125STATEMENT OF THE ISSUE
129The issue to be resolved in this proceeding concerns
138whether Joseph M. Pelle, the Petitioner should be issued a
148dental teaching permit in conjunction with his duties as Dean of
159the Jacksonville University Dental School of Orthodontists
166(dental school) in accordance with the authority cited and
175treated below.
177PRELIMINARY STATEMENT
179On May 16, 2003, the Board of Dentistry (Board) denied a
190teac hing permit, applied for by the above - named Petitioner. On
202July 18, 2003, Mr. Pelle filed a Petition for Formal
212Administrative Hearing pursuant to Sections 120.569 and 120.57,
220Florida Statutes (2003). The issue was placed on the Board's
230agenda for recons ideration and, on September 26, 2003, the Board
241declined to reconsider its prior decision. The matter was
250therefore forwarded to the Division of Administrative Hearings
258and the undersigned Administrative Law Judge.
264On November 18, 2003, the Florida Asso ciation of
273Orthodontists, Inc., filed a petition to intervene or in the
283alternative petition for leave to appear as amicus curie . On
294November 26, 2003, the Petitioner filed a written response to
304the motion. On December 10, 2003, an order was entered by t he
317undersigned denying the petition. The cause proceeded to formal
326hearing on December 15, 2003, in Tallahassee, Florida.
334Prior to taking testimony, the parties stipulated to seven
343exhibits as follows: Petitioner's Exhibit One, the teaching
351permit applic ation of Joseph Pelle; Petitioner's Exhibit Two,
360the accreditation standards for advanced specialty education
367programs in orthodontics from the Commission on Dental
375Accreditation; Petitioner's Exhibit Three, an internal listing

408American Dental Association; Petitioner's Exhibit Five, an

481The Petitioner testified on his own behalf. Irene Stavros,
490a member of the Board of Dentistry, testified on be half of the
503Respondent.
504Upon conclusion of the hearing a transcript thereof was
513ordered and the parties elected to submit Proposed Recommended
522Orders. The Proposed Recommended Orders were timely filed and
531have been considered in the rendition of this Re commended Order.
542FINDINGS OF FACT
5451. The Petitioner is Dr. Joseph M. Pelle. His business
555address is 2800 University Boulevard North, Jacksonville
562University, Jacksonville, Florida. The Petitioner is not
569licensed to practice dentistry in Florida, but is licensed in
579three other states. His licensure is current and in good
589standing in those states.
5932. The Respondent is the Florida Board of Dentistry
602(Board). It is an agency of the State of Florida charged with
614regulating the licensure standards and pract ice standards for
623those engaged in the practice of dentistry in all its facets in
635the State of Florida. Its authority includes the authority,
644under the law cited below, to issue teaching permits in limited
655circumstances for professionals engaged in the te aching of
664clinical aspects of dentistry, at accredited institutions,
671offering advanced education to post - graduate dentists in
680Florida.
6813. The Petitioner filed an application for a teaching
690permit pursuant to Section 466.002, Florida Statutes, and
698Florid a Administrative Code Rule 64B5 - 7.005, with the Respondent
709Board. The application is dated March 25, 2003. The teaching
719permit was proposed to be used at the Jacksonville University
729Dental School of Orthodontists in Jacksonville, Florida (Dental
737School). On June 25, 2003, the Board entered an order denying
748the application for the teaching permit.
7544. The Petitioner is the Dean of the Dental School of
765Orthodontics. The Petitioner is not currently licensed as a
774dentist in the State of Florida, but is lice nsed in Texas,
786Pennsylvania, and Ohio with all those licenses being in good
796standing. The Petitioner has practiced orthodontics since 1971,
804and has been the chairman of dental programs at the University
815of Pittsburgh and at West Virginia University. He h as a board
827specialty from the American Board of Orthodontics.
8345. Jacksonville University is a private, non - profit,
843accredited, liberal arts university in Jacksonville, Florida,
850that confers degrees at the undergraduate and graduate levels.
859It also offe rs advanced professional education programs.
8676. The Dental School of Orthodontics offers advanced
875education in orthodontics to post - graduate dentists that have
885already completed their dental program to receive the DMD or DDS
896degree. The dental school cur rently has four full - time faculty,
908eleven part - time faculty, and adjuncts, both outside and inside
919the Jacksonville University. There are fourteen students
926currently enrolled in the program. The advanced program offered
935consists of approximately 3700 hou rs of formal intense
944instruction over a twenty - four month period. The program
954results in conferring a certificate of advanced education in
963orthodontics on successful students.
9677. The Petitioner's duties as Dean of the Dental School of
978Orthodontics, are d ivided between administrative and teaching
986duties. Approximately 75 percent of his duties are attributable
995to administrative matters and 25 percent to teaching. If the
1005teaching permit is issued, the Petitioner will participate in
1014clinical instruction at the Dental School of Orthodontics.
