003, Ms. Guerrero completed the

359Registration Application to take the Certification Examination

366for Florida Educators that was administered on July 26, 2003.

3762. A R egistration Bulletin accompanied the Registration

384Application and contained directions for completing the

391application. On page 24 of the Registration Bulletin,

399applicants were advised that, in signing Block 19 of the

409Registration Application, they were ag reeing to the conditions

418set forth in the Registration Bulletin, including the following:

427I understand that all of the examination

434booklets, answer sheets, and other

439examination materials are the sole property

445of the Florida Department of Education and

452tha t I am not permitted to take any of the

463examination materials from the examination

468center or to reproduce the materials in

475whole or part by any method. If I do

484anything prohibited by this paragraph, my

490examination performance will be voided.

495I understand that during the examination I

502will not be permitted to use written notes,

510make written notes of the content of the

518examination booklets, use scratch paper, or

524communicate with other examinees in any way.

531I also understand that the only materials

538that may be on my desk during the

546examination are the test booklets, answer

552sheets, pencils and eraser, and examination

558aids that are specified on my admission

565ticket, and that I will be permitted to use

574the margin of my test booklet for any

582preliminary work prepa ratory to answering

588specific questions. I understand that I am

595not permitted to give assistance to or

602receive assistance from other examinees, I

608must follow the instructions of the test

615administration personnel, and I must be the

622person whose name appears on the test

629receipt card for this test. If I do

637anything prohibited by this paragraph, my

643examination will be voided.

6473. Approximately two weeks before an examination is

655administered, it is the Department's practice to send the

664candidates for the exami nation their admission tickets and a

674copy of Certification Examinations for Florida Educators, which

682includes the following:

685Cheating is any unauthorized activity that

691impairs or alters the circumstances of the

698examination as a measure of the knowledge or

706skills it was designed to assess, including

713but not limited to the following:

719* * *

722g. During or after the examination

728administration, taking, or attempting to

733take, from the examination room, copies of,

740or notes regarding, examination questions,

745prompt s, answers, responses, or examination

751question stimulus materials.

754Ms. Guerrero received a copy of Certification Examinations for

763Florida Educators, along with her examination admissions ticket.

7714. Ms. Guerrero was admitted to the examination center on

781J uly 26, 2003.

7855. Two essay topics were included in the essay booklet for

796the examination, and the candidates were to choose one topic on

807which to write. Ms. Guerrero does not understand English very

817well, and, shortly after the examination began, she wro te the

828two essay topics on the back of the admission ticket so she

840would better understand them before she chose the topic on which

851to write her essay. Ms. Guerrero also wrote her "logic rules"

862on the front of the admission ticket to make sure that she

874re membered them. Ms. Guerrero used the admission ticket as

884though it were a piece of scratch paper.

8926. At 8:35 a.m., the examination proctor observed

900Ms. Guerrero writing on her examination admission ticket and

909immediately began walking to Ms. Guerrero's s eat to confront

919her. As soon as she saw the proctor approaching, Ms. Guerrero

930realized that she should not have written on any of the

941examination materials because they belong to the Department.

9497. Ms. Guerrero moved to put the admission ticket into her

960purse, but the proctor arrived at her seat before she could

971complete the action. Ms. Guerrero gave the admission ticket to

981the proctor, who prepared an irregularity report on the

990incident.

9918. The proctor allowed Ms. Guerrero to continue taking the

1001examin ation.

10039. The Department decided to invalidate the Essay subtest

1012of Ms. Guerrero's examination as a result of the proctor's

1022report of the irregularity.

1026CONCLUSIONS OF LAW

102910. The Division of Administrative Hearings has

1036jurisdiction over the subject matt er of this proceeding and of

1047the parties thereto pursuant to Sections 120.569 and 120.57(1),

1056Florida Statutes (2003).

105911. The Department is charged with administering an

1067examination to measure the mastery of general knowledge of

1076applicants for certificati on as teachers in Florida. See

1085§ 1012.56(2), (3), and (8), Fla. Stat. (2003). Florida

1094Administrative Code Rule 6A - 4.0021 governs the written

1103examinations required for teacher certification, and these

1110examinations include subtests in various subjects, one of which

1119is writing. See Fla. Admin. Code R. 6A - 4.0021(2)(b).

112912. Candidates to take the examination are required to

1138submit a completed and signed Form CG - 20 - 03, Registration

1150Application: Certification Examinations for Florida Educators,

1156which is incorp orated by reference into Florida Administrative

1165Code Rule 6A - 4.0021(4)(a)1.a.

117013. As set forth in the findings of fact herein,

1180Ms. Guerrero, by writing the two essay topics on her examination

1191admission ticket, performed an act expressly prohibited in the

1200Registration Bulletin which accompanied the Registration

1206Application by making written notes of the contents of an

1216examination booklet. Accordingly, the Department appropriately

1222invalidated the Essay subtest of the General Knowledge Test

1231administered July 26, 2003.

1235RECOMMENDATION

1236Based on the foregoing Findings of Fact and Conclusions of

1246Law, it is RECOMMENDED that the Department of Education enter a

1257final order invalidating the Essay subtest of the General

1266Knowledge Test administered to Maria Guerrero on July 26, 2003.
