105STATEMENT OF THE ISSUE

109The issue is whether Respondent should grant Petitioner's

117application for licensure as a building inspector.

124PRELIMINARY STATEMENT

126On March 17, 2004, Respondent notified Petitioner of the

135prop osed denial of Petitioner's application for licensure as a

145building inspector. Petitioner timely requested an

151administrative hearing.

153At the hearing, Petitioner testified and submitted three

161exhibits for admission into evidence. Respondent called no

169witn esses and submitted four exhibits. The identity of the

179witnesses and exhibits, and the rulings regarding each, are

188reported in the Transcript of the hearing filed with DOAH on

199August 11, 2004.

202By letter dated July 16, 2004, Petitioner complained that

211Re spondent had not filed the transcript that Respondent

220requested to be filed at the conclusion of the hearing. By

231Order dated August 11, 2004, the ALJ ordered the parties to file

243their respective proposed recommended orders (PROs) no later

251than September 2 0, 2004. However, the Order and Transcript

261crossed in the mail, and the Transcript was filed on August 11,

2732004. Petitioner timely filed a PRO on August 16, 2004.

283Respondent timely filed a PRO on September 10, 2004.

292FINDINGS OF FACT

2951. By Notice of Int ent to Deny dated March 17, 2004

307(Intent to Deny), Respondent notified Petitioner that it

315intended to deny Petitioner's application for licensure as a

324building inspector. Respondent alleges that Petitioner does not

332have five years of combined experience i n the field of

343construction or a related field, building code inspection, or

352plans review corresponding to building inspection; and that

360Petitioner did not provide an affidavit for each separate period

370of work experience from an architect, engineer, contra ctor, or

380building code administrator who has knowledge of Petitioner's

388duties and responsibilities.

3912. Petitioner satisfies the requirements stated in the

399Intent to Deny as the grounds for denying Petitioner's

408application. Petitioner's testimony at the h earing was credible

417and persuasive.

4193. The affidavits admitted into evidence at the hearing,

428without objection, supplement Petitioner's testimony and show

435that Petitioner has the required five years' combined experience

444in building construction or a rel ated field and that the

455experience specifically corresponds to building inspection.

4614. Respondent has previously licensed Petitioner as a

469Provisional Building Inspector, One and Two Family Dwelling

477Inspector, Coastal Construction Inspector, and Building C ode

485Administrator. In order to obtain a Coastal Construction

493Inspector License, Petitioner must have five years' experience

501in the construction field or a related field.

509CONCLUSIONS OF LAW

5125. DOAH has jurisdiction over the parties and subject

521matter of this proceeding. §§ 120.569 and 120.57(1), Fla. Stat.

531(2003). DOAH provided the parties with adequate notice of the

541administrative hearing.

5436. Petitioner bears the ultimate burden of proving

551entitlement to a license. Florida Department of Transporta tion

560v. J.W.C. Co., Inc. , 396 So. 2d 778 (Fla. 1st DCA 1981).

572Petitioner has shown by a preponderance of the evidence that he

583satisfies the criteria for the license that are stated in the

594Intent to Deny as grounds for the denial. Respondent cannot

604deny P etitioner's license application on grounds not stated in

614the Intent to Deny. Respondent previously licensed Petitioner

622in a category with requirements substantially similar to those

631at issue in this proceeding.

636RECOMMENDATION

637Based on the foregoing, it is

643RECOMMENDED that the Respondent enter a final order

651granting Petitioner license application.
