169PRELIMINARY STATEMENT

171On February 2, 2004, Tammy Lea Albritton and Douglas Edward

181Albritton, on behalf of and as parents and natural guardians of

192Elizabeth Nicole Albritton (Elizabeth), a minor, filed a

200petition (claim) with the Division of Administrative Hearings

208(DOAH) for compe nsation under the Florida Birth - Related

218Neurological Injury Compensation Plan (Plan).

223DOAH served the Florida Birth - Related Neurological Injury

232Compensation Association (NICA) with a copy of the claim on

242February 4, 2004, and on April 20, 2004, NICA gave notice that

254it was of the view that the infant did not suffer a "birth -

268related neurological injury" as defined by Section 766.302(2),

276Florida Statutes, and requested that a hearing be scheduled to

286address the issue of compensability. Such a hearing was

295i nitially scheduled for September 9 and 10, 2004, but at

306Petitioners' request was re - scheduled for October 28 and 29,

3172004.

318At hearing, Petitioners' Exhibit 1 and Respondent's

325Exhibits A - I were received into evidence. No witnesses were

336called, and no fur ther exhibits were offered.

344The transcript of the hearing was filed November 30, 2004,

354and the parties were accorded 10 days from that date to file

366proposed orders. Respondent elected to file such a proposal on

376December 2, 2004, and by filing of Decembe r 9, 2004, Petitioners

388gave "notice of their election not to file a proposed order in

400this matter, inasmuch as the proposed final order of the

410Respondent accurately sets forth the testimony in this matter."

419The parties' filings have been duly considered.

426FINDINGS OF FACT

429Preliminary findings

4311. Tammy Lea Albritton and Douglas Edward Albritton are

440the natural parents and guardians of Elizabeth Nicole Albritton,

449a minor. Elizabeth was born a live infant on December 10, 2001,

461at Central Florida Regional H ospital, a hospital located in

471Sanford, Florida, and her birth weight exceeded 2,500 grams.

4812. Obstetrical services were provided at Elizabeth's birth

489by Ca'sha L. Archer, C.N.M., who was supervised by

498Christopher Quinsey, M.D. At the time, both Certifie d Nurse

508Midwife Archer and Doctor Quinsey were "participating

515physicians," as that term is used in the Plan. § 766.314(4)(c),

526Fla. Stat.

528Coverage under the Plan

5323. Pertinent to this case, coverage is afforded by the

542Plan for infants who suffer a "birth - related neurological

552injury," defined as an "injury to the brain or spinal cord . . .

566caused by oxygen deprivation or mechanical injury occurring in

575the course of labor, delivery, or resuscitation in the immediate

585postdelivery period in a hospital, which r enders the infant

595permanently and substantially mentally and physically impaired."

602§ 766.302(2), Fla. Stat. See also §§ 766.309 and 766.31, Fla.

613Stat.

6144. Here, the medical records and the results of various

624neurological examinations demonstrate that El izabeth, who

631presents with a diagnosis of cerebral palsy, is permanently and

641substantially physically impaired; however, mentally, Elizabeth

647was not similarly affected or, stated otherwise, she is not

657permanently and substantially mentally impaired. Conse quently,

664for reasons appearing more fully in the Conclusions of Law, the

675claim is not compensable, and it is unnecessary to resolve

685whether Elizabeth's cerebral palsy resulted from brain injury

693caused by birth trauma (oxygen deprivation or mechanical injur y)

703or whether it was developmentally based.

709CONCLUSIONS OF LAW

7125. The Division of Administrative Hearings has

719jurisdiction over the parties to, and the subject matter of,

729these proceedings. § 766.301, et seq ., Fla. Stat.

7386. The Florida Birth - Related Neu rological Injury

747Compensation Plan was established by the Legislature "for the

756purpose of providing compensation, irrespective of fault, for

764birth - related neurological injury claims" relating to births

773occurring on or after January 1, 1989. § 766.303(1), Fla. Stat.

7847. The injured "infant, her or his personal

792representative, parents, dependents, and next of kin," may seek

801compensation under the Plan by filing a claim for compensation

811with the Division of Administrative Hearings. §§ 766.302(3),

819766.303(2), 766.305(1), and 766.313, Fla. Stat. The Florida

827Birth - Related Neurological Injury Compensation Association,

834which administers the Plan, has "45 days from the date of

845service of a complete claim . . . in which to file a response to

860the petition and to sub mit relevant written information relating

870to the issue of whether the injury is a birth - related

882neurological injury." § 766.305(3), Fla. Stat.

