119STATEMENT OF THE ISSUE

123The issue in the case is whether Petitioner’s employment

132position was properly reclassified from career service to the

141selected exempt service pursuant to Section 110.205(2)(x),

148Florida Statutes (2001) . All citations are to Florida Statutes

158(2001) unless otherwise stated.

162PRELIMINARY STATEMENT

164On July 1, 2001, the Department of Elder Affairs

173(Department) reclassified Petitioner’s employment position from

179the Career Service System to the Selected Exem pt System pursuant

190to Section 110.205(2)(x), Florida Statutes.

195Petitioner was notified by Respondent's letter dated

202July 21, 2003, that she could file a petition challenging the

213reclassification of her position. Petitioner timely petitioned

220for review of the reclassification. The Department forwarded

228the petition to the Division of Administrative Hearings on or

238about March 15, 2004. A formal hearing was scheduled for

248May 27, 2004. The Department filed an unopposed motion for

258continuance which was grante d. The hearing was rescheduled for

268July 9, 2004.

271The parties filed a Joint Pre - Hearing Statement in which

282the parties agreed that Petitioner’s position did not satisfy

291the definitions of managerial or confidential employee for

299purposes of Section 110.205( 2)(x), Florida Statutes.

306Accordingly, the remaining issue is whether Petitioner was a

315supervisory employee as the term is defined in Section

324110.205(2)(x), Florida Statutes.

327In the Pre - Hearing Stipulation, the parties requested

336Official Recognition of Sec tions 110.205 and 110.206, Florida

345Statutes. This request was granted.

350At hearing, Petitioner testified on her own behalf.

358Petitioner’s Exhibits numbered 1 and 2 were admitted into

367evidence. Respondent presented the testimony of Thomas Reimers.

375Respond ent’s Exhibits numbered 1 through 5 were admitted into

385evidence. A one - volume Transcript of the final hearing was

396filed on July 26, 2004. The parties requested and were granted

407leave to file proposed recommended orders 21 days after the

417filing of the tra nscript. Both parties timely filed Proposed

427Recommended Orders, which have been considered in the

435preparation of this Recommended Order.

440FINDINGS OF FACT

4431. Petitioner was employed with the Department beginning

451in 1998 as a Grant Specialist. In April 2000, she applied for

463and was promoted into a newly created position of Operations

473Management Consultant (OMC) Manager in the Serving Health

481Insurance Needs of Elders (SHINE) program. The SHINE program is

491primarily a statewide health insurance counseling program

498designed to serve Florida’s elders.

5032. At the time of her promotion, Petitioner’s new position

513was classified under the Career Service System. The position

522was reclassified from Career Service to Selected Exempt Service

531effective July 1, 2001.

5353. Petitioner’s position description describes the duties

542and responsibilities of the position as follows:

549The Operations and Management Consultant

554Manager assists with supervision and

559coordination of day - to - day volunteer

567management and program manageme nt functions

573for the SHINE (Serving Health Insurance

579Needs of Elders) Program. Works [sic] is

586performed under the supervision of the

592program coordinator (Senior Management

596Analyst Supervisor) and in support of the

603department’s mission, vision and values.

6084. The position description also provides percentages of

616time regarding activities engaged in pertaining to these duties

625and responsibilities:

62730% Manages volunteer support activities

632for the SHINE Program. Provides

637orientation, training and ongoi ng technical

643assistance to program partners and volunteer

649leadership; develops resource guides and

654other tools to assist with programmatic and

661operational issues; conducts meetings,

665workshops and seminars to build leadership

671skills; maintains regular commu nication with

677program liaisons and volunteer leadership;

682disseminates correspondence on key

686programmatic issues; helps resolve

690operational challenges; and works to ensure

696outcomes measures are achieved.

70020% Supervises volunteer service functions

705for the program. Develops protocols and

711tracking systems for service and support

717provided to volunteers and staff.

722Coordinates collection of information for

727the volunteer database and maintenance of

733volunteer files. Assists with surveys and

739evaluations. Superv ises activities of

744program staff.

74610% Assists with development, preparation,

751monitoring and oversight of contracts of

757agreement with providers and program

762partners.

76310% Performs other duties as assigned by

770SHINE Program Coordinator.

77310% Ensures the a spects of SHINE Program of

782Information& Referral (I & R), education and

789outreach are coordinated with the overall

795agency responsibility in those areas.

800Supervises staff activities as they relate

806to these functions.

8095% Takes the lead for the preparation for

817the SHINE grant reapplication and other

823related new grant applications and

828opportunities.

8295% Assists with budget development.

8345% Ensures that required grant reports and

841narratives are submitted to funder on time

848and complete.

8505% Represents Depart ment of Elder Affairs

857and SHINE at community education events for

864the public and the aging network. May make

872presentations at workshops, community forums

877and seminars as assigned. Serves as an

884advocate for elders.

8875. Further, the position description lists six positions

895which are described as “subordinate positions.” This is

903consistent with the organizational chart of the Division of Self

913Care and Community Volunteer Initiatives which also reflects six

922positions directly under her position. However, during the time

931Petitioner held the position of OMC Manager, there were some

941reorganizations that resulted in two of the positions being

950shifted, sometimes being under the authority of Petitioner and

959sometimes being under the authority of others. In any e vent, at

971all times material hereto Petitioner was the supervisor of five

981to seven persons.

