37This matter comes on for review of Respondent's Motion to
47Dismiss Petition for Relief filed on April 9, 2004. The
57Petitioner filed a response to the motion on April 13, 2004.
68The Petitioner's complaint of discrimination was dual - filed
77with the Florida C ommission on Human Relations (FCHR) and the
88United States Equal Employment Opportunity Commission (EEOC).
95On February 10, 2004, the EEOC issued a Dismissal and Notice of
107Rights in which the EEOC states as follows:
115The EEOC issues the following determinati on:
122Based upon its investigation, the EEOC is
129unable to conclude that the information
135obtained establishes violations of the
140statutes. This does not certify that the
147Respondent is in compliance with the
153statutes. No finding is made as to any
161other issue s that might be construed as
169having been raised by this charge.
175On February 19, 2004, FCHR issued a Notice of Dismissal and
186Right to Sue which provides as follows:
193The case was dual filed with the EEOC, and
202the EEOC issued its determination that it
209was un able to conclude that the information
217obtained establishes violations of the
222statutes. Therefore, pursuant to the
227authority of Woodham v. Blue Cross & Blue
235Shield of Florida , 829 So. 2d 891 (Fla.
2432002), the case is dismissed and Complainant
250may pursue thi s claim in the Division of
259Administrative Hearings within 35 days of
265the date of this dismissal, or in civil
273court within 1 year from the date of this
282dismissal provided such time period is not
289more than 4 years from the date the alleged
298violation occurred .
301Florida Administrative Code Rule 60Y - 5.008(1) requires
309that a Petition for Relief must be filed within 35 days of
321the date of determination. Florida Administrative Code
328Rule 60Y - 3.001(29) provides that the "date of filing" means a
340completed complaint is received by FCHR prior to 5:00 p.m.
350(Eastern time).
352The 35 - day period from the February 19, 2004, date of the
365Notice of Dismissal and Right to Sue expired on March 25, 2004.
377In the Petitioner's response the Petitioner states that she
386mailed her Peti tion for Relief on March 29, 2004. The Petition
398for Relief was received and docketed by FCHR on March 31, 2004.
410Florida Administrative Code Rule 28 - 106.103 provides as
419follows:
42028 - 106.103 Computation of Time.
426In computing any period of time allowed by
434t his chapter, by order of a presiding
442officer, or by any applicable statute, the
449day of the act from which the period of time
459begins to run shall not be included. The
467last day of the period shall be included
475unless it is a Saturday, Sunday, or legal
483holida y, in which event the period shall run
492until the end of the next day which is not a
503Saturday, Sunday, or legal holiday. When
509the period of time allowed is less than
5177 days, intermediate Saturdays, Sundays, and
523legal holidays shall be excluded in the
530compu tation. As used in these rules, legal
538holiday means those days designated in
544Section 110.117, F.S. Except as provided in
551Rule 28 - 106.217, F.A.C., five days shall be
560added to the time limits when service has
568been made by U.S. mail. One business day
576shall be added when service is made by
584overnight courier. No additional time shall
590be added if service is made by hand,
598facsimile telephone transmission, or other
603electronic transmission or when the period
609of time begins pursuant to a type of notice
618described in Rule 28 - 106.111, F.A.C.
625In this case, the 35 - day time period began pursuant to the
638type of notice described in Florida Administrative Code Rule 28 -
649106.111 which addresses the Petitioner's point of entry into the
659administrative hearing process. Accordi ngly, no additional time
667for mailing is added to the deadline for filing the Petition for
679Relief.
680In the Petitioner's response to the Motion to Dismiss, the
690Petitioner states that she was not aware that weekends and
700holidays were included in the time com putation. The Petitioner
710is not subject to a lesser standard of conduct than a licensed
722attorney. A party's self - representation does not relieve the
732party of its obligation to comply with appropriate rules.
741Carr v. Grace , 321 So. 2d 618 (Fla. 3rd DCA 1 975), cert. denied
755348 So. 2d 945 (Fla. 1977).
761Based on the foregoing, it is hereby
768RECOMMENDED that the Florida Commission on Human Relations
776enter a Final Order dismissing the Petition for Relief filed in
787this case.
