124STATEMENT OF THE ISSUE

128Whether the Petitioner's position o f employment with the

137Respondent was properly reclassified from Career Service to

145Selected Exempt status.

148PRELIMINARY STATEMENT

150In a letter dated July 21, 2003, Marie - Michelle Edouard was

162notified that she had the right to request an agency review of

174the d ecision to reclassify her position of employment with the

185Department of Health ("Department") from a Career Service System

196position to a Selected Exempt Service position. 1 Dr. Edouard

206timely filed a Petition with the Department requesting a

215hearing. The Department forwarded the matter to the Division of

225Administrative Hearings for the assignment of an administrative

233law judge. Pursuant to notice, the final hearing in this case

244was held on February 4, 2004.

250At the hearing, the Department presented the tes timony of

260Mary Jo Trepka, M.D.; Yukosava Petrovic; Hilda Ortiz; and Juan

270Carlos Santana. Respondent's Exhibits 1 through 5 were offered

279and received into evidence. Dr. Edouard testified in her own

289behalf, and Petitioner's Exhibit 1 was received into evid ence.

299The one - volume transcript of the proceedings was filed with

310the Division of Administrative Hearings on March 8, 2004. The

320Department requested and was granted an extension of time to

330file proposed findings of fact and conclusions of law, and the

341Dep artment timely filed its proposed findings of fact and

351conclusions of law, which have been considered in the

360preparation of this Recommended Order; Dr. Edouard did not file

370a post - hearing submittal.

375FINDINGS OF FACT

378Based on the oral and documentary evide nce presented at the

389final hearing and on the entire record of this proceeding, the

400following findings of fact are made:

4061. Dr. Edouard is a physician who was employed by the

417Department as the Senior Human Services Program Manager for the

427Miami - Dade Count y Childhood Lead Poisoning Prevention Program.

437This program operates under a grant from the federal Centers for

448Disease Control, and Dr. Edouard worked out of the Epidemiology

458and Disease Control Department of the Miami - Dade County Health

469Department.

4702. Prior to July 2001, Dr. Edouard's position was

479classified as a Career Service System position.

4863. As Senior Human Services Program Manager, Dr. Edouard

495supervised a staff of four to five persons, including an

505epidemiologist, an environmental specialist, a nurse, and a

513secretary specialist, and she spent the majority of her time

523supervising these employees: Dr. Edouard prepared the work

531assignments for her staff; trained the members of her staff;

541monitored the progress of the staff members in completing th eir

552assignments; prepared evaluations for each staff member and made

561recommendations for improvement; approved or disapproved

567requests for leave; had the authority to recommend members of

577her staff for disciplinary action; had the authority to

586recommend sa lary increases and/or to recommend promotion for

595members of her staff; and prepared the budget for her program

606grant.

6074. Dr. Edouard was considered by her supervisor to be a

618very creative, hardworking, dedicated healthcare professional

624who established Mia mi - Dade County's Childhood Lead Poisoning

634Prevention Program.

6365. In July 2001, Dr. Edouard's position was reclassified

645from a Career Service System position to a Selected Exempt

655Service position because the position included substantial

662supervisory respon sibilities. After the reclassification, the

669formal job description for the Senior Human Services Program

678Manager position remained the same in all material respects as

688the job description for the Career Service System position.

6976. Dr. Edouard was termina ted from her position several

707months after it was reclassified.

7127. At the time Dr. Edouard's position was reclassified

721from a Career Service System position to a Selected Exempt

731Service position, there were other supervisory employees of the

740Epidemiology and Disease Control Department of the Miami - Dade

750County Health Department whose positions were not reclassified

758but remained Career Service System positions. These employees

766were registered nurses serving as nursing program specialists.

774CONCLUSIONS OF LAW

7778. The Division of Administrative Hearings has

784jurisdiction over the subject matter of this proceeding and of

794the parties thereto pursuant to Sections 120.569 and 120.57(1),

803Florida Statutes (2004).

8069. The Department, as the party whose action changed the

816status quo, has the burden of proving by a preponderance of the

828evidence that Dr. Edouard's position was appropriately

835reclassified from a Career Service System position to a Selected

845Exempt Service position. See Board of Trustees of the N.W.

855Florida Community Hosp. v. Department of Management Servs., Div.

864of Retirement , 651 So. 2d 170, 172 (Fla. 1st DCA 1995)( hearing

876officer correctly determined that employer's decision to treat

884Brown as an independent contractor established status quo and

893that Divisi on of Retirement had burden to demonstrate that Brown

904was in fact an employee)(citing Florida Dep't of Transp. v.

914J.W.C. Co., Inc. , 396 So.2d 778, 788 (Fla. 1st DCA 1981)(" In

926accordance with the general rule, applicable in court

934proceedings, 'the burden of proof, apart from statute, is on the

945party asserting the affirmative of an issue before an

954administrative tribunal.'").

95710. Section 110.205, Florida Statutes (2001), provides in

965pertinent part:

967(1) CAREER POSITIONS. -- The career service

974to which this par t applies includes all

982positions not specifically exempted by this

988part, any other provisions of the Florida

995Statutes to the contrary notwithstanding.

1000(2) EXEMPT POSITIONS. -- The exempt positions

1007that are not covered by this part include

1015the following

1017* * *

1020(x) Managerial employees, as defined in

1026s. 447.203(4), confidential employees, as

1031defined in s. 447.203(5), and supervisory

1037employees who spend the majority of their

1044time communicating with, motivating,

1048training, and evaluating employees, and

1053plannin g and directing employees' work, and

1060who have the authority to hire, transfer,

1067suspend, lay off, recall, promote,

1072discharge, assign, reward, or discipline

1077subordinate employees or effectively

1081recommend such action, including all

1086employees serving as superv isors,

1091administrators, and directors. Excluded are

1096employees also designated as special risk or

1103special risk administrative support and

1108attorneys who serve as administrative law

1114judges pursuant to s. 120.65 or for hearings

1122conducted pursuant to s. 120.57( 1)(a).

1128Additionally, registered nurses licensed

1132under chapter 464, dentists licensed under

1138chapter 466, psychologists licensed under

1143chapter 490 or chapter 491, nutritionists or

1150dietitians licensed under part X of chapter

1157468, pharmacists licensed under c hapter 465,

1164psychological specialists licensed under

1168chapter 491, physical therapists licensed

1173under chapter 486, and speech therapists

1179licensed under part I of chapter 468 are

1187excluded, unless otherwise collectively

1191bargained.

119211. Based on the findings of fact herein, the Department

1202has proven by a preponderance of the evidence that Dr. Edouard's

1213position as the Senior Human Services Program Manager for the

1223Miami - Dade County Childhood Lead Poisoning Prevention Program

1232included supervisory functions, as d efined in

1239Section 110.205(2)(x), Florida Statutes (2001), and that

1246Dr. Edouard actually engaged in supervisory activities during

1254the majority of the time she spent on the job.

126412. Dr. Edouard's complaint that nurses in the

1272Epidemiology and Disease Control Department of the Miami - Dade

1282County Health Department cannot be addressed in this

1290administrative forum. The exclusion of registered nurses from

1298the category of managerial, confidential, and supervisory

1305employees is included in Section 110.205(2)(x), Flor ida Statutes

1314(2001), and this statutory exclusion can only be changed by

1324legislative action.

1326RECOMMENDATION

1327Based on the foregoing Findings of Fact and Conclusions of

1337Law, it is RECOMMENDED that the decision to reclassify the

1347position of employment with t he Department of Health formerly

1357held by Marie - Michelle Edouard be sustained.
