111PRELIMINARY STATEMENT
113Petitioners application for licensure as a Temporary
120Limited Surety/Bail Bond Agent was denied by Responde nt based on
131Petitioners plea of nolo contendre to two felonies in 1996 and
142his plea of guilty to a felony in 1999. The matter was referred
155to the Division of Administrative Hearings (DOAH), and this
164proceeding followed. 1 By Notice of Hearing entered Mar ch 15,
1752004, the final hearing was set for May 10, 2004, by video
187teleconference between Miami and Tallahassee, Florida. The
194Notice of Hearing was mailed to Petitioner at his last known
205address.
206Petitioner made no appearance at the final hearing.
214Respond ent offered no testimony, but it presented 12
223sequentially numbered exhibits, each of which was admitted into
232evidence.
233No transcript of the proceedings was filed. Respondent
241filed a Proposed Recommended Order, which has been
249duly - considered by the und ersigned in the preparation of this
261Recommended Order. Petitioner did not file a proposed
269recommended order.

283FINDINGS OF FACT
2861. On February 7, 2002, Petitioner applied to Respondent
295for licensure as a Temporary Limited Surety/Bail Bond Agent.
3042. Respondent is the agency of the State of Florida
314responsible for licensure of Temporary Limited Surety/Bail Bond
322Agents.
3233. In processing Petitioners application, Respondent
329conducted a routine investigation of his criminal history which
338revealed the facts set forth in paragraphs four and five of this
350Recommended Order.
3524. On July 15, 1996, Petitioner entered a plea of nolo
363contendre to two third degree felony offenses (both felonies
372were Resisting an Officer with Violence) and one first degree
382misdemeanor offense (Battery). Adjudication of guilt was
389withheld on all counts and Petitioner was placed on probation,
399which he successfully completed.
4035. On July 20, 1999, Petiti oner entered a plea of guilty
415to a third degree felony offense (Possession of Cocaine).
424Adjudication of guilt was withheld and Petitioner was placed on
434probation, which was subsequently extended. Petitioner
440successfully completed the extended term of pro bation.
4486. Respondent denied Petitioners application based on his
456criminal history.
458CONCLUSIONS OF LAW
4617. The Division of Administrative Hearings has
468jurisdiction over the subject matter of and the parties to this
479proceeding pursuant to Sections 120.5 69 and 120.57(1), Florida
488Statutes.
4898. As set forth in Respondents Proposed Recommended
497Order, Petitioners plea of nolo contendre to two felonies in
5071996 and his plea of guilty to a felony in 1999 constitute
519grounds for the denial of his application for licensure pursuant
529to Sections 648.27(2); 648.34(2); 648.355(1)(c); and 648.45(2),
536Florida Statutes.
5389. As the applicant, Petitioner has the burden of proving
548his entitlement to licensure. See, Florida Department of
556Transportation v. J.W.C. Co., Inc. , 3 96 So. 2d 778 (Fla. 1 st DCA
5701981) and Department of Banking and Finance v. Osborne Sterne
580and Company , 670 So. 2d 932 (Fla. 1996). Petitioner has failed
591to meet his burden in this proceeding.
598RECOMMENDATION
599Based on the foregoing Findings of Fact and C onclusions of
610Law, it is RECOMMENDED that Respondent enter a final order
620denying Petitioners application for licensure.

6961 / This matter was initially referred to DOAH in 2002 and
708assigned DOAH Case 02 - 4815. Respondent subsequently filed a
718Motion to Relinquish Jurisdiction so that Petitioner could
726atte mpt to get his felony pleas set aside in Circuit Court. On
739February 20, 2003, the presiding Administrative Law Judge in
748DOAH Case 02 - 4815 entered an order which closed that file and
761relinquished jurisdiction of the matter to Respondent with leave
770to file a motion to reopen the case if settlement could not be
783attained. On February 26, 2004, Respondent moved to reopen the
793matter. Respondents motion was granted, and the matter was
802assigned DOAH Case 04 - 0688.
