142At issue is whether Isiah Jamal June, a minor, qualifies

152for coverage under the Florida Birth - Related Neurological Injury

162Compensation Plan (Plan).

165PRELIMINARY STATEMENT

167On May 3, 2004, Jennifer Anne Miller and S eti June,

178individually and as the parents and natural guardians of Isiah

188Jamal June (Isiah), a minor, filed a petition (claim) with the

199Division of Administrative Hearings (DOAH) for compensation

206under the Plan.

209DOAH served the Florida Birth - Related Neurol ogical Injury

219Compensation Association (NICA) with a copy of the claim on

229May 4, 2004, and on November 5, 2004, following a number of

241extensions of time within which to do so, NICA filed its

252response to the petition for benefits and gave notice that it

263was of the view that Isiah did not suffer a "birth - related

276neurological injury," as defined by Section 766.302(2), Florida

284Statutes, and requested that a hearing be scheduled to resolve

294whether the claim was compensable. By Notice of Hearing dated

304November 2 9, 2004, such a hearing was scheduled for March 1,

3162005.

317At hearing, the parties stipulated to the factual matters

326contained in paragraphs 1 and 2 of the Findings of Fact which

338follow, and Respondent's Exhibits A - H were received into

348evidence. No witnesse s were called, and no further exhibits

358were offered.

360The parties were accorded 10 days from the date of the

371hearing to file proposed orders. Respondent elected to file

380such a proposal, and it has been duly considered.

389FINDINGS OF FACT

392Preliminary finding s

3951. Jennifer Anne Miller and Seti June, are the natural

405parents and guardians of Isiah Jamel June, a minor. Isiah was

416born a live infant on August 23, 2002, at Central Florida

427Regional Hospital, a hospital located in Sanford, Florida, and

436his birth wei ght exceeded 2,500 grams.

4442. The physician providing obstetrical services at Isiah's

452birth was Michael Geiling, D.O., who, at all times material

462hereto, was a "participating physician" in the Plan, as defined

472by Section 766.302(7), Florida Statutes.

477Cover age under the Plan

4823. Pertinent to this case, coverage is afforded by the

492Plan for infants who suffer a "birth - related neurological

502injury," defined as an "injury to the brain or spinal cord . . .

516caused by oxygen deprivation or mechanical injury occurri ng in

526the course of labor, delivery, or resuscitation in the immediate

536postdelivery period in a hospital, which renders the infant

545permanently and substantially mentally and physically impaired."

552§ 766.302(2), Fla. Stat. See also §§ 766.309 and 766.31, F la.

564Stat.

5654. Here, the proof demonstrates that Isiah, who presents

574with a diagnosis of athetoid cerebral palsy, is permanently and

584substantially physically impaired. However, mentally, Isiah is

591not similarly affected or, stated otherwise, he is not

600perma nently and substantially mentally impaired. Consequently,

607for reasons appearing more fully in the Conclusions of Law, the

618claim is not compensable, and it is unnecessary to resolve

628whether Isiah's impairments resulted from a brain or spinal cord

638injury ca used by oxygen deprivation or mechanical injury

647occurring in the course of labor, delivery, or resuscitation, or

657whether his impairments are attributable to another etiology.

665CONCLUSIONS OF LAW

6685. The Division of Administrative Hearings has

675jurisdiction o ver the parties to, and the subject matter of,

686these proceedings. § 766.301, et seq ., Fla. Stat.

6956. The Plan was established by the Legislature "for the

705purpose of providing compensation, irrespective of fault, for

713birth - related neurological injury claim s" relating to births

723occurring on or after January 1, 1989. § 766.303(1), Fla. Stat.

7347. The injured "infant, her or his personal

742representative, parents, dependents, and next of kin," may seek

751compensation under the Plan by filing a claim for compensati on

762with the Division of Administrative Hearings. §§ 766.302(3),

770766.303(2), 766.305(1), and 766.313, Fla. Stat. The Florida

778Birth - Related Neurological Injury Compensation Association,

785which administers the Plan, has "45 days from the date of

796service of a complete claim . . . in which to file a response to

811the petition and to submit relevant written information relating

820to the issue of whether the injury is a birth - related

832neurological injury." § 766.305(3), Fla. Stat.