10228. The accreditation body for dental programs in the
1031United States is the Commission on Dental Accreditation of the
1041American Dental Association (the Commission). The Commission is
1049a specialized programmatic accreditin g agency recognized by the
1058United States Department of Education. It conducts all aspects
1067of the accreditation process for the more than 1300 programs for
1078dental, allied dental, and advanced dental education in the
1087Untied States. The accreditation is for the program itself, and
1097not for the sponsoring institution. The Petitioner, on behalf
1106of the Dental School of Orthodontics, applied to the Commission
1116for accreditation and personally participated in the
1123accreditation review process.
11269. The Commission's accreditation standards are set forth
1134in a document entitled "Accreditation Standards for Advanced
1142Specialty Education Programs in Orthodontics and Dentofacial
1149Orthopedics" that was introduced in Petitioner's Exhibit Two in
1158evidence. The accreditation pro cess requires compliance with
1166six standards contained in that document. The standards address
1175institutional commitment and program effectiveness, the program
1182director and teaching staff, the facilities and resources, the
1191curriculum and program duration, t he advanced education student
1200selection, and research. The Commission concluded that the
1208Dental School of Orthodontics is in compliance with all
1217accreditation standards. See Petitioner's Exhibit Four in
1224evidence.
122510. The curriculum for the Dental School was developed in
1235accordance with the self - study guide of the Commission on Dental
1247Accreditation of the American Dental Association.
125311. As a result of the accreditation process and
1262evaluation, the Commission sent a letter dated August 5, 2003,
1272to David L . Harlow, President of Jacksonville University,
1281containing the following passage:
1285The program in orthodontics and dentofacial
1291orthopedics is accredited by the Commission
1297on Dental Accreditation [and has been
1303granted the accreditation status of 'initial
1309acc reditation.'] The Commission is a
1315specialized accrediting body recognized by
1320the United States Department of Education.
1326That letter from the Commission also contains the following
1335passage:
1336Based upon all the information presented,
1342the Commission conclude d that the program is
1350in compliance with the Accreditation
1355Standards, including Standard 1 - 1 regarding
1362financial support from entities outside of
1368the institution. Accordingly, the
1372Commission adopted a resolution changing the
1378accreditation classification o f the
1383educational program from 'preliminary
1387provisional approval' to 'initial
1391accreditation.' No additional information
1395is requested at this time.

140612. Petitioner's Exhibit Three consists of the listing of
1415from the American Dental Association of all Florida programs
1424currently accredited by the Commission. The School of
1432Orthodontics is included on that list.
143813. The Petitioner has never failed the Florida Dental
1447Licensure Examination. The Petitioner is also a f ull - time
1458faculty member at the Dental School of Orthodontics at
1467Jacksonville University. The Petitioner has agreed not to
1475engage in the practice of dentistry pursuant to the teaching
1485permit if it is issued, except under the programs of the Dental
1497School o f Orthodontics.
150114. The Petitioner has also agreed that if the teaching
1511permit is issued, all records pertaining to the teaching
1520practice shall be subject to review and available to the Board
1531of Dentistry. The Petitioner has also agreed that if the
1541teach ing permit is issued, information requested by the Board of
1552Dentistry will be submitted for the purpose of allowing the
1562Board to evaluate compliance with applicable laws regulating the
1571practice of dentistry.
157415. The Petitioner has provided proof of curren t CPR
1584certification to the Board of Dentistry. The Board of Dentistry
1594does not issue or grant accreditation to dental programs in the
1605State of Florida. Rather, the Board defers to the Commission as
1616to its accreditation decisions.
162016. As shown by Respond ent's Composite Exhibit One in
1630evidence (letter of May 12, 2003, from attorney Bruce D. Lamb to
1642the Executive Director of the Board of Dentistry) the Commission
1652voted to discontinue awarding preliminary provisional approval
1659status as to accreditation. Acc ording to that letter the United
1670States Department of Education does not consider preliminary
1678provisional approval to constitute accreditation. In fact, the
1686Commission Communications Update of Fall 2002 indicates that the
1695Commission has a firm policy that a program is strongly
1705encouraged not to enroll students/residents until "initial
1712accreditation" status has been obtained. If a program enrolled
1721students or residents without first having been granted "initial
1730accreditation" status, the Commission will no tify all students
1739or residents enrolled of the possible ramifications of
1747enrollment in a program operating without accreditation. Thus,
1755at least implicitly, the Commission and the U.S. Department of
1765Education considers "initial accreditation" status, conv ersely,
1772to constitute accreditation, at least for purposes of admission
1781of students and residents to such a program.
1789CONCLUSIONS OF LAW
179217. The Division of Administrative Hearings has
1799jurisdiction of the subject matter of and the parties hereto.
