32ORDER OF DISMISSAL
35This matter came on for consideration on Respondent's
43Motion to Dismiss filed March 30, 2004. Having reviewed the
53file and being otherwise advised in the premises, it is
63ORDERED:
641. Section 760.11 establishes the process to be followed
73by Florida Commission on Human Rela tions (FCHR) when a charge of
85discrimination is filed. Section 760.11(3) and (7), Florida
93Statutes, states, in part:
97(3) Except as provided in subsection (2),
104the commission shall investigate the
109allegations in the complaint. Within 180
115days of the fili ng of the complaint, the
124commission shall determine if there is
130reasonable cause to believe that
135discriminatory practice has occurred in
140violation of the Florida Civil Rights Act of
1481992. When the commission determines
153whether or not there is reasonable c ause,
161the commission by registered mail shall
167promptly notify the aggrieved person and the
174respondent of the reasonable cause
179determination, the date of such
184determination, and the options available
189under this section.
192* * *
195(7) If the commission dete rmines that there
203is not reasonable cause . . . the commission
212shall dismiss the complaint. The aggrieved
218person may request an administrative hearing
224. . . but any such request must be made
234within 35 days of the date of determination
242of reasonable cause . . . . If the
251aggrieved person does not request an
257administrative hearing within the 35 days,
263the claim will be barred .
2692. On January 30, 2004, FCHR issued a Notice of
279Determination: No Cause, in FCHR No. 2201672, Ronald J. Clardy
289vs. FL Department of Corrections and informed Petitioner of the
299determination and his subsequent right to request an
307administrative hearing within 35 days of its determination.
315Petitioner had 35 days from January 30 or until March 5 to
327request a hearing.
3303. FCHR rece ived a Petition for Relief from Petitioner on
341March 8, 2004, more than 35 days after FCHR entered its
352determination. On March 9, 2004, FCHR properly issued a Notice
362of Dismissal for failure to timely file a Petition for Relief
373within 35 days after the dat e of its determination. Florida
384Administrative Code Rule 60Y - 5.008 and Section 760.11.
3934. In response to the dismissal, Petitioner provided FCHR
402with documentation that he sent, by next day delivery, his
412Petition for Relief to FCHR on the afternoo n of March 4, 2004,
425(approximately 34 days after the date of the Notice of
435Determination: No Cause). However, for unknown reasons, the
443petition was not delivered to or received by FCHR until March 8,
4552004 more than 35 days after the date of its determina tion. The
468petition was filed on the same date. Based on Petitioners
478documents, FCHR issued a Rescission of Notice of Dismissal on
488March 19, 2004. As sole reasoning for its decision to rescind
499the Notice of Dismissal, the Commission cited the fact that the
510petition was sent "in a timely manner as required pursuant to
521Rule 60Y - 5.008(1)."
5255. Rule 60Y - 5.008(1) states:
531Petition. A complainant may file a Petition
538for Relief from an Unlawful Employment
544Practice within 35 days of the Date of
552Determinatio n of Reasonable Cause, No
558Reasonable Cause, No Jurisdiction or
563Untimeliness. A complainant who is not
569represented by an attorney may file a
576Petition for Relief without copies or proof
583of service, and the Clerk shall prepare
590copies and serve them upon all other
597parties. (emphasis added)
6006. Rule 60Y - 5.008(3) states:
606Procedures. Petitions for Relief, and
611proceedings thereupon, are governed by the
617provisions of Chapters 28 - 106 and Florida
625Administrative Code Rule 60Y - 4, except as
633otherwise provided by this section.
6387. Section 120.569(2)(c), states, in pertinent part:
645A petition [for relief/hearing] shall be
651dismissed if . . . it has been untimely
660filed.
6618. The statute and the rule unambiguously provide that the
671Petition for Relief must be filed within 35 days of the date of
684the determination by FCHR. This time is jurisdictional and
693cannot be added to. There is a difference between filing a
704petition and serving a petition. Filing by definition occurs
713and is complete when an agency actually receives a document.
723Fla. Admin. Code R. 28 - 106 - 104. Service occurs and is complete
737when mailed or posted. The act required by the statutes and
748rule is filing of a petition, not service of a petition.
7599. In this case, Petitioner's Petiti on for Relief was not
770filed until received by FCHR on March 8, 2004, more than 35 days
783after the determination by FCHR. The fact that Petitioner sent
793the petition to FCHR on March 4, 2004, is irrelevant to a
805determination of when the petition was filed. FCHR has no
815authority to ignore the clear language of the statutes and
825rules. Therefore, the Petition for Relief is dismissed.