8888. If NICA determines that the injury alleged in a claim

899is a compensable birth - related neurological injury, it may award

910compensation to the claimant, provided that the award is

919approved by the administrative law judge to whom the claim has

930been assigned. § 766.305(6), Fla. Stat. If, on the other hand,

941NICA disputes the claim, as it has in the instant case, the

953dispute must be resolved by the assigned administrative law

962judge in accordance with the provisions of C hapter 120, F lorida

974Statutes. §§ 766.304, 766.309, and 766.31, Fla. Stat.

9829. In discharging this responsibility, the administrative

989law judge must mak e the following determination based upon the

1000available evidence:

1002(a) Whether the injury claimed is a

1009birth - related neurological injury. If the

1016claimant has demonstrated, to the

1021satisfaction of the administrative law

1026judge, that the infant has sustained a brain

1034or spinal cord injury caused by oxygen

1041deprivation or mechanical injury and that

1047the infant was thereby rendered permanently

1053and substantially mentally and physically

1058impaired, a rebuttable presumption shall

1063arise that the injury is a birth - relate d

1073neurological injury as defined in s.

1079766.303(2).

1080(b) Whether obstetrical services were

1085delivered by a participating physician in

1091the course of labor, delivery, or

1097resuscitation in the immediate post - delivery

1104period in a hospital; or by a certified

1112nu rse midwife in a teaching hospital

1119supervised by a participating physician in

1125the course of labor, delivery, or

1131resuscitation in the immediate post - delivery

1138period in a hospital.

1142§ 766.309(1), Fla. Stat. An award may be sustained only if the

1154administra tive law judge concludes that the "infant has

1163sustained a birth - related neurological injury and that

1172obstetrical services were delivered by a participating physician

1180at birth." § 766.31(1), Fla. Stat.

118610. Pertinent to this case, "birth - related neurologic al

1196injury" is defined by Section 766.302(2), to mean:

1204injury to the brain or spinal cord of a live

1214infant weighing at least 2,500 grams for a

1223single gestation or, in the case of a

1231multiple gestation, a live infant weighing

1237at least 2,000 grams at birth cau sed by

1247oxygen deprivation or mechanical injury

1252occurring in the course of labor, delivery,

1259or resuscitation in the immediate

1264postdelivery period in a hospital, which

1270renders the infant permanently and

1275substantially mentally and physically

1279impaired. This d efinition shall apply to

1286live births only and shall not include

1293disability or death caused by genetic or

1300congenital abnormality.

130211. Here, while the proof demonstrated that Elizabeth was

1311permanently and substantially physically impaired, it also

1318demonstr ated that she was not permanently and substantially

1327mentally impaired. Consequently, given the provisions of

1334Section 766.302(2), Florida Statutes, Elizabeth does not qualify

1342for coverage under the Plan. See also Florida Birth - Related

1353Neurological Injury Compensation Association v. Florida Division

1360of Administrative Hearings , 686 So. 2d 1349 (Fla. 1997)(The Plan

1370is written in the conjunctive and can only be interpreted to

1381require both substantial mental and physical impairment.);

1388Humana of Florida, Inc. v. McKaughan , 652 So. 2d 852, 859 (Fla.

14002d DCA 1995)("[B]ecause the Plan . . . is a statutory substitute

1413for common law rights and liabilities, it should be strictly

1423construed to include only those subjects clearly embraced within

1432its terms."), approved , Flo rida Birth - Related Neurological

1442Injury Compensation Association v. McKaughan , 668 So. 2d 974,

1451979 (Fla. 1996).

145412. Where, as here, the administrative law judge

1462determines that ". . . the injury alleged is not a birth - related

1476neurological injury . . . he [ is required to] enter an order [to

1490such effect] and . . . cause a copy of such order to be sent

1505immediately to the parties by registered or certified mail."

1514§ 766.309(2), Fla. Stat. Such an order constitutes final agency

1524action subject to appellate court review. § 766.311(1), Fla.

1533Stat.

1534CONCLUSION

1535Based on the foregoing Findings of Fact and Conclusions of

1545Law, it is

1548ORDERED that the claim for compensation filed by Tammy Lea

1558Albritton and Douglas Edward Albritton, on behalf of and as

1568parents and natural guardians of Elizabeth Nicole Albritton, a

1577minor, is dismissed with prejudice.
