125The issue for determination is whether Petitioner’s

132Equivalency of Training Out - of - State/Federal Officer Form

142(CJSTC - 76) should be approved.

148PRELIMI NARY STATEMENT

151Richard A. Benvenuti made application to the Florida

159Department of Law Enforcement, Criminal Justice Standards and

167Training Commission, hereinafter CJSTC, to take the Equivalency

175of Training Course for re - certification as a Florida Certified

186Police Officer and completed the Equivalency of Training Out - of -

198State/Federal Officer Form (CJSTC - 76), hereinafter Equivalency

206Form. By notice dated August 25, 2003, CJSTC notified

215Mr. Benvenuti that approval of the Equivalency Form was denied

225on the bas is that he failed to meet the requirements of the

238Equivalency of Training law, which became effective July 11,

2472003, because his Equivalency Form showed that he had over an

258eight - year break in employment. By letter dated September 22,

2692003, Mr. Benvenuti requested a formal hearing. On October 1,

2792003, this matter was referred to the Division of Administrative

289Hearings.

290At hearing, Mr. Benvenuti testified in his own behalf and

300entered three exhibits (Petitioner’s Exhibits numbered 1 - 3) into

310evidence. 1 CJS TC did not present the testimony of any witnesses

322and entered six exhibits (Respondent's Exhibits numbered 1 - 6)

332into evidence. 2

335A transcript of the hearing was ordered. At the request of

346the parties, the time for filing post - hearing submissions was

357set for ten days following the filing of the transcript. The

368Transcript, consisting of one volume, was filed on December 15,

3782003. An extension of time for filing post - hearing submissions

389was filed and granted. Both parties filed post - hearing

399submissions, w hich have been considered in the preparation of

409this Recommended Order.

412FINDINGS OF FACT

4151. Mr. Benvenuti is seeking eligibility for an equivalency

424of training exemption from basic recruit training.

4312. Mr. Benvenuti has approximately 18 years of experien ce

441in law enforcement, fire, and emergency medical service.

4493. Mr. Benvenuti was employed as a firefighter in the

459State of Connecticut, with the City of New London, from January

4701971 to July 1979. He was also employed as a police officer in

483the State of Connecticut, with the Town of Waterford, from June

4941977 through December 1998, when he was not on shifts with the

506City of New London as a firefighter.

5134. Additionally, Mr. Benvenuti was the certified Fire

521Marshall for the City of New London and the Acting Deputy Fire

533Marshall for the Town of Waterford.

5395. On January 7, 1985, Mr. Benvenuti was certified as a

550law enforcement officer in Florida and became a law enforcement

560officer with the Oakland Park Public Safety Department in

569Oakland Park, Florida. He v oluntarily left the Oakland Park

579Public Safety Department on August 20, 1987, to return to

589Connecticut.

5906. When Mr. Benvenuti returned to Connecticut in 1987, he

600was re - employed by the New London Fire Department. In 1989,

612because of a lower back injury, he retired.

6207. Mr. Benvenuti was subsequently licensed by the State of

630Florida as a private investigator. He worked as a private

640investigator from 1991 to 2001, with a company performing

649investigations and surveillance. During his tenure with the

657compan y, Mr. Benvenuti received training from the United States

667Customs Office and the United States Drug Enforcement

675Administration and performed airport security in Costa Rica.

6838. Mr. Benvenuti is presently the general manager of a

693towing company in Fort Laud erdale, Broward County, Florida.

702Among other things, he has constant contact with law enforcement

712officers.

7139. Mr. Benvenuti has impressive letters of recommendation.

721The letters of recommendation include recommendations from the

729Chief of Police of the Waterford Police Department and of the

740Oakland Park Public Safety Department, and the Fire Chief of the

751City of New London.

75510. During the summer of 2003, Mr. Benvenuti decided to

765get re - certified, as a law enforcement officer in Florida, since

777he had a "love" for law enforcement and after becoming aware

788that a friend of his had returned to school in the spring of

8012003 for re - certification. Mr. Benvenuti inquired about re -

812certification at Broward Community College (College). The

819College offers the Pre - Exam Qualification Course for the

829Equivalency Training exam. Mr. Benvenuti was informed by the

838College that the class offered in July 2003 was already full and

850that he had to wait until the next available class was offered,

862which was in September 2003.

86711 . In August 2003, Mr. Benvenuti forwarded his

876information to the College to register for the class, together

886with the required registration fee. The class was scheduled for

896September 29 through October 21, 2003. Notification of his

905acceptance into the c lass was forwarded to Mr. Benvenuti on

916September 2, 2003, by the College.

92212. On August 23, 2003, Mr. Benvenuti filed a completed

932Equivalency of Training Form with the CJSTC. On the Equivalency

942of Training Form, he indicated, among other things, that he was

953seeking certification as a law enforcement officer; that he was

963an inactive Florida officer; and that his prior criminal justice

973employment was with the Oakland Park Police Department, as a law

984enforcement officer from January 17, 1985 to August 20, 19 87.

99513. CJSTC reviewed Mr. Benvenuti's Equivalency Training

1002Form. By letter dated August 25, 2003, CJSTC informed

1011Mr. Benvenuti that, due to a recent change in the law for

1023eligibility, which took effect July 11, 2003, his eight - year

1034break in employment m ade him ineligible for equivalency training

1044and that, therefore, his Equivalency Training Form was denied.