1809§§ 120 .569 and 120.57, Fla. Stat. (2003).
181718. The statutory basis for the Respondent's authority to
1826issue teaching permits is found in Section 466.002(6), Florida
1835Statutes, which provides in pertinent part as follows:
1843A full - time dental instructor at a denta l
1853school approved by the board may be allowed
1861to practice dentistry at the teaching
1867facilities of such school, upon receiving a
1874teaching permit issued by the board, in
1881strict compliance with such rules as are
1888adopted by the board pertaining to the
1895teaching permit and with the established
1901rules and procedures of the dental school.
190819. The applicable rule for teaching permits is Florida
1917Administrative Code Rule 64B5 - 7.005. That Rule provides as
1927follows:
1928(1) A teaching permit may be issued by the
1937Board of Dentistry to a faculty member of a
1946dental school accredited by the Commission
1952on Dental Accreditation of the American
1958Dental Association or a medical school
1964accredited by the American Medical
1969Association's Liaison Committee for Medical
1974Education upon the request of the dean of
1982the school if the faculty member:
1988(a) Has not failed the Florida dental
1995licensure examination; and
1998(b) Is a full - time faculty member; and
2007(c) Does not engage in the practice of
2015dentistry except under the programs of the
2022dental or medical school described in
2028subsection 64B5 - 7.005(1), F.A.C.
2033The Rule proceeds on to set forth the conditions under which the
2045permit authorizes the holder to practice dentistry. These
2053conditions include the following:
2057(a) All records pertaining to th e teaching
2065practice shall be subject to review and
2072available to the Board.
2076(b) Upon the Board's request, the permit
2083holder shall submit any information the
2089Board deems necessary to evaluate compliance
2095with Chapters 456 and 466, Florida Statutes,
2102and Chap ter 64B5, F.A.C.
2107(c) Permits shall be in effect only as long
2116as the holder is a full - time faculty member
2126of the College of Dentistry or School of
2134Medicine and shall be automatically
2139cancelled and nullified by termination of
2145the holder as a faculty member of the
2153teaching facility or failure of the Florida
2160dental licensure examination.
2163(d) Teaching permits are subject to
2169cancellation or revocation by the Board for
2176failure to comply with Chapters 456 and 466,
2184F.S. and Chapter 64B5, F.A.C.
2189Fla. Admin. Code . R. 64B5 - 7.005(3). In addition to the
2201foregoing conditions and requirements, proof of current CPR
2209certification must be obtained and maintained while the teaching
2218permit is in effect. Fla. Admin. Code. R. 64B5 - 7.005(4).
222920. The disputed issue concerns whether the Dental School
2238of Orthodontics is accredited by the Commission as required by
2248the applicable rules quoted above. There is no dispute that the
2259Petitioner has met all of the other requirements for issuance of
2270the teaching permit. He has agreed to use the teaching permit
2281in accordance with the terms and conditions of the Board's
2291rules, and has further agreed to make available and provide the
2302information required under those rules.
230721. The rules do not define what is meant by the term
"2319accredite d." The Respondent did not present any testimony or
2329evidence concerning this term or definition. Rather the
2337testimony presented by the Respondent makes clear that the Board
2347is not an accrediting body and that it accepts the
2357determinations of the Commissi on. The evidence adduced by the
2367Respondent in testimony, does not establish a policy basis by
2377the Board for any definition of what is meant by the term
"2389accredited."
239022. Based upon the evidence submitted by the Petitioner,
2399the Dental School of Orthodont ics has met all of the
2410requirements of the Commission for accreditation. It is listed
2419on the master list of accredited programs in the State of
2430Florida. The Commission has unequivocally stated that the
2438Dental School of Orthodontics is in compliance with
2446accreditation standards and is an accredited program. The
2454preponderant weight of the evidence, culminating in the above
2463Findings of Fact demonstrates that indeed the status "initial
2472accreditation" constitutes accreditation for purposes of the
2479Commission's accreditation standards, and the acceptance of
2486students and/or residents in such programs as being acceptance
2495into an accredited program. The Dental School is thus
2504established to be an accredited program for purposes of the
2514application of Section 466.002 (6), Florida Statutes, and Florida
2523Administrative Code Rule 64B5 - 7.005. Inasmuch, as all
2532requirements for issuance of a teaching permit by the Board have
2543been met, the teaching permit should be granted to the
2553Petitioner.
2554RECOMMENDATION
2555Having considered t he foregoing Findings of Fact,
2563Conclusions of Law, the evidence of record, the candor and
2573demeanor of the witnesses, and the pleadings and arguments of
2583the parties it is, therefore,
2588RECOMMENDED that the Respondent enter a Final Order
2596determining that the Petitioner is in compliance with the above -
2607referenced statute and Rule, relating to the issuance of a
2617teaching permit and that the application of the Petitioner for
2627the teaching permit at issue be granted.
