107STATEMENT OF THE ISSUE

111Whether Petitioner is entitled to a passing grade on the

121Self Contained Breathing Apparatus section (the SCBA section) of

130the Firefigh ter Minimum Standards Examination (the Examination)

138administered September 25, 2003.

142PRELIMINARY STATEMENT

144The Examination consists of a written portion and a

153practical portion. The SCBA section is one of four sections of

164the practical portion of the Ex amination. Petitioner took both

174portions of the Examination on May 29, 2003. Petitioner passed

184the written portion of the Examination and three of four

194sections of the practical portion of the Examination.

202Petitioner failed the SCBA section.

207Pursuant to applicable statute and rule, Petitioner was

215permitted to retake the SCBA section on September 25, 2003. 1

226Thereafter, Respondent notified Petitioner that she had failed

234the retake of the SCBA section. Petitioner requested a formal

244administrative hearin g to challenge the scoring of her retake of

255the SCBA section, the matter was referred to the Division of

266Administrative Hearings, and this proceeding followed.

272At the final hearing, Respondent presented its evidence

280first to facilitate the proceeding. R espondent presented the

289testimony of Ralph Chase, Jr. (a field representative with the

299State Fire Marshal’s Bureau of Fire Standards and Training), and

309offered 11 sequentially numbered exhibits, each of which was

318admitted into evidence. Petitioner present ed no testimony and

327no exhibits.

329A Transcript of the proceedings was filed on June 10, 2004.

340Each party filed a Proposed Recommended Order, which has been

350duly - considered by the undersigned in the preparation of this

361Recommended Order.

363All statutory r eferences are to Florida Statutes (2004),

372and all references to rules are to those set forth in the

384Florida Administrative Code as of the date of this Recommended

394Order.

395FINDINGS OF FACT

3981. Petitioner applied to Respondent for certification as a

407firefig hter. Pursuant to Section 633.35, Florida Statutes,

415Petitioner was required to take and pass the written portion and

426all four sections of the practical portion of the Examination to

437achieve this certification.

4402. The practical portion of the Examinatio n consists of

450four sections: the SCBA section; the Hose and Nozzle Operation

460section; the Ladder Operation section; and the Fireground Skills

469section.

4703. On May 29, 2003, Petitioner took both the written and

481practical portions of the Examination. Sh e passed the written

491portion and three sections of the practical portion. Petitioner

500failed the SCBA section. Petitioner was not required to retake

510the written portion of the examination or the three sections of

521the practical examination she passed. Pet itioner thereafter

529retook the SCBA section on September 25, 2003.

5374. As implied by the name of the section, the SCBA section

549involves the use of equipment that enables a firefighter to

559breathe in a hostile environment, such as a burning building.

569The candidate must check the equipment, properly don the

578equipment, activate the equipment, and properly doff the

586equipment.

5875. Mr. Chase was responsible for administering and grading

596Petitioner’s retake of the SCBA section on September 25, 2003.

606To pass e ach section of the practical examination, including the

617SCBA section, a candidate has to achieve a score of at least

62970 points. 2 The candidate’s performance on the SCBA section is

640graded in ten categories, with each category being worth ten

650points.

6516. The greater weight of the credible evidence established

660that Petitioner's performance on the SCBA section of the

669practical examination was appropriately and fairly graded.

676Petitioner earned a score of 40 points on her retake the SCBA

688portion of the practi cal examination. Petitioner was awarded no

698points for six of ten categories for which points could be

709awarded. 3 Petitioner failed to establish that she was entitled

719to additional credit for her performance on the SCBA section.

7297. Respondent establishe d that Mr. Chase appropriately

737administered and graded the subject SCBA section pursuant to the

747applicable provisions of Chapter 69A - 37, Florida Administrative

756Code, which set forth guidelines for the practical examination.

765CONCLUSIONS OF LAW

7688. The D ivision of Administrative Hearings has

776jurisdiction over the parties hereto and the subject matter

785hereof pursuant to Chapter 120, Florida Statutes.

7929. Section 633.35, Florida Statutes, provides, in relevant

800part, as follows:

803(1) The division shall establish a

809firefighter training program of not less

815than 360 hours, administered by such

821agencies and institutions as it approves for

828the purpose of providing basic employment

834training for firefighters. . . .

840(2) The division shall issue a

846certificate of compliance to any person

852satisfactorily complying with the training

857program established in subsection (1), who

863has successfully passed an examination as

869prescribed by the division. . . .

879(4) A person who fails an examination

886given under this section may retake the

893examination once within 6 months after the

900original examination date. An applicant who

906does not retake the examination within such

913time must take the Minimum Standards Course,

920pursuant to subsection (1), before being

926reexamine d. . . .

93110. Florida Administrative Code Rule 69A - 37.056 pertains

940to the Firefighter Minimum Standards Test and provides, in

949relevant part, as follows:

953(6) All tests, both written and

959practical, given during training shall

964require maintenance of a pe rcentage score of

972not less than 70% on each subject listed in

981the prescribed Firefighter I and Firefighter

987II courses. If a minimum score of 70% is

996not achieved on any test, the student shall

1004be afforded a one - time make up examination

1013to achieve the requi red 70%.

103311. Petitioner has the burden of proving by a

1042preponderance of the evidence that she is entitled to a passing

1053grade on the SCBA section of the test administered Sept ember 25,

10652003. See Harac v. Department of Professional Regulation , 484

1074So. 2d 1333 (Fla. 3d DCA 1986); State ex rel. I. H. Topp v.

1088Board of Electrical Contractors for Jacksonville Beach, Florida ,

1096101 So. 2d 583 (Fla. 1st DCA 1958); and State ex rel. Glas er v.

1111J. M. Pepper , 155 So. 2d 383 (Fla. 1st DCA 1963). Petitioner

1123did not meet that burden in this proceeding.

113112. Petitioner argues in her Proposed Recommended Order

1139that she should be permitted an additional retake of the SCBA

1150section. The rational e underpinning her argument is rejected as

1160being contrary to the factual findings that the examination was

1170properly administered and graded. Moreover, her requested

1177relief is inconsistent with the provisions of Section 633.35(4),

1186Florida Statutes, and F lorida Administrative Code Rule 69 -

119637.056(6).

1197RECOMMENDATION

1198Based upon the foregoing Findings of Fact and Conclusions

1207of Law, it is RECOMMENDED that Petitioner enter a final order

1218finding that Petitioner failed the SCBA section of the practical

1228portion of the Firefighter Minimum Standard Examination

1235administered September 25, 2003.

1356must successfully complete to pass, regardless of total score.

1365The failure to activate and check a personal alarm as part of

1377the exercise is one fatal item. The failure to complete the

1388SCBA section within one minute, forty - five seconds is the other

1400fatal item. Those fatal items are not at issue in this

1411proceeding, although the scoring shee t completed by Mr. Chase

1421erroneously reflects that Petitioner did not timely complete the

1430SCBA section. This harmless error is not the basis for

1440Petitioner’s scoring on the SCBA section on September 25, 2003.

14503/ Petitioner failed to connect to her air s upply during the

1462exercise, which established that she failed to properly don the

1472equipment and failed to properly secure all valves and

1481connections. In addition, Petitioner failed to announce a

1489required numerical reading of her regulator, failed to proper ly

1499secure her facemask, failed to properly seal her facemask, and

1509failed to properly doff the equipment.