105314. The College was not aware of the change in the law

1065until it was re - contacted by Mr. Benvenuti regarding the denial

1077by CJSTC.

107915. Mr. Benvenuti' s qualifications are not at issue in

1089this matter.

1091CONCLUSIONS OF LAW

109416. The Division of Administrative Hearings has

1101jurisdiction over the subject matter of this proceeding and the

1111parties thereto pursuant to Sections 120.569 and 120.57(1),

1119Florida Statut es (2003).

112317. Mr. Benvenuti has the ultimate burden of proof to

1133establish by a preponderance of the evidence that he is entitled

1144to approval of the Equivalency Form. Florida Department of

1153Transportation v. J.W.C. Company, Inc. , 396 So. 2d 778, 788

1163(Fla. 1st DCA 1981); § 120.57(1), Fla Stat. (2003).

117218. Section 943.13, Florida Statutes (2003), provides the

1180minimum qualifications for a person to be employed or appointed

1190as a law enforcement officer and provides in pertinent part:

1200On or after October 1, 19 84, any person

1209employed or appointed as a full - time, part -

1219time, or auxiliary law enforcement officer

1225or correctional officer; on or after October

12321, 1986, any person employed as a full - time,

1242part - time, or auxiliary correctional

1248probation officer; and on or after October

12551, 1986, any person employed as a full - time,

1265part - time, or auxiliary correctional officer

1272by a private entity under contract to the

1280Department of Corrections, to a county

1286commission, or to the Correctional

1291Privatization Commission shall:

1294* * *

1297(9) Complete a commission - approved basic

1304recruit training program for the applicable

1310criminal justice discipline, unless exempt

1315under this subsection. An applicant who

1321has:

1322(a) Completed a comparable basic recruit

1328training program for the appli cable criminal

1335justice discipline in another state or for

1342the Federal Government; and

1346(b) Served as a full - time sworn officer in

1356another state or for the Federal Government

1363for at least 1 year provided there is no

1372more than an 8 - year break in employment, as

1382measured from the separation date of the

1389most recent qualifying employment to the

1395time a complete application is submitted for

1402an exemption under this section, is exempt

1409in accordance with s. 943.131(2) from

1415completing the commission - approved basic

1421recr uit training program.

1425(emphasis added)

142719. Section 943.131, Florida Statutes (2003), provides in

1435pertinent part:

1437(2) If an applicant seeks an exemption from

1445completing a commission - approved basic

1451recruit training program, the employing

1456agency must veri fy that the applicant has

1464successfully completed a comparable basic

1469recruit training program for the discipline

1475in which the applicant is seeking

1481certification in another state or for the

1488Federal Government. Further, the employing

1493agency must verify that the applicant has

1500served as a full - time sworn officer in

1509another state or for the Federal Government

1516for at least 1 year provided there is no

1525more than an 8 - year break in employment, as

1535measured from the separation date of the

1542most recent qualifying employ ment to the

1549time a complete application is submitted for

1556an exemption under this section. When the

1563employing agency obtains written

1567documentation regarding the applicant's

1571criminal justice experience, the

1575documentation must be submitted to the

1581commission. The commission shall adopt

1586rules that establish criteria and procedures

1592to determine if the applicant is exempt from

1600completing the commission - approved basic

1606recruit training program and, upon making a

1613determination, shall notify the employing

1618agency. A n applicant who is exempt from

1626completing the commission - approved basic

1632recruit training program must demonstrate

1637proficiency in the high - liability areas, as

1645defined by commission rule, and must

1651complete the requirements of s. 943.13(10)

1657within 1 year afte r receiving an exemption.

1665If the proficiencies and requirements of s.

1672943.13(10) are not met within the 1 year,

1680the applicant must complete a commission -

1687approved basic recruit training program, as

1693required by the commission by rule. Except

1700as provided in subsection (1), before the

1707employing agency may employ or appoint the

1714applicant as an officer, the applicant must

1721meet the minimum qualifications described in

1727s. 943.13(1) - (8), and must fulfill the

1735requirements of s. 943.13(10).

174120. T he "8 - year break in employment" in the statutory

1753provisions was a new requirement, and it became effective

1762July 11, 2003. Chapter 2003 - 278, Laws of Florida.

177221. Mr. Benvenuti presented evidence that he is well

1781qualified. However, his qualifications are not at issue in this

1791matter.

179222. The undersigned is convinced that Mr. Benvenuti's

1800strong desire to be re - certified is genuine.

180923. However, Mr. Benvenuti failed to demonstrate that his

1818Equivalency Form should be approved. His Equivalency Form

1826reflects and the evidence shows that he has over an 8 - year break

1840in employment. At the time that he submitted his Equivalency

1850Form, the new statutory provision prohibiting an exemption for

1859over an 8 - year break in service was in effect. Because of the

1873new statutor y provisions, Mr. Benvenuti fails to qualify for

1883exemption from completing a CJSTC - approved basic recruit

1892program.

1893RECOMMENDATION

1894Based on the foregoing Findings of Fact and Conclusions of

1904Law, it is

1907RECOMMENDED that the Florida Department of Law Enforceme nt,

1916Criminal Justice Standards and Training Commission, enter a

1924final order denying approval of Richard A. Benvenuti's

1932Equivalency of Training Out - of - State/Federal Officer Form

1942(CJSTC - 76).
