136STATEMENT OF THE ISSUE

140The issue in this case is whether Respondent properly

149reclassified Petitioner's employment position from Career

155Service status to Selected Exempt Se rvice status.

163PRELIMINARY STATEMENT

165On July 29, 2003, Respondent advised Petitioner that his

174position of employment with the State of Florida was being

184reclassified from Career Service status to Selected Exempt

192Service status in accordance with the Servi ce First initiative

202Chapter 2001 - 43, Laws of Florida. Petitioner timely filed a

213petition challenging the reclassification, and a final hearing

221was held before the undersigned on February 3, 2004, in Tampa,

232Florida.

233At final hearing, Petitioner appeared pr o se and testified

243on his own behalf. Petitioner introduced Composite Exhibit 1

252which was received into evidence. Respondent presented the

260testimony of Patty Roberts, Roseann Liriano, Nancy Levy, and

269James Saxon. Respondent introduced Composite Exhibits 1

276through 6 which were received into evidence. The one - volume

287Transcript of the final hearing was filed with DOAH on March 16,

2992004. Respondent timely filed its terse proposed recommended

307order on March 16, 2004, which was carefully considered.

316FINDING S OF FACT

3201. In 2001, the Florida Legislature enacted a substantial

329revision to Florida's civil service system commonly referred to

338as the "Service First" initiative. See Ch. 2001 - 43, Laws

349of Fla. Among the significant changes, the revision redefined

358t he parameters of the Selected Exempt Service classification for

368public employees. In essence, the Selected Exempt Service

376classification was expanded to include most of the supervisory

385level employee classifications which had previously been

392identified as part of the Career Service classification.

4002. The statutory changes brought about by the Service

409First initiative became effective on May 14, 2001. Id. at 15.

4203. Petitioner was employed under the Career Service

428classification by the Department of Chi ldren and Family Services

438since 1990, and served as a Public Assistance Specialist

447Supervisor, position number 64817, in the Suncoast Region.

4554. In light of Section 110.25(2)(x), Florida Statutes

463(2003), Respondent reclassified Petitioner's Career Servi ce

470position to Selected Exempt Service status in July 2003.

4795. Petitioner's Career Service position description

485remained unchanged when it was reclassified to Select Exempt

494Service status. The position description specifically

500identifies supervisory res ponsibilities and states:

506Duties and Responsibilities: This is a

512professional position primarily responsible

516for the supervision of a public assistance

523unit for determining the initial and ongoing

530eligibility of applicants for programs such

536as Food Stamps , Medicaid, ICP, OSS, Waiver,

543etc.

5446. More specifically, pursuant to the written position

552description, the Public Assistance Specialist Supervisor is

559required to "supervise the appointment and case management

567system" to ensure that subordinates are cor rectly processing

576applications. The position is responsible for evaluating all

584scheduled work and appropriately reassigning work.

5907. In addition, pursuant to the position description, the

599supervisor shall analyze work reports provided by subordinate

607em ployees, educate staff, schedule case reviews with supervised

616employees, and conduct monthly conferences with each employee.

624The supervisor is obligated to review their performance,

632identify their strengths and weaknesses, and provide supervisory

640assistan ce in achieving acceptable standards. The supervisor is

649required to prepare written evaluations, conduct staff meetings,

657and develop in - service training for under achieving employees.

6678. Petitioner's actual duties and work - load were

676consistent wit h the written position description. Petitioner

684interviewed applicants and recommended candidates for job

691vacancies in his area. He supervised subordinates, recommended

699and levied appropriate corrective action, and organized and

707distributed work. Petitio ner set organizational goals,

714motivated employees, trained and developed their technical

721skills, resolved employee problems, and implemented performance

728and quality control standards.

7329. Petitioner was responsible for ensuring that the staff

741assigned to him maintained at least a 90 percent accuracy rate

752on case reviews processed and a 96 percent processing rate on

763unit assigned client applications.

76710. Petitioner admits that his supervisory duties consumed

775most of his time. He acknowledges that clien t interviews were

786not part of his normal duties and concedes that he regularly

797supervised employees, provided feedback to employees, and

804performed evaluations. In addition, he agrees that his

812recommendations regarding discipline were usually followed.

81811. Petitioner routinely led staff meetings with his

826subordinates and frequently met with them individually. He

834controlled work - flow and made changes as he deemed appropriate

845within his department. Petitioner admits that he functioned as

854the supervisor in an area that was distinct and separate from

865the other units.

86812. The evidence presented at hearing establishes that

876Petitioner's written and actual duties were supervisory in

884nature, and he spent the majority of his time performing those

895duties.

896CONCLUSIONS OF LAW

89913. The Division of Administrative Hearings has

906jurisdiction over the parties to and the subject matter of these

917proceedings pursuant to Sections 120.569 and 120.57(1), Florida

925Statutes (2003).

92714. Although neither party addressed the issue of burden

936of proof, Respondent is seeking to change Petitioner's existing

945status quo and reclassify his employment position from Career

954Service status to Selected Exempt Service status. Hence,

962Respondent has the burden of proving its claim by a

972pre ponderance of the evidence. See Florida Department of

981Transportation v. J.W.C. Co., Inc. , 396 So. 2d 778, 788 (Fla.

9921st DCA 1981); The Board of Trustees of the Northwest Florida

1003Community Hospital v. Department of Management Services , 651

1011So. 2d 170 (Fla. 1st DCA 1995)(" In accordance with the general

1023rule, applicable in court proceedings, 'the burden of proof,

1032apart from statute, is on the party asserting the affirmative of

1043an issue before an administrative tribunal.'"); Balino v.

1052Department of Health and Rehabilitative Services , 348 So. 2d 349

1062(Fla. 1st DCA 1977); § 120.57(1)(j), Fla. Stat. (2002)("Findings

1072of fact shall be based upon a preponderance of the evidence,

1083except in penal or licensure disciplinary proceedings or except

1092as otherwise provided by s tatute, and shall be based exclusively

1103on the evidence of record and on matters officially

1112recognized.").

111415. Pursuant to Subsection 110.205(2)(x), Florida Statutes

1121(2003), employees exempt from Career Service status include:

1129supe rvisory employees who s pend the majority

1137of their time communicating with,

1142motivating, training, and evaluating

1146employees, and planning and directing

1151employees' work, and who have the authority

1158to hire, transfer, suspend, lay off, recall,

1165promote, discharge, assign, reward, or

1170d iscipline subordinate employees or

1175effectively recommend such action, including

1180all employees serving as supervisors,

1185administrators, and directors.

118816. Respondent sufficiently proved that Petitioner spent

1195the majority of his time motivating, training, evaluating, and

1204directing employees' work. Furthermore, Respondent adequately

1210demonstrated that Petitioner had the authority to hire and

1219discipline subordinate employees or effectively recommend such

1226action. Based upon the evidence, Respondent properly

1233transferred Petitioner's Career Service position of Public

1240Assistance Specialist Supervisor to the Selected Exempt Service

1248status.

124917. While Petitioner seemed to suggest that the Florida

1258Legislature lacked the authority to unilaterally, retroactively,

1265and statutorily rescind his existing property right of

1273employment within a protected class, the undersigned does not

1282have the jurisdiction to determine the constitutionality of the

1291statute.

1292RECOMMENDATION

1293Based on the foregoing Findings of Fact and Conclusion s of

1304Law, it is

1307RECOMMENDED that Respondent enter a final order approving

1315Petitioner's reclassification.
