107STATEMENT OF THE ISSUES

111The issues are whether Petitioner's employment as a

119substitute teacher is creditable ser vice under the Florida

128Retirement System, entitling her to retirement benefits and

136whether she may purchase retirement credit for out - of - state and

149federal service prior to vesting.

154PRELIMINARY STATEMENT

156By letter dated August 19, 2003, Respondent Departme nt of

166Management Services, Division of Retirement (Respondent) advised

173Petitioner Carolyn Johnson - Rollins (Petitioner) that she was

182ineligible for benefits under the Florida Retirement System.

190Petitioner subsequently requested an administrative hearing to

197challenge Respondent's decision.

200In a Notice of Hearing dated November 6, 2003, the

210undersigned scheduled the hearing for December 22, 2003. During

219the hearing, Petitioner testified on her own behalf and offered

229nine exhibits that were accepted into t he record as evidence.

240Respondent did not present any witnesses but offered the

249deposition of Doug Cherry, with attached exhibits, which was

258accepted as testimony in lieu of live testimony at hearing.

268The parties did not file a copy of the hearing tran script.

280Respondent filed a Proposed Recommended Order on December 30,

2892003. Petitioner has not made a post - hearing submission as of

301the date of issuance of this Recommended Order.

309FINDINGS OF FACT

3121. Petitioner, aged 53, applied for retirement benefits

320from the Florida Retirement System (FRS) on October 20, 2003.

3302. Petitioner has 4.53 years of creditable service with

339the FRS due to her employment as a full - time teacher with the

353Alachua County School Board (School Board). She worked for the

363School Board from sometime in the early 1970s through May 1977.

3743. In May 1977, Petitioner terminated her employment with

383the School Board. She then joined the military, serving four

393years of active duty.

3974. After completing her military service in 1981,

405P etitioner worked out of state as a civil service employee with

417the Federal government. She also worked for a period of time in

429the private sector.

4325. In the 1990s, Petitioner returned to Alachua County,

441Florida. She worked as a substitute teacher for th e School

452Board for approximately four years, from November 21, 1999

461through February 14, 2002.

4656. Before beginning her employment as a substitute

473teacher/temporary employee in 1999, Petitioner signed a document

481entitled "Acknowledgement of FRS Status an d Alternative Plan."

490This document clearly advised Petitioner that her employment as

499a substitute teacher was not covered under FRS.

5077. Petitioner was not employed by a participating employer

516in a regularly established position on July 1, 2001. She ne eds

528an additional 1.47 years of credible service in order to vest in

540FRS with six years of credible service.

547CONCLUSIONS OF LAW

5508. The Division of Administrative Hearings has

557jurisdiction over the parties and the subject matter of this

567proceeding pursua nt to Sections 120.569 and 120.57(1), Florida

576Statutes (2003).

5789. Petitioner has the burden of proving by a preponderance

588of the evidence that she is entitled to benefits under FRS.

599Department of Transportation v. J.W.C. Co. Inc. , 396 So. 2d 778

610(Fla. 1s t DCA 1981); Agrico Chemical Co. v. Department of

621Environmental Regulation , 365 So. 2d 759 (Fla. 1st DCA 1978).

63110. Section 121.021(45), Florida Statutes (2003), provides

638as follows in pertinent part:

643(45)(a) "Vested" or "vesting" means the

649guarantee that a member is eligible to

656receive a future retirement benefit upon

662completion of the required years of

668creditable service for the employee's class

674of membership, even though the member may

681have terminated covered employment before

686reaching normal or ea rly retirement date.

693Being vested does not entitle a member to a

702disability benefit. Provisions governing

706entitlement to disability benefits are set

712forth under Section 121.091(4).

716(b) Effective July 1, 2001, a 6 - year

725vesting requirement shall be imple mented for

732the defined benefit program of the Florida

739Retirement System. Pursuant thereto:

743* * *

7462. Any member not employed in a regularly

754established position on July 1, 2001, shall

761be deemed vested upon completion of 6 years

769of creditable service, p rovided that such

776member is employed in a covered position for

784at least 1 work year after July 1, 2001.

793However, no member shall be required to

800complete more years of creditable service

806than would have been required for that

813member to vest under retiremen t laws in

821effect before July 1, 2001.

82611. Section 121.1115, Florida Statutes, provides as

833follows in relevant part:

837121.1115 Purchase of retirement credit for

843out - of - state and federal service. -- Effective

853January 1, 1995, a member of the Florida

861Retir ement System may purchase creditable

867service for period of public employment in

874another state and receive creditable service

880for such periods of employment. Service

886with the Federal government, including any

892military service, may be claimed. Upon

898complet ion of each year of service earned

906under the Florida Retirement System, a

912member may purchase up to one year of

920retirement credit for his or her

926out - of - state service subject to the

935following provisions:

937(1) LIMITATIONS AND CONDITIONS. -- To receive

944cred it for the out - of - state service:

957(b) The member must have completed a

964minimum of 6 years of creditable service

971under the Florida Retirement System,

976excluding out - of - state service and in - state

987service claimed and purchased under

992section 121.1122 .

99512. Florida Administrative Code Rule 60S - 1.004(5) provides

1004as follows in relevant part:

1009(5) An employee who is filling a temporary

1017position shall not be eligible for

1023membership in the Florida Retirement System.

1029. . . An employer employing a perso n in a

1040temporary position shall advise the employee

1046at the time of his employment that he is

1055filling a temporary position and cannot

1061participate in the Florida Retirement System

1067or claim this temporary employment later for

1074retirement purposes.

1079(b ) A temporary position in a local agency

1088is:

1089* * *

10922. An employment position which is listed

1099below in (d) regardless of whether it will

1107exist beyond 6 consecutive months.

1112* * *

1115(d) The following types of positions in a

1123local agency are considered temporary

1128positions for retirement purposes. . . .

11384. Substitute Teacher Positions (positions

1143filled by persons not on contract called to

1151work intermittently to substitute.)

115513. In this case, Petitioner has not met her burden. She

1166has 4.53 ye ars of creditable service in the FRS. She needs to

1179work in a covered position for an additional 1.47 years in order

1191to vest in FRS with six years of creditable. Only then will she

1204be eligible to purchase her out - of - state and/or military

1216service.

1217RECOMM ENDATION

1219Based on the foregoing Findings of Fact and Conclusions of

1229Law, it is

1232RECOMMENDED:

1233That Respondent enter a final order finding that Petitioner

1242is not entitled to FRS benefits.