8388. If NICA determines that the inju ry alleged in a claim

850is a compensable birth - related neurological injury, it may award

861compensation to the claimant, provided that the award is

870approved by the administrative law judge to whom the claim has

881been assigned. § 766.305(6), Fla. Stat. If, on the other hand,

892NICA disputes the claim, as it has in the instant case, the

904dispute must be resolved by the assigned administrative law

913judge in accordance with the provisions of C hapter 120, F lorida

925Statutes. §§ 766.304, 766.309, and 766.31, Fla. Stat.

9339 . In discharging this responsibility, the administrative

941law judge must make the following determination based upon the

951available evidence:

953(a) Whether the injury claimed is a

960birth - related neurological injury. If the

967claimant has demonstrated, to the

972satisfaction of the administrative law

977judge, that the infant has sustained a brain

985or spinal cord injury caused by oxygen

992deprivation or mechanical injury and that

998the infant was thereby rendered permanently

1004and substantially mentally and physically

1009impa ired, a rebuttable presumption shall

1015arise that the injury is a birth - related

1024neurological injury as defined in s.

1030766.303(2).

1031(b) Whether obstetrical services were

1036delivered by a participating physician in

1042the course of labor, delivery, or

1048resuscitati on in the immediate post - delivery

1056period in a hospital; or by a certified

1064nurse midwife in a teaching hospital

1070supervised by a participating physician in

1076the course of labor, delivery, or

1082resuscitation in the immediate post - delivery

1089period in a hospital.

1093§ 766.309(1), Fla. Stat. An award may be sustained only if the

1105administrative law judge concludes that the "infant has

1113sustained a birth - related neurological injury and that

1122obstetrical services were delivered by a participating physician

1130at birth." § 766.31(1), Fla. Stat.

113610. Pertinent to this case, "birth - related neurological

1145injury" is defined by Section 766.302(2), to mean:

1153injury to the brain or spinal cord of a live

1163infant weighing at least 2,500 grams for a

1172single gestation or, in the case of a

1180multiple gestation, a live infant weighing

1186at least 2,000 grams at birth caused by

1195oxygen deprivation or mechanical injury

1200occurring in the course of labor, delivery,

1207or resuscitation in the immediate

1212postdelivery period in a hospital, which

1218renders the in fant permanently and

1224substantially mentally and physically

1228impaired. This definition shall apply to

1234live births only and shall not include

1241disability or death caused by genetic or

1248congenital abnormality.

125011. Here, while the proof demonstrated that Isiah was

1259permanently and substantially physically impaired, it also

1266demonstrated that he was not permanently and substantially

1274mentally impaired. Consequently, given the provisions of

1281Section 766.302(2), Florida Statutes, Isiah does not qualify for

1290coverage u nder the Plan. See also Florida Birth - Related

1301Neurological Injury Compensation Association v. Florida Division

1308of Administrative Hearings , 686 So. 2d 1349 (Fla. 1997)(The Plan

1318is written in the conjunctive and can only be interpreted to

1329require both subst antial mental and physical impairment.);

1337Humana of Florida, Inc. v. McKaughan , 652 So. 2d 852, 859 (Fla.

13492d DCA 1995)("[B]ecause the Plan . . . is a statutory substitute

1362for common law rights and liabilities, it should be strictly

1372construed to include only those subjects clearly embraced within

1381its terms."), approved , Florida Birth - Related Neurological

1390Injury Compensation Association v. McKaughan , 668 So. 2d 974,

1399979 (Fla. 1996).

140212. Where, as here, the administrative law judge

1410determines that ". . . the i njury alleged is not a birth - related

1425neurological injury . . . he [is required to] enter an order [to

1438such effect] and . . . cause a copy of such order to be sent

1453immediately to the parties by registered or certified mail."

1462§ 766.309(2), Fla. Stat. Such an order constitutes final agency

1472action subject to appellate court review. § 766.311(1), Fla.

1481Stat.

1482CONCLUSION

1483Based on the foregoing Findings of Fact and Conclusions of

1493Law, it is

1496ORDERED that the claim for compensation filed by

1504Jennifer Anne Miller and Seti June, individually and as parents

1514and natural guardians of Isiah Jamel June, a minor, is dismissed

1525with prejudice.
