118STATEMENT OF THE ISSUE
122Whether Petitioners, K.W. and L.A.W., should be granted a
131license to be foster parents.
136PRELIMINARY STATEMENT
138On January 27, 2004, Respondent, Department of Children and
147Family Services, notified Petitioners that their application to
155be foster parents would not be approved based on a series of
167incidents of domestic violence and a negative ch aracter
176reference. On February 16, 2004, Petitioners requested an
184administrative hearing. On February 26, 2004, the case was
193referred to the Division of Administrative Hearings.
200On March 2, 2004, an Initial Order was sent to the parties.
212On March 22, 20 04, the case was scheduled for final hearing in
225Viera, Florida, on April 22, 2004. On Petitioners' motion, the
235case was continued and rescheduled for final hearing on June 2,
2462004.
247The case was presented as rescheduled. Petitioners
254presented the testimon y of Nancy Sley, William Carignan, John
264Wright, and Petitioners. Respondent presented the testimony of
272Anita Houchin and offered eight exhibits which were marked
281Respondent's Exhibits 1 through 8 and received into evidence.
290The parties requested and were given 30 days after the
300filing of the Transcript of Hearing to file proposed recommended
310orders. The Transcript of Hearing was initially misfiled with
319the Clerk of the Brevard County, Florida, Civil Court;
328ultimately, it was filed with the Clerk of the Di vision of
340Administrative Hearings on August 30, 2004. On November 22,
3492004, Respondent requested an extension of time to file its
359proposed recommended order. The request was granted, allowing
367Respondent until December 10, 2004, to file.
374Petitioners' Prop osed Recommended Order was filed on
382November 22, 2004. Respondent's Proposed Recommended Order was
390filed on December 10, 2004. Both parties' proposals have been
400given careful consideration in preparation of this Recommended
408Order.
409FINDINGS OF FACT
412Based on the oral and documentary evidence presented at the
422final hearing, the following findings of facts are made:
4311. Petitioners are a married couple who applied to
440Respondent for a foster home license. Petitioners have three
449children.
4502. The background in vestigation conducted by Respondent
458revealed reports of incidents of domestic violence and battery
467involving Petitioners and their children.
4723. On October 4, 1999, police officers responded to
481Petitioners' home after receiving a report of domestic violenc e.
491The officer's investigation revealed that one of the
499Petitioners, L.A.W., had been battered by her son. The child
509had been involved in pastoral counseling for his aggressive
518behavior. Petitioner, K.W., advised the police officer that the
527child, W.A.W ., would be moving from the residence because of his
539continuing inappropriate behavior.
5424. On April 7, 2002, another incident of domestic violence
552was reported and investigated. On this occasion, the two
561younger children of Petitioners were involved in a n altercation
571that resulted in Petitioner, K.W., being rendered unconscious by
580a blow to the head with an object delivered by one of the
593children, C.W. C.W. was arrested for aggravated battery.
6015. In February 2003, Petitioners desired to keep a six -
612mon th - old, unrelated child in their home. The child was placed
625in the home contingent on C.W.'s moving from the home and not
637residing in the home. Petitioners agreed to this contingency of
647placement, and the child was placed in Petitioners' home.
6566. On Nov ember 5, 2003, Petitioners applied to be licensed
667as foster parents. Ten days after Petitioners applied to be
677licensed, another incident of domestic violence occurred. On
685November 15, 2003, two of Petitioners' adult children got into a
696fistfight which re sulted in one having a broken nose. As a
708result, W.A.W. was arrested. At the time of the altercation,
718W.A.W., 21 years old and the oldest child who had moved out at
731an earlier time as a result of his behavior, was residing at
743Petitioners' residence. Alt hough the police report indicates
751that the incident occurred at Petitioners' residence, the
759testimony indicated that it occurred "down the street."
7677. All three of Petitioners' children continue to reside
776locally and frequent their parents' home.
7828. Peti tioners are highly recommended by a representative
791of The Children's Home Society, a Guardian ad Litem, and their
802pastor.
8039. Respondent has the responsibility of placing foster
811children in a safe setting. But for the behavior of their
822children, Petitio ners would qualify for licensure. As long as
832Petitioners' children frequent Petitioners' residence, any child
839placed in that residence is at risk. As a result, Petitioners
850are not qualified to be licensed as foster parents.
859CONCLUSIONS OF LAW
86210. The Di vision of Administrative Hearings has
870jurisdiction over the parties to and subject matter of this
880proceeding. § 120.57, Fla. Stat. (2004).
88611. Respondent is the agency charged with the
894responsibility of licensing foster homes. § 409.175, Fla. Stat.
903(200 4).
90512. Petitioners are applicants for a foster home license.
914Accordingly, as the party asserting the affirmative of an issue
924before this administrative tribunal, Petitioners have the burden
932of proof. Florida Department of Transportation v. J.W.C.
940Compa ny, Inc. , 396 So. 2d 778 (Fla. 1st DCA 1981). Petitioners
952must establish facts which support their position by a
961preponderance of the evidence. Department of Banking and
969Finance v. Osborne Stern Company , 670 So. 2d 932 (Fla. 1996).
98013. Subsection 409. 175(1)(a), Florida Statutes (2004),
987authorizes Respondent to establish rules regarding
993qualifications of parties seeking to be licensed as foster
1002parents.
100314. Florida Administrative Code Rule 65C - 13.011(11)(b)
1011reads as follows:
1014(11) Physical Environme nt.
1018* * *
1021(b) The home and premises must be free
1029from objects, materials, and conditions
1034which constitute a danger to children.
104015. Respondent relies on Subsection 409.175(2)(f), Florida
1047Statutes (2004), which reads, in pertinent part:
1054A license under this section is issued to a
1063family foster home or other facility and is
1071not a professional license of any
1077individual. Receipt of a license under this
1084section shall not create a property right in
1092the recipient. A license under this act is
1100a public trust and a privilege, and is not
1109an entitlement. The privilege must guide
1115the finder of fact or trier of law at any
1125administrative proceeding or court action
1130initiated by the department. (Emphasis
1135supplied)
113616. But for the conduct of their chi ldren, Petitioners
1146meet the licensure standards. However, the preponderance of the
1155evidence reveals that Petitioners' children frequent their
1162residence, and the unruly behavior of these children constitutes
1171a danger to a foster child as contemplated by Fl orida
1182Administrative Code Rule 65C - 13.011(11)(b).
118817. Given the Legislative directive contained in
1195Subsection 409.175(2)(f), Florida Statutes (2004), Respondent's
1201decision to deny Petitioners' application for licensure is
1209appropriate.
1210RECOMMENDATION
1211Based on the foregoing Findings of Facts and Conclusions of
1221Law, it is
1224RECOMMENDED that the Department of Children and Family
1232Services enter a final order denying the foster care license
1242application of Petitioners.
