104STATEMENT OF THE ISSUE
108Whether the Agency should register the Petitioner as a
117septic tank contractor?
120PRELIMINARY STATEMENT
122The Petitioner applied for registration as a septic tank
131contract or. The Department of Health advised the Petitioner by
141letter of its intent to deny his application because of various
152problems with the application and his qualifications. This
160letter advised the Petitioner of his right to an administrative
170hearing on t he denial of his application and the Petitioner
181requested a hearing. The Department forwarded the matter to the
191Division of Administrative Hearings on or about December 18,
2002003. The case was set for hearing for February 17, 2004, by a
213Notice of Hearing dated January 9, 2004. Thereafter, an amended
223notice was issued on January 22, 2004, continuing the case until
234February 25, 2004. The case was heard as noticed, except that
245the undersigned was assigned to hear the case for Judge Don W.
257Davis, who was una ble to travel because of illness.
267The Department of Health called Robert J. Kuhn and Robert
277A. Knott to testify. The Petitioner testified in his own
287behalf. The parties stipulated to the introduction of the
296letter of denial dated October 7, 2003, as Exhi bit 9, and to the
310authenticity of Exhibits 1 through 6, and 8. These exhibits and
321Exhibit 7 were received into the record.
328Both parties submitted proposed findings that were read and
337considered.
338FINDINGS OF FACT
3411. The Petitioner, Ronald Burkett, appl ied for
349registration has a septic tank contractor to the Department of
359Health, the regulatory and permitting authority.
3652. The Department noticed the Petitioner by letter of its
375intent to deny his application for various grounds and that he
386had a right to a formal hearing. The Petitioner made a timely
398request for a formal hearing and these proceedings ensued.
4073. The application filed by the Petitioner was filled out
417by his now ex - wife, Susan Burkett, who had previously been a
430licensed septic tank contra ctor and the Petitioner's employer.
439The couple did business in the name of Working Man Septic Tank
451(Working Man). Susan Burkett filed out the application because
460the Petitioner does not read or write.
4674. The Petitioner as the employee of Working Man i nstalled
478a septic tank without a license under a complex set of
489circumstances in which the property owner, employees of the
498Department of Health and the Petitioner sought to eliminate a
508serious health problem at a rental property. The existing
517septic syst em had failed and raw sewage was on the ground in the
531yard of single family residence which was being rented. The
541Department of Health sought to eliminate the nuisance. The
550Petitioner undertook to fix the system, submitted an
558application, and commenced w ork. Thereafter, it was determined
567that public sewer service was available, and this precluded
576issuance of the permit to repair the septic system.
5855. There is conflicting testimony about what occurred
593next; however, based upon the testimony of all the wi tnesses,
604the Petitioner left the tank he had installed in the ground; the
616owner hooked up the system; and the problems were eliminated.
626However, Susan Burkett received a warning letter from the
635Department of Health for having commenced the work without th e
646permit.
6476. In 1994, the Petitioner was disciplined for septic tank
657contracting without a license, for installing septic tanks
665without a permit, and for substandard work in contracting.
6747. In 2003, Burkett repaired and replaced a distribution
683box at 638 Lakewood Road without a permit or an inspection which
695resulted in his now ex - wife, Susan Burkett, receiving a fine of
708$1,000, as the responsible contractor.
7148. Complaint SC 0752 alleges that U.S.A. Septic abandoned
723its contract and failed to fully perfor m a repair. Ron Burkett
735received checks in the amount of $3,500, which were negotiated
746in due course.
7499. Profit and Loss Statements which were part of tax
759documents submitted with the Petitioner's application indicated
766that they were for Ron's Septic T ank Service and Ronald E.
778Burkett. However, these statements were prepared in error by
787the Petitioner's accountants who subsequently supplied corrected
794documents showing the Petitioner's business name to be U.S.A.
803Septic Tank Co. and Ronald E. Burkett, Pr oprietor. Ron's Septic
814Tank Service is an unrelated septic contracting company owned
823and operated by another individual. This appears to have been a
834scrivener's error by the accountant which was corrected.
842However, the corrected documents are at odds wi th the business
853organization which supposedly existed, that is, U.S.A. Septic
861Tank Co., operated by Susan Burkett. At a minimum, the
871activities of U.S.A. Septic Tank Co. cannot be separated from
881the Petitioner's activities, and the Petitioner cannot divor ce
890himself from misfeasance and malfeasance of that company or
899other companies which he worked for as an employee of his wife.
91110. The Construction Industry Certificate of Exemption
918from Florida Workers' Compensation Law filed with the
926application had ha d the expiration date altered. While the
936Petitioner may not have been responsible for the alteration, his
946application was facially deficient by failing to have a current
956exemption certificate.
958CONCLUSIONS OF LAW
96111. The Division of Administrative Hear ings has
969jurisdiction over parties and subject matter in this case
978pursuant to Section 120.569, Florida Statutes.
98412. Because this is an application case, the Petitioner
993has the burden of proof to establish that his application is
1004facially sufficient. The burden is by a preponderance of the
1014evidence. See Section 120.57(1)(j), Florida Statutes.
102013. The application is not facially sufficient because it
1029lacks a current workmans' compensation exemption certificate.
1036The error on the Profit and Loss Sta tement was corrected by the
1049accountant, and it is sufficient to meet the application's
1058requirements.
105914. The Department has put forth affirmative grounds for
1068denying the license. The Department has the burden to prove
1078these allegations by a preponderanc e of the evidence. The
1088Department showed that two predecessor septic tank contracting
1096companies with which the Petitioner was intimately associated
1104either as owner and operator or as the employee and husband of
1116the "owner" and "operator" have been discipl ined for being
1126unlicensed, doing work without the required permits, and doing
1135substandard work. Although there are substantial mitigating
1142factors regarding one of the allegations, notwithstanding the
1150name changes and changes in the licensee, the Petitione r has
1161been involved in unlicensed contracting for over a period of
1171nearly ten years.
117415. Section 489.553, Florida Statutes, requires in
1181pertinent part that the individual applying for registration be
1190of good moral character. The statute states that in considering
1200good moral character, the Department may consider any matter
1209that has a substantial connection with the professional
1217responsibilities of a registered contractor. Unlicensed
1223contracting and contracting without the required permits are the
1232type s of violations which can be considered.
124016. The Department showed good cause to deny the
1249registration of the Petitioner for lack of good character.
1258RECOMMENDATION
1259Based upon the foregoing Findings of Fact and Conclusions
1268of Law set forth herein, it is
1275RECOMMENDED:
1276That the Department of Health deny the Petitioner's
1284application for registration as a septic tank contractor.