9846. Petitioner does not dispute that she performed some

993supervisory duties. At hearing, she acknowledged that she had

1002supervisory duties, but asserts that she only spent a minimal

1012amount of time in the performance of supervisory activities.

10217. Each morning, Petitioner would hold a staff briefing

1030which lasted 15 to 30 minutes with the individuals she

1040supervised. Petitioner described these group staff meetings as

1048an update session to discuss “what’s hot, what are you working

1059on, do you need help, do you need information . . . and more

1073targeted towards continuing to instill a teamwork type of effort

1083in the attitude of the staff.”

10898. In addition to her duties regardin g staff, Petitioner

1099was also responsible for the oversight of contracts with program

1109providers and with volunteers. These providers and volunteers

1117were not employees of the Department. Petitioner estimates that

1126she spent between 50 and 75 percent of each day on contract

1138management issues. However, in terms of her responsibility to

1147develop, prepare, monitor, and oversee those contracts, she

1155would utilize her staff in order to carry out many of those

1167duties.

11689. Tom Reimers has worked for the Department since 1995.

1178He is currently the Director of the Division of Volunteer and

1189Community Services. Prior to that, he served as Director of the

1200SHINE Program. During part of that time, Mr. Reimers was

1210Petitioner’s direct supervisor.

121310. According to Mr. Reim ers, Petitioner was responsible

1222for the work product of the employees she supervised, in

1232reviewing their work product, in informing those employees when

1241their work product was inadequate, and in evaluating employees

1250including signing their “Review and Perf ormance Planning” forms.

1259Her signature on those employee reviews appears in the line

1269designated for “supervisor’s signature.”

127311. Mr. Reimers considered Petitioner to be a full - time

1284supervisor in that Petitioner had the authority to sign time

1294sheets, a pprove and consider requests for travel, provide

1303information to her employees about their job and about the

1313Department’s mission, ensure that they were carrying out the

1322mission, and provide guidance to her subordinate employees.

133012. When Mr. Reimers rec eived communications from the

1339persons under Petitioner’s supervision or needed to communicate

1347something to them, he would generally funnel that communication

1356through Petitioner.

135813. Moreover, Mr. Reimers was frequently out of the office

1368due to his job r esponsibilities. When he was out of the office,

1381Petitioner described herself as a “second - in - command type of

1393individual monitoring the program at home.”

139914. Mr. Reimers conducted Petitioner’s employee

1405evaluations. His review of her work included he r ability to

1416communicate with employees, whether she was properly assigning

1424and overseeing work of her subordinates, and whether she was

1434motivating her staff. Petitioner received positive evaluations

1441from Mr. Reimers.

144415. Petitioner interviewed applicant s for at least two

1453employment positions and made recommendations regarding their

1460employment. In both instances, those persons recommended by

1468Petitioner were hired.

147116. Petitioner was employed by the Department until

1479March 31, 2002, when her position was eliminated because of loss

1490of grant monies which funded her position.

149717. The weight of the evidence supports a conclusion that

1507Petitioner spent a majority of her time supervising employees as

1517contemplated by Section 110.205(2)(x), Florida Statutes.

1523CON CLUSIONS OF LAW

152718. The Division of Administrative Hearings has

1534jurisdiction over the parties and subject matter of this

1543proceeding. § 120.57(1), Fla. Stat. (2003)

154919. Unless exempted, all state employees are deemed to be

1559career service employees. See § 110.205(1)(“the career service

1567to which this part applies includes all positions not

1576specifically exempted by this part . . .”).

158420. Section 110.205(2)(x), Florida Statues, reads in

1591pertinent part, as follows:

1595(2) EXEMPT POSITIONS. -- The exempt positio ns

1603that are not covered by this part include

1611the following:

1613* * *

1616(x) Effective July 1, 2001, managerial

1622employees, as defined in s. 447.203(4),

1628confidential employees, as defined in

1633s. 447.203(5), and supervisory employees who

1639spe nd the majority of their time

1646communicating with, motivating, training,

1650and evaluating employees, and planning and

1656directing employees' work, and who have the

1663authority to hire, transfer, suspend, lay

1669off, recall, promote, discharge, assign,

1674reward, or dis cipline subordinate employees

1680or effectively recommend such action,

1685including all employees serving as

1690supervisors, administrators, and

1693directors. . .

169621. Respondent has the burden of establishing by a

1705preponderance of the evidence that the reclass ification of

1714Petitioner's employment position was proper under the applicable

1722statutes. Florida Department of Transportation v. J.W.C. Co.,

1730Inc. , 396 So. 2d 778 (Fla. 1st DCA 1981); Balino v. Department

1742of Health and Rehabilitative Services , 348 So. 2d 34 9 (Fla. 1st

1754DCA 1977). Based upon the parties’ stipulation, the only issue

1764is whether her position was that of a supervisory employee as

1775defined in Section 110.205(2)(x). 1/

178022. Petitioner's employment position meets the definition

1787of "supervisory employe e" as described above. Accordingly, the

1796reclassification of the position from career service to selected

1805exempt was authorized by the statute.

1811RECOMMENDATION

1812Based on the foregoing Findings of Fact and Conclusions of

1822Law, the Department of Elder Affair s should enter a final order

1834finding that the position held by Petitioner Candace C. McMahon

1844on July 1, 2001, was properly classified into the selected exempt

1855service.
